Bengaluru, Sep 24: Siddaramiah, by treading a line that his predecessors had not, proved himself to be different from others. In the past, state governments led by S M Krishna and S Bangarappa had shown the courage to disobey Supreme Court orders. But on account of legal lacunae found on both the occasions, they were compelled to withdraw their decisions and apologize to the apex court.

Siddaramiah however, has taken an intelligent and bold decision in not adhering to the orders of the Supreme Court. Many say credit needs to go to former Prime Minister, Deve Gowda, who gave sound advice on the issue to the chief minister.


In the previous cases, contempt of court was committed. However, this time, the government has moved carefully to ensure that words like declining to follow the Supreme Court order do not appear anywhere in the resolution. The unanimous resolutions passed by both houses of the legislature to use water available in reservoirs only for drinking purpose is in tune with the law where drinking water use gains precedence over irrigation.

Both Supreme Court and houses of legislature are constitutional bodies. It is the duty of the government to follow the decisions taken by these bodies. If the Supreme Court tries to blame the government for contempt of court, the government now has the option to seek shelter under the cover of unanimous resolutions passed by the state assembly and legislative council.

During Bangarappa's regime, ordinance was issued against release of water, but the Supreme Court had upheld the order of the tribunal to release water. When the state refused to abide by this order, it faced contempt of court case. Finally the state was made to release water to Tamil Nadu and apologize.

When S M Krishna was the chief minister, the emergency cabinet meeting had taken a decision not to comply with the Supreme Court order to release 1.25 tmc water to Tamil Nadu. As this was blatant violation of Supreme Court order, the government was compelled to apologize and release water later.

In the meanwhile, leader of the opposition in assembly, Jagadish Shettar, said that he would write to the centre not to form Cauvery River Water Management Board as directed by Supreme Court as it is impossible. "Neither the state nor Tamil Nadu had sought formation of this board. Supreme Court on its own accord passed this order. Board formation entails lot of procedures and it is detrimental to the interests of Karnataka. Therefore, the central government would be requested not to form it," he said.

    If we stand united definitely we will achieve success. The problem is that it is raining heavily the other side. If we get so much rain at Madikeri (Talakaveri) at the catchment area (Kaveri Ugamasthana) then there is no question of grudging to release water from Kaveri.

    Yesterday it was reported that Amma was admitted to hospital with fever and dehydration.
    I think fever because of Karnataka government's fighting response and dehydration may be because of lack of Cauvery water.
    Today it has been reported Amma is going to Singapore for treatment for high sugar and some kidney problem. Why suddenly all these ailments ?

    What BJP demanded was to take advantage of the situation for political gain. They expected CM to follow supreme court order and thought they could take advantage by not being part of the meeting. But the CM was courage's by declining to accept the Supreme Court order and decided to have a session - And wise decision of not mentioning water for irrigation but a resolution for the purpose of drinking water. This was not suggested by BJP, please dont be so blind in supporting BJP at all cost appreciate the CM for his decision & Deve Gowda for his suggestion. And ask your BJP MP what they have done for the state in this matter when the BJP is heading at the center...

    For your kind information, if you see the petition filed by the Karnataka in all 3 occasions it mentioned water is more important for drinking purpose in Karnataka, but it also mentioned we ready to release 10000CU for 10 days

    I appreciate all the good decisions taken by all goverments in India, but here my question is delay to act which meant Karnataka Lost Thousands of Crores due to strike

    Petition may have been given considering various circumstances which I am not aware of as I am not an expert. But being a common man what I can understand that the Supreme court was bias towards Karnataka. Which even our politicians may not have expected. What was said by the government was release of 10000 Cusecs for only 10 days (Probably considering we need to share our resources as we all are Indians), but the Supreme Court said to release 15000 Cysecs, even after requests the Supreme Court again asked to release 12000 Cusecs of water, even they went against the experts and asked to release 6000 Cusecs. No where the Government mentioned we have excess of water but were fair to release some water to Tamil Nadu which would have been fair. The issue to strike was due to Supreme Court revised order for 12000 Cusecs for additional 10 days. BJP has so many MP in central why didnt they ask the center to interfere why this game of silly politics. If you cant do good at least dont pull down others doing good, if you cant appreciate others at least dont degrade all ways. Kindly read all facts again it may help you...
