SC directs H D Kumaraswamy, his wife to face trial in graft case


New Delhi, Sept 27(PTI): Former Karnataka Chief Minister H D Kumaraswamy and his spouse will have to face criminal trial for alleged misuse of official position in granting lease to a mining firm and allotment of 80 acres of land to a private cooperative society, the Supreme Court said today.

The allegations against the Janata Dal (Secular) leader include that he abused his official position in granting lease to a mining company for lifting of one lakh metric tonne of iron ore.

"You should face trial", a bench of Justices Ranjan Gogoi and P C Pant said while rejecting their contention that the case was made out of political vendetta. "Of course, you are a political person. You will say it...Just because you were Chief Minister it does not mean that you would not face the trial," the bench said.

The apex court allowed the plea filed by advocate M Vinod Kumar against the Karnataka HC order of October 21, 2011 that had quashed the proceedings initiated against the couple by the Special Lokayukta Court on his complaint. It said that high court should not have quashed the order and proceedings against the accused.

"The allegations against them ought to have been adjudicated in the trial," the bench said while setting aside the high court's order. The bench, however, said it has not expressed any opinion on merit of the allegations and all the defences of the accused would be open.

The cases against Kumaraswamy and his wife Anita, then a JD(S) MLA, were related to renewal of mining lease to the Jantakal Mining Firm in alleged violation of norms and alleged irregularities in allotment of sites to Vishwabharathi Housing Cooperative Society, which had made a quid pro quo site allotment to Anita, during Kumaraswamy's tenure as Chief Minister in 2006.

    There are similar orders of the High Court in exactly similar cases involving senior politicians from various parties. It is significant that the State of Karnataka was not an appellant in this case. It was pursued by the individual complainant. Politicians in Karnataka have a tradition of covering for each other irrespective of the party to which they belong. It is hoped that the lokayukta prosecutors will now go ahead with this case and with similar others without delay.

    This JD [S} born in Karnataka couple of decades ago, struggling with party's imbalances and still within Karnataka only yet.
    See this AAP born couple of years ago and approached 6 plus states already in expanding strength without money power.

    JD(S) in Karnataka is splinter group of the larger Janata Pariwar parties. These socialist parties are there in various states in India under different leaders, different names - but ideology, pro farmer stance etc same

    So you have Samajwadi Party, BSP and RLD in UP, JD(U), RJD in Bihar, SJD in Kerala, JD(S) in Karnataka...Socialists are relevant in UP, Bihar, Karnataka and Kerala only as of now...Rest ZERO

    HDK no doubt is one of the most corrupt politicians!. How else can their family own thousands of crores of assets!?. As a film producer, he may get some tens of crores and if all the films were hit!. Over that making Kannada films, only few crores he may earn. HDK has to first come clean himself and then talk of others!

    JDS district working president, Sanketh Poovayya, despite clean chit by CBI, protested against induction of KJ George.
    Now leave your Kodagu and protest against his supremo H D Kumaraswamy and his wife!
    Demand their resignation till trial in graft case is complete!
    If they don't resign, Poovayya shouldn't remain in JDS.
    Otherwise he must quit JDS district president post in protest!
