Deposits above Rs 2.5 lakh to face tax, 200% penalty on mismatch


New Delhi, Nov 10 (PTI) : Further dangling the stick, government warned that cash deposits above Rs 2.5 lakh threshold under the 50-day window could attract tax plus a 200 per cent penalty in case of income mismatch.

"We would be getting reports of all cash deposited during the period of November 10 to December 30, 2016, above a threshold of Rs 2.5 lakh in every account.

"The (tax) department would do matching of this with income returns filed by the depositors. And suitable action may follow," Revenue Secretary Hashmukh Adhia said tonight. Any mismatch with income declared by the account holder will be treated as a case of tax evasion.

"This would be treated as a case of tax evasion and the tax amount plus a penalty of 200 per cent of the tax payable would be levied as per the Section 270(A) of the Income Tax Act," he said.

The government has allowed citizens to deposit in their bank accounts old currency of Rs 500 and Rs 1,000 denominations, which had been declared invalid in the nation's biggest crackdown on blackmoney, corruption and counterfeit notes, between November 10 and December 30.

Adhia said small businessmen, housewives, artisans and Adhia said small businessmen, housewives, artisans and workers who had some cash lying as their savings at home should not be worried about any tax department scrutiny.

"Such group of people need not worry about such small amount of deposits up to Rs 1.5 or 2 lakh since it would be below the taxable income. There will be no harassment by the Income Tax Department for such small deposits made," he said. On people resorting to buying of jewellery, he said persons buying jewelery has to provide the PAN number.

"We are issuing instructions to the field authorities to check with all the jewellers to ensure this requirement is not compromised. "Action will be taken against those jewellers who fail to take PAN numbers from such buyers. When the cash deposits of the jewellers would be scrutinised against the sales made, whether they have taken the PAN number of the buyer or not will also be checked," he added.

    If money once deposited was withdrawn for some purpose and kept in hand what is the purpose of depositing again and for how many days, months and years if their purpose of money not served? One earns money to spend for their use not to keep as deposit. People deposit excess money in Bank to earn interest not keeping oneself hungry.

    No where it said if one deposits your tax paid money more than 2.5 lakhs. Any one can deposit any Quantum of amount to bank, but it should be tax paid, otherwise it will attract tax & penalty. Some people who are crying are those who have stacked plenty & are acting like fish out of water..

    At the break of midnight all Indian 500 and 1000 denomination notes lost currency value. It was a surgical act on those with limited stock of money saved for future use. Further more the citizen has to earn little value of those denominations by disclosing identity. Money saved for future safety becomes biting viper and everybody start burning it like dry leaves. What kind of situation this?

    This has greatly affected those who do not believe in abiding the laws and not following the govt. banking procedure but hoarding the money.

    I wish BJP govt. will come with citizen friendly Income tax formalities which every common man can understands. Also the slab of income tax should go up, so that every citizen is able to buy a house for himself.

    This will definitely will affect the real estate companies if they have hoarded the currency illegally. Shortly I am sure, real estate prices will collapse.

    Hope the real estate prices will collapse, so that the lower income groups can afford to buy a decent house.

    200% penalty on tax payable means you are paying 100% (tax plus penalty) on your cash deposits in excess of taxable income d in your IT Return. As in India those in higher tax bracket already pay 30% Tax, 12% Surcharge on Tax and 3% Education Cess on Income Tax plus Surcharge.

    Then people with 10L plus annual income may be better off not disclosing anything as there is actually nothing left for them if they or not !!! They may be paying more than 100% !!! What a non practical provision. isn't it ?

    Govt. better check practical utility of this provisio.

    When it comes to money, there is no BJP nor Congi but its people's hard earned money. The RBI did not deliver sacks of money at peoples door but they earned it, irrespective of a party they are affiliated to.

    Well, if at all somebody is in trouble, its the rich, businessmen, institutions who took lacks of amount in donation but never d it, Doctors who charged through the nose but never issued a receipt, Engineers, who charged to pass an inspection stage and so on. There is no issue at all with salaried people, whose income is regularised.

    There is news already about money being shredded and set on fire. Do you think its just paper ? No, it has a worth and Modi has caused this burning. He enticed people to surrender their cash by Sept. but the response was pittance. This is his next move, the 'Thedi ungli' to remove the ghee.

    Some people mis-understand the entire concept of demonetizing old notes. People hide money in order to avoid paying taxes, hide their illegal businesses, bribes etc. Some people like government servants and illegal business houses, even if they want to pay taxes on their bribes/illegal earnings,they cannot do it because potential exposure of their criminal activities. Such people accumulate huge purchasing power and willing to pay potential price than the actual price for any commodity. An honest man suffers as he cannot afford to match the potential price in the market. Real estate is one example.

    I am not a BJP fan. Politics aside, what PM Modi has done is a brilliant move that put Harvard educated financial Pundits to shame. It is fair to note that the former RB Gov. Raghuram Rajan once spoke about demonetizing of Rs.500 and Rs.1000 notes to flush out the black money from the economy. How it has been done is commendable.

    There is $240 billion worth of total Indian currency in circulation. Out of which, $210 billion worth of currency is in Rs.500 and Rs.1000 notes. No one is sure how much will be flushed out. One thing is sure that an honest person is happy today because he is expecting the prices to fall in the market.

    Mohammed, Porbus are the most happiest people at present because most of them are not affected by the demonetization. Porbus spend their money educating their children in foreign Universities, building houses like mini-palaces, spending lavishly on weddings, parties, drink superior liquor,eat good food and at the same time donating to various charities to uplift the poor and downtrodden irrespective of caste and religion. Perhaps you may not be aware that the new generation of Porbus are well educated and highly placed in top most institutions around the world. They are peace loving and law abiding people. Their businesses are straight forward no illegal business like gold smuggling, terrorism,supari killings, anti-national activities, etc. You should appreciate, how effectively the Porbus have handled the Church attack without any violence.     This step is taken on the misguided assumption that all the black money is hoarded in cash & bound to fail as only people with cash on hand like traders or village people who still doesn't like to deposit their savings in banks do save by hoarding.
    The Big Fish always invests their money into other assets like land, gold & foreign investments or in foreign currencies which no government will dare to touch as they are fund givers to the parties at election time.
    Only achievement for election propaganda here is stopping fake currency in circulation for a short time as counterfeiters will adopt the new currency as well.
    But the only sufferers here will be common people & small traders going through the process of submitting currency to the banks & getting it back in small amounts standing daily in long ques.
    The process could have been smooth tracked without labeling the holders of this worthless notes as criminals by making them go through the grind for no fault of theirs.

AADHAR card, linking of it with bank accounts, with all subsidies, limits on gas cylinders etc were started by UPA and that time you all protested!!!. That was all part of controlling black money. When Chidambaram started Financial inclusion scheme by aiming to bring every one to have a bank account, you people had protested, saying, how will the poor people open bank accounts when they dont have enough for everyday!.     I am worried about those poor domestic helpers and the lot like them including the common man you refer to, who have been toiling day-in and day-out to save some money for their child's further education or their daughter's marriage and preferred to keep their savings in the safety of their homes in denominations of 500s and 1000s.

    I never panicked, am not panicking, and will never panic! Like I said, there might be a bandwagon of CAs, Bank Managers, Lawyers etc.. etc.. who could be following my interests.

    I am just voicing my concerns for those forgotten poor and destitute who I am sure will end up paying the price intended for the super wealthy.
