Bengaluru: Assault in pub - court dismisses Mohammed Nalapad's bail application

Bengaluru, May 31: A court in the city has dismissed the bail application moved by Mohammed Nalapad, son of Shanthinagar MLA N A Haris on Wednesday May 30.

Nalapad has been in jail since the last over 14 weeks for the alleged murderous assault he launched on Vidwath. Currently he is under judicial custody.

The order issued by the 63rd Sessions Court in the city has dashed the hopes of Nalapad of getting bail even after chargesheet was filed in the case. As a result, he is forced to remain inside the prison at least for the time being.

After his bail application was quashed by the state High Court in the past, Nalapad had moved bail application for the second time in the sessions court after chargesheet was filed. Judge of the court, Parameshwar Prasanna, who conducted hearing into the petition, ordered quashing of the application.

The court noted that the accused is facing charge of attempt to murder under section 307 of Indian Penal Code under which there is provision to award life term imprisonment. "A perusal of statements by witnesses gives clear picture about the seriousness of the incident. The accused is an influential person and hearing in the case has not concluded. There is possibility of destruction of evidence and influencing witnesses if he is released. Therefore, at this stage, bail cannot be granted," the judge observed before dismissing the application.

The judge also noted that the investigation conducted so far and medical reports contain strong evidences about the veracity of the incident. "When considering bail application in the past, the High Court had gone through the video footage of the incident and opined that the matter is serious, before quashing the application. Moreover there is no rule that bail should be granted immediately after chargesheet is filed. Therefore, the bail application stands dismissed," the judge observed.

Advocate for Nalapad, Usman, said that his client would appeal in the High Court against the court order.

    This is the reason we love INC,they are and were always victim supporters not the goonda mla supporters unlike in UP, Rajesthan,MP etc.

    Very good decision by court.Let him regret.And we are 100%sure his father is also not supporting him.Coz we know senior nalappad ,very good man,u can ask any locals.That's why he won .

    Any parents shouldn't support their child when they are wrong.supporting them blindly will backfire us parents only.

    good for nalapata...if you were muslim, you will not be in pub...in the first place...you sinned even more by brutally attacking a much weaker opponent in a spirit of power and avenge surrounded by minions..

    now in this holy month of ramadan, do your fast, prayers, iftar everything in solitary confinement in jail...meditate, reflect and repent....you have to pass through the punishment God chose for you for your irreligiousness...

    bail is secondary..when you come out of jail, come back as good muslim
