Brutal assault in pub - High Court grants conditional bail to Mohammed Nalapad

Bengaluru, Jun 14: Karnataka High Court granted conditional bail to Mohammed Nalapad, son of Shanthinagar MLA N A Haris on Thursday, June 14.

Nalapad has been in jail from several weeks for the alleged murderous assault he launched on Vidwath and was under judicial custody.

Justice John Michael D’Cunha, who heard the bail plea for over two hours, delivered the order. As per latest reports, Nalapad will have to furnish a bond of Rs 2 lac and cannot leave the city.

Earlier, an order issued by the 63rd sessions court in the city had dashed the hopes of Nalapad of getting bail even after chargesheet was filed in the case. As a result, he was forced to remain inside the prison.

    Justice Michael D'Cunha is considered a very upright person who never bends to any kind of pressure. He is held in high esteem by the advocates for his vast knowledge on legal matters. While I was extremely glad when he delivered a verdict against Jayalalitha, I am unhappy that this Nalapad has been granted bail. God knows on what grounds Justice D'Cunha granted him bail but I am sure he must have had his own reasons for doing this.

    My friend, do not tarnish a HC judge’s reputation, when you do not know the facts or the law. This is the same judge who ruled against Jayalalitha which was ultimately upheld by the Supreme Court.

    You may not like the law of our land. But a judge has to rule according to the law and legal precedents set by various HC / SC judgements over the years.

    Just wait for couple of days, and then go to Supreme Courts website where all SC / HC judgements are published, read it with a cool head and then tell me the deficiency if his judgement. Judiciary does not exist just to uphold what you think is right, rather it exists to uphold the law.

    Since this is not a murder case the accused is entitled to bail as per law, as he is in prison for 115 days now.

    What people want is that the case be decided soon and strict punishment be given. The punishment should be like make him sweep/ clean the streets where he is to do the hooliganism. He will remember the punishment for ever. Just putting in prison will not help them to realise their mistake.
