Bangalore: LGBT Community Rejoices Over Verdict

BANGALORE, Jul 3 (The Hindu): As soon as the verdict on Section 377 of the Indian Penal Code was out on Thursday morning, hundreds of lesbian, gay, bisexual and transgender (LGBT) people and their supporters gathered at the United Theological College (UTC) in jubilation.

While the reading down of the law that now decriminalises homosexuality in the Indian Penal Code may be seen as a victory that has emerged out of the Delhi High Court, it has entailed an eight-year-long legal battle fought from across the country that culminated in this epic judgment. The country now joins the ranks of 128 countries where homosexuality is not a criminal offence.

Here in Bangalore, from where hundreds of affidavits about experiences of the LGBT community went on to be part of the petition filed by the Naz Foundation from New Delhi, celebrations at UTC began with distribution of sweets.







 

Members of organisations such as Sangama, Samara, Good As You (GAY), Swabhava, and the Alternative Law Forum (ALF) from Bangalore, who were among the many who provided material for the litigation, were at the venue with several other supporters. Revathi, a transsexual activist, said that the community, years of the country’s Independence, finally felt like they had some legitimacy in the society. Sumathi, of Sangama, said: “We are finally no longer criminals!”

One important question being asked in the midst of the celebration is that if the read-down law would apply to courts outside the Union Territory of New Delhi.

Advocate Siddharth Narrain of the ALF explained: “Since there is no other law that now criminalises consensual sex among adults in private, all high courts and lower courts across the country will have to take cue from this particular judgment.”

He said that in the coming days the government will have to decide if it would want to appeal against the judgment. “We are hopeful that they will not,” he said.

Advocate and human rights activist B.T. Venkatesh said that while this would be one of the many steps in the recognition of the LGBT community, at least “their existence as people would finally be recognised.”

Another issue being raised among community members was that of police harassment. They wonder if the attitude of the police, especially towards the hijra community, would change with the judgment. “If nothing else, they cannot at least arrest us,” said one community member.

    Every human being have their own rights, then why not LGBT communities? God has created everybody, and it is their own right to be what they are.. How does it matter to any politicians or some religious communities. If their own son or a daughter is a gay or a lesbian will they give the same "No! it is not a physical disorder.. it is as natural as heterosexuality. moreover treat them as human beings... not as animals. One more point to be noted is that, many men and women''s life is ruiened because they are forced to get married, because of their parents.. and ruien their''s and other''s life.. neither they are able to tell boldly about their sexual orientation nor avoid marraige...

    I think we people are thinking within the box. It is not necessary that two people get together only for SEX. LETS THINK BEYOND OUR BOUNDARIES. Lets learn to respect, live and let live. Whats wrong in seeking companionship of another person belonging to the same sex. Its all about sharing our joys and sorrows and not just body pleasure. If its looking dirty for some please close your eyes and walk.

    Through the most retrograde verdict on July 2 declaring section 377 of the Indian Penal Code (which punishes unnatural sex) as violating the fundamental freedom of “gays,” the honorable judges of the Delhi High Court have unfortunately made a significant contribution to expediting the ongoing phase of India’s “cultural catastrophe.”

    If the morally debased and sexually perverted people can be called a “sexual minority,” and, therefore, entitled to the elimination of all legal barriers to their debauchery, time is not far off when they may claim the constitutional right to make the demonstration of their heinous crimes at street corners, and the judges such as A.P. Shah and S. Muralidhar may not hesitate to concede to their request.

     Homosexuality is prohibited in all religions of the world. These acts of immodesty are a slur on the rich cultural heritage of India, which as a single entity, represent a composite national creed. One is astonished that Indian Muslim scholars have reacted to the Delhi High Court Judgment in a myopic manner as if the legalization of homosexuality were the negation of Islamic mandates only. It is a national offense. It is a crime against humanity.

    If, in the West, it has been legalized, it is against their basic cultural ethos and religious scripts. The church has always condemned it in totally unequivocal language. In India it is not the question of Hindu, Muslim, Christian, Sikh or Parsi culture, but it is the question of the magnificent structure of the grand edifice of the country’s ancient heritage which must not be allowed to be spoiled by gays and lesbians.

    All Indians are in dire need of constructive cooperation for the sake of their country’s heritage, for the sake of their children, for the sake of womanhood, and above all for the sake of those distinctive values for which India is still known as the fountainhead all over the world.

    I would have appreciated if Court legalised Prostitution.At least sex workers will get 3 times meal and live their life with dignity. This HOMOSEX is utter nonsense.

    homosexulity is given by nature.if take the history it couild be hyderabadh nizames or vijayanagar.they were homosexuals and they were treated as equals.science tells u homosexulity.in the vedas speally in the rigvedas there is a mentionion about homosexuls hinduism as a religion it wa s never against for it during the vedic period,the kamasuthra talks openly about homosexualit.the homosexuals are in the minority.so dont try to insult or hate them.the nature has created in that way.if we do not accept them it is our sin . respect them.

    This is wrong on so many levels. God has not meant for this to ever happen. If this was right, would not God have first created the world with two men/women? Punishment and atonement awaits these foolish uneducated people and all those who support them. This is against all the laws of nature. Prayer is needed to heal the souls of these people.

    Big Joke. What is the result of Homosexuality ? Can they produce children ? If their parents also did this, whether these people will come to this earth ? What a mad world. Why so importance to this matter ? In US decade old court struggle was there for this impotent issue... Please do keep those concepts away from Indian morally rich family concept.

    No doubt LGBTs have equally fundamental rights as other citizen of India but no FRs provide such type of activity & it could not be justified on the ground of basic rights such as provided under art14,15&21 our constitution maker have certain object behind these rights & if court or parliament legalize it. It means that he does not care about object of constitution.

    God has blessed some people with different inherent characteristics, why should we humans discriminate against them and take away their fundamental rights. Who are we to point fingers and judge that what they are doing is sinful. Also what has this got to do with culture? LIVE AND LET LIVE IN PEACE.

    The Indian judiciary has matured and come of age all such pedantic laws should be struck down. Hope the government will follow the example set by the judiciary and not succumb to the pressure of hard line religious fundamentalists and appeasement politics.

    As the time changes, people''s thinking has to change. Change is inevitable and is basic for survival. People who judge LGBT as bad for the society have to think twice. Is it the hypocritical standard imposed on them by the society makes them think so? Are those who are vociferous in their criticism of LGBT are also equally vociferous against communialism, robbery, rape, murder...etc. that is prevelent in every society? LGBT does not harm the society, but communalism, rape, murder etc. does. Let us start accepting people as they are and fight against the real evils of society instead of fighting against the way some people are born.
