Bengaluru: HC takes Aadhaar as proof, orders husband to pay alimony

Bengaluru, Dec 30: A woman who fought against her estranged husband who claimed that she was not his wife, has finally succeeded in getting favourable decree from the state high court. The high court (HC), when ordering the man to pay her alimony, solely depended on the fact that the man's name was mentioned as husband in Aadhaar card, ration card, and birth certificate.

The man had reportedly developed physical relationship with her and later married her. She also gave birth to two children. The high court has now ordered the man to pay her sustenance at the rate of Rs 5,000 every month.

A single judge bench of the state high court presided over by Justice B A Patil observed that the defendant often visited the lady. He developed physical relationship with her on account of which the woman gave birth to two children. The bench therefore, ordered the man to pay sustenance allowance to the woman every month.

The bench observed that the lower courts had erred in handling this case properly in the face of claims by the defendant that she is not his wife. "A perusal of documents provided by the litigant go to prove that the two had married and he fathered her two children. The argument put forth by the man that she is not his wife just to escape from the responsibility cannot be accepted," the high court said.

    Seems everything is going as per the whims and fancies of judges and not according to law.

    Countless times it is seen that the lower courts give an extremely opposite verdict to that of high court and Supreme court. While it is understandable in complicated issues like Ram Mandir, in a simple case like this why the lower court did not close the matter like high court did?

    As per government we can prove our citizenship but using the same aadhaar card government will prove our stupidity.
