Governor returns file on M’lore varsity VC
Bangalore, Feb 5 (DHNS) : Governor H R Bhardwaj on Thursday returned the file sent by the state government on appointment of new vice-chancellor to Mangalore University.
The Governor has taken objection to the government’s move of sending only a single name in its submission note instead of a panel of three as specified by law. “The government has not sent the panel of three persons whose names were submitted by the government by the search committee. Instead the government has forwarded only one name of Prof B Thimme Gowda”, the Governor, who is also the chancellor of all universities in the state, said in his notings.
Violation of law
“It is a serious illegality that the chancellor has been deprived of his role in appointment of vice-chancellor and it is difficult to apply the mind on the basis of merit, equity and social justice unless other names have also been sent in the submission note. I do not approve the single name sent by the government”, the Governor has stated while returning the file.
The Governor noted that as per section 14 (4) of Karnataka State Universities Act 2000 requires the chancellor to take a decision keeping in view the merit, equity and social justice and thereafter the concurrence of the state government is required.
“The submission note has foreclosed the application of mind of the chancellor because the name of two other candidates - Prof Abdul Rahiman and T C Shivashankara Murthy have not been included in the panel sent by the government to the Chancellor”, the Governor noted.
Section 14 (4) of KSU ACt 2000 states that the search committee shall submit to the State government a panel of three persons who are eminent academicians in alphabetical order. The State government shall forward the panel to the chancellor who shall, keeping in view the merit, equity and social justice and with the concurrence of the state government appoint one person from the panel as vice-chancellor.

Fri, Feb 05 2010I do not understand all the ruckus. The governor has merely returned the file pointing out legal non-compliance. The government has to just make corrections and send it back to the governor. He is just doing his job. I do not understand all the talk about government dismissal, puppet etc!

I dont understand why state govt is indulging in all these contrversies.ion of VCs shall be kept out of petty politics. Lets hope current HRD minister Mr.Sibbal, will revamp the system. What more can we expect from people who have been eyewashed by members of the BJP who called Dr. Manmohan Singh a shikandi. Take time to read Dr.Singh's resume.And a small advice, you will need atleast 3 hours to read and comprehend it entirely. This indirectly diminishes the chance of eminent academician like Thimme Gowda becoming VC. May be government has some other name in mind for post.

Fri, Feb 05 2010What is happening in Karnataka? First governor rejects the name of one person out of three recommended for nomination to Legislative council. Then the governor rejects single name suggested by stste government for appointment as Vice-chancellor of Mangalore University. Governor Bharadwaj is a former Union Law minister and he certainly knows the constitution and the laws of land. Ex-minister Somanna, a party-hopper`s name was proposed for nomination to Council under the `education and social service' category.How can one expect the governor accept the proposal? Karnataka State Universities Act clearly states that govt.send panel of three names submitted by search committee, to the governor for appoinment as Vice-Chancellor. But this govt. sends only one name out of three to the governor and expects that he approves it. Now it is clear who is right and who is wrong.

Fri, Feb 05 2010His Excellency the Governor H.R.Baradwaj was a law minister and law adviser. Hence he knows the laws well. The fundamentals are blaming him as a directed person of UPA. What about Mr. Yeddyurappa? Has he not acted according to the direction of Sushma Swaraj and the ministers were inducted by forcing/willingly ping/withdrawing Ministress Shoba Karandlaje. BJP did not Mr. Gadkari RSS ed and made him known as BJP president. I appreciate the Governor’s moves now and before.

It is expected from the saffron brigade when they find you a stumbling block in their programme of saffornizing the field of education. But you are bound by your constitutional duties to the State. For all practical purposes, YOU are the constitution for the people of the state. We always look up to you to right the wrongs of this government.

A former Union Law Minister, who is well-versed in all legal aspects & constitutional provisions, has rightly asked the Government to follow the Rule of Law. The past Governments may have got away with what they wanted merely because the Governors were rubber-stamps or political lightweights without the required stature or intelligence to understand legal niceties. That does not mean all Governors should accept what the Gocvernments of the day recommend. The Government & its legal brains would do well to first learn what they should do & follow in accordance with law. If they don't, more embarrassments will come.Even if the Government wants to favour somebody, there should be some legal justification so that nobody should be able to question the decision or challenge in a court of law. That will be even more damaging.
