Defence land sold to Bengaluru Metro by CSI - ED seizes compensation amount

Daijiworld Media Network - Bengaluru (SP)

Bengaluru, Sep 10: The enforcement directorate (ED) has recovered the compensation amount received by the Church of South India (CSI) by disposing off defence land to Bengaluru Metro.

The ED has ordered State Bank of India's Sudhama Nagar branch to hand over Rs 59.52 crore standing in the name of the Church of South India Trust Association, under the illegal money laundering act. This amount was kept in the form of term deposit.

The land belonging to the defence department had been given to All Saints Church here for religious purposes. But the ownership rested with the defence department. Out of this, 7,421.886 metres land was handed over to the Bengaluru Metro by the CSI. As compensation, it had received Rs 59.52 crore. A case had thereafter been filed contending this to be illegal.

During the investigation, it became clear that the church did not own this land. Moreover, it was given only for religious purposes. Therefore, the compensation should have gone to the defence department. Therefore, the ED said it had recovered the compensation amount.

American Consulate in Mumbai, transferred their office from Lincoln House to Bandra Kurla coplex. Lincoln house in a 2 acre land was on lease and owned by Indian defence dept. In September 2015, it was sold for a reported Rs 7.5 billion, to Cyrus Poonawalla, Chairman of the Poonawalla Group, who planned to use the property as a family home. Though, Indian govt tried to get the 750 crore (7.5 Billion) from American Consulate, it was not able to recover. American Consulate is not even perturbed.

Indian government claimed the amount, American Consulate never bothered to return. Claim may be still there, but American Consulate is not showing any inclination to pay. Indian ED has no authority to impound embassy accounts.

This land once belonged to the British Army. A part of it was donated to the church for religious activities. Obviously after independence it was inherited by the Ministry of Defence. Now was this donation made without paperwork? If the church does not possess any document of possession then how come they got compensation? There must have been underhand dealings somewhere. The concerned registrar as well as the responsible officials of BMRC and MOD should also be taken to task.

During the East India Company and British Raj days, for the British officers, a small church would be built in the cantonments (military stations).

    There were no papers.

    The churches were Protestant.

But, after Independence, the Protestant churches became known as CSI/CNI, and continued to manage the cantonment churches. The Indian military had no clue what was going on.

It may be difficult for the Indian military to claim ownership of the land on which the churches stood as there may no papers on transactions whatsoever.

Regardless, the churches did not buy/own the land. It is ultimately the Government land.

Land is allotted to religious purpose. The land isn't sold but used by railway services. The money paid compensation. For sale there should be sale deed. If land is of defence why they were silent. The land nearby also to be investigated. How the construction was allowed

It was in 1865 when your masters were in charge of defence, when they gave the lease to church it was not a sale. Forged documents were created to show it as a sale, and claim the compensation.
