Assembly vandalism case: Court asks 6 accused to appear on Oct 15


Thiruvananthapuram, Sep 22 (IANS): A city court on Tuesday dismissed a Kerala government plea to withdraw a 2015 case registered against six sitting legislators at that time on the charge of vandalism in the Assembly and directed them to personally appear in court on October 15.

Those directed to appear in the Chief Judicial Magistrate's court are present Industries Minister EP Jayarajan and Higher Education Minister KT Jaleel and four others -- V Sivankutty, K Kunju Ahamed, CK Sadasivan and K Ajith -- who are no more members of the House.

After Sivankutty wrote to Chief Minister Pinarayi Vijayan, the government decided to seek withdrawal of the case, even though a Crime Branch probe had allegedly found wrongdoing on the part of the then Left lawmakers.

Leader of Opposition Ramesh Chennithala too had become a party in the petition to withdraw the case, maintaining that it should not be done as public property was destroyed by responsible persons.

The accused had allegedly indulged in vandalism on March 13, 2015, when then Kerala Finance Minister KM Mani was presenting the state Budget.

The3 then Opposition led by the Communist Party of India-Marxist had protested that Mani -- accused of taking Rs one crore in bribe from a bar owner for reopening bars in Kerala -- would not be allowed to present the Budget.

When Mani began his speech, the Left legislators went berserk, throwing the Speaker's chair from the dais and damaging electronic equipment installed on his table.

After the incident, then Speaker N Sakthan had sought a Crime Branch probe that blamed the six accused for the Assembly ruckus.

    It was really pathetic and demeaning to see the elected representatives of people, hete MLAs, resorting to vandalism and bedlam in the Assembly. In the process, they damaged furniture, electronics gadgets in the Assembly. When the members of Legislative Assembly swoop to the levels of goons, people lose their faith in democracy. It was really a black day in the annals of Kerala legislative Assembly. The citizens of the country now bemoan over the democracy going by the way the legislatures behave, the stories of corruption reported to by them,. They never care about the welfare of the people.
    All the more shocking is the fact that the present LDF Government wanted to withdraw the cases registered against the members of the previous legislative Assembly. It is very unethical, illegal, immoral and against the principles of democracy and rule of law.
    The Trivadrum CJM Court's judgement is a historical one. The people have faith in judiciary only now, as they only come as deterrent authorities against the illegal and high handed actions of MLAs.
    By delivering such a powerful judgement, the judge has upheld the law of the land in letter and spirit. The judgement should serve as an eye opener to the criminal minded so called people's representatives. The CJM has drawn the admiration of all the people for his strong proactive judgement. He has rightly and dutifully delivered a a judgement that is written for the people.
    The Government will definitely will go for an appeal in the district court against the CJM judgement. By doing so, they should understand that they would be challenging the wisdom and faith of people in democracy. No one will blame the people if they prefer and come forward for an alternative system of governance. The guilty and culprits who have plundered the public money should be punished. No one should allay with such illegal activities of any politician. We pray that better sense and responsibility prevail upon the politicians.
