Kundapur: Court sentences man to 10 yrs prison, slaps Rs 60,000 fine for raping minor

Kundapur, Jan 29: Kundapur district and additional sessions Justice Narahari Prabhakar Marate has announced the quantum of punishment for the accused who had raped a girl for several years by making false promises of marriage.

Back in 2005, the accused Pradeep Naik (36), resident of Konjadi, near Ardi, had come for masonry work at the house of the victim. He had built a relationship with the then 15-year-old victim by assuring her that he will soon marry her. On these grounds, the accused, for nine years raped her by continuing to make promises of marriage. However, he denied to actually get married when the victim insisted on it.

The court now in its ruling has sentenced Pradeep to 10 years of rigorous imprisonment for rape under IPC section 376 and slapped a fine of Rs 50,000 for illegally entering the house. The sentencing is imprisonment of every year that the accused cheated the victim. The accused has been also ordered to pay Rs 5,000 each under IPC section 448 and 417 for cheating.

The court has ordered that out of the total fine of Rs 60,000, accused has to pay Rs 50,000 to the victim as compensation.

    Only 10 years prison to the rapist? What is the guarantee that once he comes out from jail or on bail doesn't rape anyone??? We are very liberal to rapists and criminals and hence the crime rate in India is very high. Our politicians are very fast in making law to increase their salaries but to bring strict law to punish the criminals they are reluctant. Reason is loud and clear as most of these politicians are criminals and rapists. We just get number of rapists and criminals but do the government take any action against them? No. They just gave them more powers.

    15 Year old girl and Marriage Promise with the father aged Man. What Rubbish. its not considered as Rape. because both agreed . now he is not agree for the marriage,for that he require punishment. but Rape .........????

    Nagpur (Maharashtra), Jan 29 (IANS): Acquitting a 26-year-old man in a rape case, the Bombay High Court has recently ruled that it is highly impossible for a man to gag a girl, de-nude her and self and then rape a 15-year old girl without a scuffle.

    In a verdict delivered last fortnight, Justice Pushpa Ganediwala at the Nagpur Bench said that there were no signs of any scuffle between the accused and the minor victim, while hearing an appeal by the convicted accused in an eight-year-old rape case under the POCSO Act....

    hey Rudolf , The judge from Nagpur doing very good job , giving neutral judgement , normally sessions courts are very biased against men .

    Look at this case man probably had love affair with 15 year girl , now court says he didnt married her ! , while marrying girl below 18 is itself is offence , so whats the option left for this poor guy . Teenage girls r very vocal now a days , but when relationship gets public its only men are arrested .

    ... the Bombay HC acquitted a man from a very similar case where the lower court had sentenced him to a 10-year prison term.

    The Bombay HC seems to be going by a reasonable assessment rather than jumping to conclusion based on the 'defence' arguments.

    According to the higher courts. over 80% of the so-called rape cases are not so.

    Punishment awarded is enough for Pradeep and other would be
    Opportunists who in the false promises spoil girls career .
    In the mean time the girls career and future is at stake. It's a misery in her life time.

    If pradeep wanted to marry this girl, who was a minor at that time, he could have approached to her parents and expressed his interest to get married with her instead of misusing her under false promises. He could have waited the girl till she finished her studies. He was more aged than her obviously he had more than experience in life than her. If she was behaving inappropriate, matter should have brought to her parents instead of misusing her. Because, many of us speak I'll of those girls, many cases are quietly erased without being bringing to the notice of the court.

    10 is too less for such a grievous offense could have granted 20 max behind bars + 5,00,000k towards victim. unfortunately due to spartan age told 60's one of the weakest judicial system in the world right now we don't have community service system after completion of prison term and moreover several rape / murder cases against kids haven't received full justice nor any of them are arrested.
