Bhardwaj Rebuffs CM Again, Returns Bill on Akrama-Sakrama

Bangalore, Sep 27: Governor Hans Raj Bhardwaj, who has been at loggerheads with the B S Yeddyurappa-led BJP regime more often than not, has returned the Karnataka Town and Country Planning and Certain Other Laws (Amendment) Bill 2009, popularly known as the Akrama-Sakrama legislation, providing for regularisation of unauthorised constructions in the state for the second time.
               
Home and transport minister R Ashok, who is chairman of the Cabinet sub-committee on Akrama-Sakrama scheme and an ardent votary of the move, indicated that the governor had returned the Bill to the government stating that the issue was pending before the state High Court.
               
The governor had refused to give his assent to the Ordinance promulgated by the government for regularisation of the illegal constructions in different cities across the state suggesting that the legislation should be discussed in the state legislature first instead of being promulgated as an ordinance.

Following the governor’s decision to return the Bill, the state is exploring various options, including legal, for regularisation of illegal structures, the minister indicated.

Incidentally, the governor, a former union law minister,  had recently declined assent to the state’s controversial Bill on banning cow slaughter and referred it to the President for scrutiny, inviting the anger of the ruling BJP which has vowed not to rest till the ban was implemented.

Bhardwaj had publicly chastised the Yeddyurappa regime over various issues ever since he assumed charge as the governor, starting with the series of attacks on churches, the alleged assaults on women and girls in Mangalore and other places as also other incidents of moral policing, including illegal mining and law and order, bringing him and the ruling party on a collision course.

The state BJP leaders, particularly the state BJP president K S Eshwarappa and even former national BJP president Venkaiah Naidu, have been openly critical of the governor and had even accused Bhardwaj of acting as an agent of the Congress. Naidu, a Rajya Sabha member from state, had gone to the extent of asking the governor to resign his post and become a spokesman of the Congress if he was so much enamoured of the Congress-led UPA regime which had appointed him to Raj Bhavan.

The issue would also be discussed with minister for law and parliamentary affairs S Suresh Kumar and state advocate general Ashok Harnahalli, he said mentioning that he would first discuss the issue with the chief minister B S Yeddyurappa.

However, Ashok claimed that the advocate general had informed him that the matter was not before the court.

The government would provide all clarifications sought by the governor and appealed to him to reconsider his decision, he said adding that implementation of the proposed law would also help families to get access to basic services in cities and towns.

Official sources said the governor’s action was based on a state High Court verdict last year, which disapproved of regularisation of illegal constructions.

It may be recalled that the Bill was passed without a debate and amidst dharna by the Opposition demanding a CBI probe into illegal export of iron ore from the state during the budget session of the state legislature.

The law and parliamentary affairs minister, who spoke to reporters, disclosed that he or other ministers would meet the governor, if necessary, and convince him about the importance of the Bill.

The Bill was passed keeping in mind the interests of the poor and middle class families who had built houses on revenue sites measuring 30x40 sq ft  and 20x20 sq ft or built houses in violation of the law, Ashok explained.

    Its not opposition’s duty to destabilise the ruling government
    The first BJP government in the south bastion is in deep trouble. CM Yeddyurappa has been in trouble since inception of the government. These troubles have been more due to infighting in the BJP. Not long agoBJP had got resounding success in the municipality elections. Barring Christians, none of the communities has any sort of problem from BJP. It is not a hidden secret that larger segment of church has been demanding for the dismissal of Yedurappa government and had even submitted memorandum to governor in this regard.
    The current trouble in the BJP is due to resentment in the certain section of MLAs. Congress and JD(S) have become active to take advantage of the situation. It is futile to expect value based politics from government. However, Congress has forgotten that how Kumaraswami had dethroned Congress ruled Dharma singh government 4-years-ago.
    From the last few years this has become tradition of opposition to destabilise the ruling government at any cost. No one can deny role of opposition in democratic establishment. It is also true that governments become autocratic in the absence of opposition. But if opposition destabilises any functioning government, then it should also present viable option to people. But, the million dollar question is will JD(S) and Congress dare to form the government?
    It is obvious that Congress was never able to digest BJP government in the south bastion. Church equally disliked BJP government. This was precisely the reason Congress government sent former law minister Hansraj Bhardwaj to contain the BJP government. Post of governor is very important in the constitution and everbody expects impartial behaviour and not politically motivated behaviour. Hansraj Bhardwaj has miserably failed on this account. He is more seen as Congress worker and less as a governor.
    A seminar in the India Habitat Centre in Delhi was organised by journalists to discuss on the role of governor of Karnataka in the last month. Many former governors and legal luminaries had criticised him for his alleged role in the state. He is constantly creating obstacles for CM Yeddyurappa
    Now, ball is in the court of central government. Governor has raised question on the win in the confidence motion. Governor has proposed for President Rule in the state. Speaker of the assembly disqualified 16 MLA’s. Disqualified MLA’s are now in the cort that will review decision of speaker.
    Will BJP be able to save government? Only future will tell this. But, it is the democracy which has been ashamed from the political maneeuvers of governor. The way in which governor directed speaker not to disqualify MLA’s made it aptly clear that he is more in the role of opposition. Karnataka episode has once again raised this question of more political reforms in the country.

    Why are you frustrated so much with the power of Sonia Gandhi?

    In the last election people had to make choices from two people. On one side there was Italian born politician who was thriving for unity of Indians and touching the pulse of poor people, on the other hand they had Pakistani born politician who was responsible for communal divide in India. People made their choice and reposed faith in Italian born politician as they thought she is better than the sulking politician(later he was sidelined by his own party because they found him as liability more than an asset to the party). Now what is the point in getting so much frustrated by her popularity and power?

    Problem with the main opposition party is that they have no leaders with the stature of Sonia or Rahul to counter them. Atal was the tall leader and he could have been useful at this stage. There is a necessity for the main opposition party to develop a more acceptable leader to counter the Congress and that is possible if they can follow the path of Atal which was all inclusiveness and respect for all.

    It is a known fact that Sonia is more leftist than Congress and this has helped in forcing the common man programmes like NREGA and Food Security Bill.

    Nagesh Nayak, unfortunately for you the people of this country does not go with the pseudo nationalist propaganda but on the basis of actual work on the ground.

I had advised you to be little careful when you made personal comment on me on some other article but you seem to have not changed. But I am not surprised as you are the follower of philosophy of the likes of nagesh nayak and the frustration is understandable.

    Now coming to your comment on NRIs I would like to tell you that we send major part of our hard earned money to our motherland so that the money can be spent in our country thus giving our bit in the progress of economy. Many of the NRIs including me contribute a bit to the social causes in our country and I can give hundreds of examples of such activity. Even though we are away, we always think of our country and all Indians stay united irrespective of caste, religion or region. We mourn whenever anything bad happens in India and the best example when Mumbai attack happened most of the Indians I met here were shocked and pained as if death happened in their own family.

    Mr Richard I agree with your comment that it is impossible to break our united society by foreign support but unfortunately this is systematically done by the Sangh Parivar in the name of religion. Pseudo nationalists like you do not understand that you are damaging the very fabric of Indian Constitution by such acts.

    Kannada proverb used by you fits well to BJP and Sangh Parivar.

    As regards the article I can only say that let the better sense prevail.

    MR MAHEDRA SHETRE,GOV's activitism is not new in Indian political history.Every successive govt doing the same thing.Had BOMMAI govt's dismissal not happened earlier by office of the gov and then SC intervened and said dismissal is illeagal,null and void, I think the present govt may dismissed earlier.BJP also not lag behind in this issue as in UP also same thing happend by then Gov Bhandary under NDA Govt.After BOMMAI fiasco SC have given a direction that the counting of majority of MLAs are not in Gov's office instead in the house only.As a democracy lover,I am not in favor of gov's role in popularly elected govt.

    Sunil Pinto, do you remember recently he publicly insulted Dy.VC of an university for overruling governor's order not to take action against an univerisity official who was indicted by an enquiry committee. The governor wanted to overrule that decision. So, you want to respect these type of politician-cum-governors. One more thing he acts like a governor because Karnataka is ruled by NDA. If it is ruled by Congi, then Mr. Bharadwaj will act like a rubber stamp- you got it?

    It is very suspicious about BJP government and what they are doing. It looks like that they are playing a very dirty POLITICAL game and trying to bluff the Karnataka State people.
    1. Why the ministry did not go through with all details before sending or passing it?
    2. When it was rejected for some reason for first time, why the government did not ask the legal opinion by legal authorities?
    3. Why CM is not calling all political party meeting with authorities and trying to implement the right and good law in the state?
    4. Government want to make illegal construction as legal with some fine Is the right way or do the authorities are looking other facts like road approach, emergency services etc are disturbed by this illegal construction? If yes what will be the solution?
    I feel that the CM and his gang want to blame the Governor for their fails and irresponsibilities. We can expect many more bills will pass in assembly and will send and rejected due to some serious reasons. So the CM and his team can blame the Governor for NOT approving it. It is shows that CM and his Team are NOT having enough experience to rule the State and their main aim is to fulfill their pocket.

Also now a days people are complaining that no plan is getting sanctioned for independent house building in Mangalore which makes one think why is it so???  The reason is very obvious...the builder lobby is very strong and wants to make merry when sun shines.....
