Taxi Driver Sentenced for Life in Pratibha Murder Case 

Bangalore, Oct 8 (IANS): A fast track court here Wednesday sentenced Bangalore taxi driver Shiva Kumar to "life imprisonment till death" for the 2005 murder of Hewlett Packard (HP) India employee Pratibha Murthy.

Pronouncing the judgment in a packed court room, Judge B.V Guddali of the 11th fast track court sentenced him under Section 302 of the Indian Penal Code (IPC) for murdering the 28-year-old.

The judge also sentenced the accused to 20 years of rigorous imprisonment with a fine of Rs.20,000 under Section 376 of the IPC for raping Pratibha. Shiva Kumar was also handed down a sentence of 10 years rigorous imprisonment with a fine of Rs.10,000 for kidnapping Pratibha under Section 366 of the IPC.

Shiva Kumar was convicted for the gruesome crime Wednesday.

The shocking incident took place in the early hours of Dec 13, 2005 when Pratibha was picked up by the accused from her house for the graveyard shift (late night duty) in the HP office in the electronics city, about 30 km from city centre.

Pratibha's body was found with her throat slit in a pit near Anjanapura layout on the outskirts of south Bangalore.

Though Shiva Kumar first confessed to the crime, he later backtracked and denied all the charges.

The trial has been going on in the courts for four-and-a-half years. It began in a sessions court in Bangalore in January 2007 and was shifted to a fast track court in December 2009.

A total of 71 witnesses had been examined in the case.

    fast track took 5 years. normal 25 years.all together 30 years to get the verdict. very good. no matter what crime you do, nowadys we all die within 60, so you can do whatever crime you want, the verdict doesnt come until your normal death, and you are innocent until you are proved, so if you do crime and if you have little power then you are fine. or else you can rape, murder and still live happily without any punishment. very good.it looks like why strugle to get work, and get into strugle and live? go for rape murder or any big crime, such as murders for money. if you are caught the worst will be you are behind bars with free food and accomadation. what a country what a law. God save India and its people from these dirty people.

    The court has overstepped in its verdict and shown leniency towards the guilty. The judge has shown remorse and in his verdict, by sentencing him jail until death, he has upheld the right to live, where as the judge forgot intentionally that the victim's life was cut short judge to satiate the sexual urge. If the victim was raped and let to live, then this judgement would have been welcome one, but the victim was killed to erase the evidence which itself is a major crime. The mother should move to appalent court and challenge the verdict and must see the guilty is sent to gallows in public as a deterrent to others. Ind India, people have been practicing double standards.

    We give lectures on women, we call them mothers, sisters, when mother India is painted in nude, we protest and call for painters hanging, but in reality, there are many Mohan kumars and other rapists, who committ the crimes against women and then evade arrest or punishment. Now our society has become faith based and the so called Muthaliks and Mahendra Shettys are sleeping and have no voice. They have voice and power only to beat and create terror to people belonging to other communities. They have blind and deaf to the anti social activities of their own people. They failed to understand that there are black sheeps in all communities Its very sad reality. Instead of attacking pubs, churches, masjids, it would have been nice these goons engage in attacking anti social/women activist who are in all communities

    I am in complete agreement with Mr. M. Bhat, Mumbai. Look at the murder of Padmapriya, Udupi MLAs wife at New Delhi. Nearly two years now and I think not even post mortem report is filed.There is no doubt justice is for sale now. As for our State is concerned, we can now be called the criminal state of India. Ladies in particular are too unsafe here though we call them Amma.

    Why this leniency in meting out punishment for a crime that is so heinous? The victim’s life was cut short within hours, whereas the murderer is given to live years eating out of tax payers money. Once proven guilty, the criminals such as these should be hanged publicly.

    For last 26 years, Hindu India has been ensuring that no justice comes to the Pradip Kaurs of this country who were raped (and some killed too) in 1984 riots, then why do they want the harshest form of justice for a Shiva Kumar in the case on one Pratibha Murthy

    Look at the reversal of judgement by SC from death by hanging to life imprisonment in Priyadarshini matto case. This kind of judgement's would dent the image of SC, loose respect and our confidence in true and fair trial. What happened to Bitti Mohanty case? where is he is hiding? Both these culprits are sons of IPS officers. We need to objectively look at the effectiveness of our laws vis-a-vis the enormity of crime. Eversince our respected Mr.Shanti Bhusahn an eminent lawyer and ex-Law minister expressd doubts over the integrity of several SC judges my respect for them has diminished. A partial judge, corrupt politician and policemenr are traitors of the country and are enemies within.

    First he should be made to serve 20 yrs of rigorous imprisonment.After the successful completion of 20 yrs of RI, he should be stoned to death, in presence of Public.

    The court has finally held Shivakumar guilty of rape and murder. What prevented the court from sentencing him to death by hanging? We donot need such perverts and pests live in our society, who inspire others to commit henoius crimes and get away with lesser punishment? What is rarest of rare case? Our law is not clear on it. Whether it is rarest of rare crime or common crime the reslut of such criminal act is same. A young lady has lost her life in her youth. How does a vocabulary (rarest or common ) change the outcome of the verdict? Till a daughter or wife of a judge, politician or police personnel is raped and killed the rarest of rare is not applied to common person. Do we need such kind of laws? I feel very sad at the plight of the mother of deceased of Pratiba, who fought the case relentlessly for last 5 years. May Pratibha's soul rest in peace.
