Karnataka HC Upholds Disqualification of 11 BJP MLAs


Yeddy is Safe as 11 Dissident MLAs Remain 'Disqualified'

Bangalore, Oct 29: In a major relief to the beleaguered Karnataka Chief Miniser B S Yeddyurappa ahead of the Rajyothsava Day and Diwali celebrations, the third single judge of the High Court Justice V G Sabhahit on Friday upheld the decision of the Legislative Assembly Speaker K G Bopaiah in disqualifying the 11 dissident ruling BJP MLAs for "anti-party activities."
 
The Speaker had disqualified 11 BJP MLAs and 5 Independents, just a couple of hours before Yeddyurappa’s crucial trust vote in the state assembly on October 11 after they informed the Governor H R Bhardwaj in writing on October 6 about their decision to withdraw support to the government.

The Governor had asked the Chief Minister to prove his government’s majority on the floor of the assembly by October 12. The ruling party managed to win the floor test by disqualifying the 16 MLAs on October 11 itself amid tight security and chaotic conditions by ``voice vote.”
 
However, the Governor took exception to the voice vote victory secured by Yeddyurappa as a ``farce” and had sent a detailed report to the Centre recommending dismissal of the Yeddyurappa regime and imposition of the President’s Rule.
 
But, obviously under pressure from the Congress-led UPA regime, the Governor virtually reversed his stand on the next day and offered a ``second chance” to Yeddyurappa to prove his majority on the floor of the assembly again, if he wished, with a clear division of votes in favour and against, by October 14.
 
The Chief Minister and the ruling BJP took up the second chance offered by the Governor after it became known that the Karnataka high court, which heard the separate writ petitions filed by the 16 disqualified MLAs, did not grant a stay order against the disqualification and posted the hearing to October 18. Thus, the Yeddyurappa regime proved its majority in the assembly by 106 to 100 votes on October 14.

Thus, after the Yeddyurappa regime proved its majority in the assembly twice within a matter of three days, the division bench of the Karnataka high court finally came out with its split decision. While the Chief Justice J S Kehar decided in favour of the speaker’s decision in disqualifying the 11 BJP MLAs, the other judge Justice N Kumar quashed the disqualification. With a split in the division bench, the matter was referred to a third judge to decide on the disqualification of the 11 MLAs from BJP.
 
The Division Bench, however, referred the case of the 5 Independents to a separate bench and posted the hearing to November 2.
 
Justice V G Sabhahit, who was finally named as the third judge, heard the matter and reserved his ruling, which was finally delivered on Friday afternoon.

The third judge was necessiated as the division bench comprising Chief Justice J S Khehar and Justice N Kumar expressed divergent views on invoking para 2(1)(a) of the Tenth Schedule of the Constitution — pertaining to defection — against these MLAs, based on CM's complaint. The bench had concurred on three aspects of the case — rules, principles of natural justice
 
The 11 rebel MLAs of BJP, who had been disqualified by the Speaker, have announced that they will approach the Supreme Court.

However, the fact remains that the decision of Justice Sabhahit has come as a windfall to the Yeddyurappa regime ahead of the Rajyothsava Day celebrations on Monday and the Diwali festival next week as the 11 MLAs with the backing of 5 Independents could have forced the Chief Minister to resign even without facing the assembly for another floor test as the ruling party would have been reduced to a minority in the assembly.

The ruling party, however, sought to improve its position in the assembly by persuading as many as 2 Congress MLAs and 1 JD(S) MLA to resign their membership of the assembly by resorting to ``Operation Kamala” and thereby reduce the strength of the Congress and JD(S) from 100 to 97. The BJP had also managed to win over the support of Independent MLA, Varthur Prakash, who had switched his loyalties to JD(S).

In fact, political grapevine has it that the ruling BJP had prepared plans for ``winning over” another 8 to 10 Congress and JD(S) MLAs through Operation Kamala in order to ensure that the Government was not disturbed even if the High Court verdict went against the disqualifications.

    The ultimate winner in this episode is the third judge Mr.Sabhahit. The actual reason to postpone the verdict is, he was busy all these days in bargaining with yeddy to fix his rate to announce the verdict in BJP's favour. He knew that the current MLA rate in Karnataka is 25 crore and 11 MLA x 25 crore = 275 crore. Finally he might have settled for 200 crore to announce the verdict in yeddy's favour. I know some of you may ask whether I where there during the deal. but " Samajnevale ko Ishara Kaafi Hei" So far the contribution of BJP to Karntaka State is, It just made some MLAs and Judges Millionire in overnight. But dear Pro BJP supporter it is too early to jump in joy as the disqualified MLAs decided to move to Supreme Court. So wait until. For the Time being the cow expert Bardwaj and SDK can put a veil on their face and The Temple & Pooja Expert Yediyoorappa feel a sigh of relief.Let another useless sweet distribution exper Venkayya naidu distribute the sweets as he has no any other business now a days.     constitution. How can he protect the constitution when he acts as a agent of CONGI! What he mean by Democrazy. He seems a expert lier not lawyer! He seems to be upholding agenda of Opposition to

If these 11 idiots are not happy with leaders, first complaint to high command & if they doent respond, resign the MLA seat. Why you are going to opposition party & trying to topple the government?     CM can defend his seat by any means crying, begging, kneeling either in front of media or perhaps prior to High court verdict ! Who knows ?? Ultimately it is the Money Power, Reddy Power has a role to play to let Govt to rule. Although I am from Congress, BJP Govt. should be allowed to complete its full term until electorate seals its fate. However, can BJP anticipate Gujarat result in Karnataka ?

    Court judgement depends on papers presented and goes strictly as per whats written in the law and for some extent argument done by resp judges. Court can not know what all our winning boy and his gang had done one day before the test and how he used speakers house into their office and how they disqualified these 11 mlas and 5 independents.These boys now have mustered enough majority and they have no fear even if 5 mlas get pass on 2nd nov.They must have done enough plans to get these 5 members too into their fold supposing they win on 2nd.I feel floor test done on the 1st instance to be uphold where Yeddy had won only 105 Seats .All the members supported Yeddy after 1st floor test obviously to be not counted due to obvios wrong methods Yeddy used to get them.Only Yeddy & his boys concience knows what all they have done after elections to retain power. Only God knows whats that.No wordly man can give judgement on these masterplanners Yeddy & friends as they are capable of changing anthing. These boys are ready to go any any extent to remain in power whatsover it may be .Coming days will be more intersting-

    I am always reading the comments posted by different people. Some are supporting BJP and Others supporting Congress. They are blind supporters of those parties. Please raise yourselves above party level and see good people in each party and support them. There are many good MLA's and MPs who are not so rich inspite of having power e.g. George Fernandes, AK Antony, Manmohan Singh, AB Vajpayee etc most of them even opposition parties are giving respect. Therefore, we should not blindly support one party instead support good people and appreciate for them if they do any good things for the people.     Dear educated people of Karnataka, Please take it easy just because the third Judge has upheld the CJ Judgment dosent mean its the end of the Road, Well u will see the Supreme Court revert the unjust judgment and then it will be a shame on the entire Judicial system in Karnataka Waite and watch game is not yet over, Karnataka judicial system could could have been influenced but, Supreme Court can never be bought. All the best to the learned supreme court Judges who will hear this petition, and pronounce an unbiased judgment.

    Is it good news or bad news, God knows. But judgement given by the third judge is not correct. Why 16 MLA's has been disqualified and suspended hours before the no confidence motion. Reason behind the suspension is that Yediurappa knows he can not win it without suspending them. No confidence motion should be taken as per the strength of MLAs on 06 Oct 2010, when Governor asked CM to prove his majority.

    It is well known that the third judge will uphold the judgement of CJ. When there is case pending in the court, why no confidence motion taken second time. Speaker should be neutral to all the parties, but he acts on behalf of CM. BJP can give crores of rupees to opposition MLA for cross voting or resign his seat, why not they can bribe Judge. BJP is good Govt but the policies of CM are not good. He is the worst CM ever Karnataka had. He can develop all matt's but he can not develop state for the people...

    When are these politicians start working for the people? Are they our representatives or celebraties? All I see since the last few months is:
    brick-brack fights, distribution of sweets,
    visiting places of worship and distribution of sweets.
    Jumping parties & distribution of sweets.
    Crores passing under the tables & distribution of Sweets.
    Padayatras & distribution of sweets.
    and the list goes on.... except for real service to commoner.
    No wonder, every politician looks like ruffians, with big protruding belly and white clothes to hid the dirt inside!

    It is high time, all parties in Karnataka are liquidated. Young blood under 40 with proven educational background of atleast Post graduation degree in Politics (preferably) should take over the state and run it with only one motto - serve the common public and uplift our state from the deep void it has fallen into.

    Electorate of Karnataka gave BJP an opportunity to rule the state for 5 years. Power hungry H.D. Kumaraswamy of Appa Makkalu party with the active support and connivance of Nakli congress leader Siddu wanted to dislodge the democratically elected BJP government by engineering defection of BJP MLAs by offering crores of rupees(?) and form the JDS/Congress government through backdoor. Governor Bharadwaj of congress also helped them to accomplish thier mission, though unsuccessfully. Goverenor himself also tried to dislodge the BJP government by colluding with HDK and Siddu.

    Almost daily HDK and Siddu were running to Raj Bhavan during those turbulant days. Now the high court verdict which is announced today upholding the validity of suspension of all 11 MLAs by the speaker has come has a slap on the face of the governor Bharadwaj. If he has got an iota of resepct left in him and any respect to the judiciary and the rule of law, he should immediately resign his post rather than using Raj Bhavan to destabilise the democratially elected government in the coming days.

    This governor, while commenting on the issue of Cow slaughter bill once said he is a is a lawyer and knows the legal system and the constitution better than any one else. Todays judgement has proved what our governor knows? Shameless HDK/Siddu should now relax till the next election and wait for thier luck!!!

    Its a victory for BJP & mr.Yeddyurappa in the state.Now the honourable CM must try & concentrate to developments ,so far he was not allowed by the opposition.Hope everything will be smooth with the culprits are out.Renukacharya must be stripped of his ministry for his alleged involvement in encouraging the revolt,he is unfit for the post of a minister.CM try to include the honest MLA's who are work oriented,give the MLA's of south kanara more power.I think South Kanara is one of the region ignored by the state as far as the developments are concerned,though they are the one who backed BJP from day one.CM should try to keep the trust of the public who elected BJP.

    Alter the High court judgment let us analyze certain facts now.
    This Judgment if gone to Supreme Court and Supreme court also upholds the Judgment It will be a great day for Indian democracy.
    It will stop the jumping jacks hopping from one party to other at the of a hat.
    Corruption and frequent reelections will be reduced.
    The tail wagging the dog is not desirable.
    I am not a fan of Yediyurappas’s Governance. But a few of my observations are:
    Had Yediyurappa not resorted to operation kamala BJP would not be able to rule even for a month.
    Had Speaker not taken a hasty decision in disqualifying the 11 MLA’s overnight, The Governors decision to give the least minimum time to prove majority would have got the desired effect.
    Had the 11 MLA’s not dillydallied with Kumaraswamy so openly, they had an opportunity to say that they are just against Yediyurappa and not against the BJP Party. Now it has fallen flat.
    Congress came out fairly clean in this episode and Kumaraswamy fell flat on his face.

    "It is the Chief Justice who ruled the disqualifications were in order while the other judge quashed the action taken by the Speaker. CJ is the head of High Court & it was he who named the third judge, Justice V G Sabhahit. It is logial to presume & wonder whether Justice Sabhahit can go against the judgement given by the CJ. Though it is quite possible & cannot be completely ruled out, I personally don't think Justice Sabhahit will be bold enough to go against the ruling by his immediate boss!"

    HC judgment vindicated Speakers decision. Now the time has come for the cow-expert Bhardwaj to leave Karnataka for good without creating further mayhem. Am sure majority of Kannadigas will be happy, Bhardwaj taking Kumarswamy with him for good.

    It is indeed a good news for the voters.So that in future the MLA's will be careful before making any such move.But unfortunate for the Eddy team because they lost these 11 MLA's and have to run the show with less MLA's and keep fishing for congress or JDS MLA's.This will be a very tough task for the BJP and also the people will give a wise verdict in the next election.The BJP cannot convince to the voters their so called innocence of JDS hacking because BJP bought MLA's for cash on delivery.
