Court Declines to Stay Proceedings against Yeddyurappa

Bangalore, Feb 26 (PTI) : A local court today dismissed an application seeking a stay on the proceedings against Karnataka Chief Minister B S Yeddyurappa and his family members over alleged corruption and nepotism in land dealings. 


The court also rejected Yeddyurappa's son-in-law Sohan Kumar's another application to include former chief minister and JD-S chief H D Kumaraswamy as an accused in the case filed on private complaints by two advocates.

Rejecting the two applications, Additional City Civil and Session Court Judge C B Hippargi posted the matter to Feb 28 for recording of evidence.

Kumar in his application had sought a stay on the proceedings on the ground that the matter was already being investigated by the Lokayukta.

Armed with the Governor's sanction for prosecution of the chief minister, Sirajin Basha and K N Balaraj had filed five private complaints against Yeddyurappa, his sons B Y Vijendra and B Y Raghavendra, MP, Sohan Kumar and others regarding alleged nepotism and corruption in land denotification.

Earlier, counsel for the complainants objected to Kumar's applications contending that he had no locus standi to seek such a relief at the "pre-processing stage and pre-cognisance of the matter".

The counsel argued that such an application could not be moved as the court had not issued any summons to those named in the complaint and hence they had no right of audience. The applications were frivolous and intended to delay the legal proceedings.
The judge refused to hear any arguments made by Kumar's counsel today.

Hailing the court's decision as a positive one, advocate Anup Chowdary on behalf of the complainants told reporters that it meant the "court had taken cognisance" of the private complaint and that the judicial process in the matter had now begun.

"Law will take its course," he said."The court would record the evidence and based on the examination of documents, evidence and witness statement decide whether summons should be issued to the 'proposed accused' or not," Chowdary said

    It is better you don't build castle on the air. Once we have given power to BJP to rule India. But because of poor administration in the centre under the leadership of great Vajapayee, BJP could not gain the powe in the centre since so many years. Likewise, the same history will repeat in Karnataka also. I hope BJP will never come to power in Karnataka forever because of their worst administration since 3 years.

    If I am commenting again & again it is my right & I desire to open eyes & minds of the people where those attackers now desire to forget blunder carried out by them & their cases were thrown out by the bjp. Only innocent Christian's cases r still in the courts.
    When there were rampant attacks on churches relentlessly for3days no action was taken against the attackers or144section imposed nor there was lathicharge. When Christians started to protest144section was slapped & purposely arrested Christian youths. Is it not bjp government's jealousy & crooked acts over a small minority? Did we kill anybody to promote our religion or did we attack any Hindu temples?

    What I have to do with 26/11? While bjp was in power they scared to cross the border to Pakistan & when 26/11 attack they blamed congress. Am I a corrupt person or an agent to take money & keep quiet w/o expressing my rights. What v the Christians have done to those attackers to blaspheme our worship places. If u r talking about terrorism I have condemned terrorism several times. V Christians love Hindus but the communal minded r poisoning minds of Hindus everyday.

    I am amazed at Yeddyurappa's son in law Sohan Kumar. What a first call beggar. He accepts illegal land from Yeddyurappa and when questioned asks the court to go after H D Kumaraswamy. Yeddyurappa seems to a good man but he has been tricked by his good for nothing sons, daughter and now son in law Sohan Kumar. My best wishes for Yeddyurappa and pray that he gets minimum punishment.
    Sonia Gandhi is blessed to get a son like Rahul.

I do agree but why you want to bring the parents name in this? You could give you statement in a good manner but you failed to do so. My request is never bring the parents in the comments because they are the people who gave birth to us. Political comments and statements we should NOT take it very seriously specially in INDIA and remember it there is constitutional right to every citizen that is “RIGHT OF SPEECH”.     "A stay of proceedings is a stopping or arresting of a judicial proceedings by the direction or order of a court... (a) a kind of injunction with which a court freezes its proceeding at a particular point, stopping the prosecution of the action altogether, or holding up some phase of it.
    "A stay may imply that the proceedings are suspended to await some action required to be taken by one of the parties as, for example, when a non-resident has been ordered to give security for costs. In certain circumstances, however, a stay may mean discontinuance or permanent suspension of the proceedings."

    Now the court is refused to put stay which means it will start its procedure. Being responsible Citizen Mr. CM must respect, honor, and accept the decision and act accordingly. Wish he will be a good model to the society by accepting the truth, correcting himself, and apologizing for his misdeeds if any thing found as well as he knows. If we obey the law and fulfill it then our Heart, Mind, and Soul always will be the Chief Justice to us.
