Godhra Train Burning Case: Death Penalty for 11, Life Sentence for 20

Ahmedabad, Mar 1 (IANS): A special court here on Tuesday March 1 sent to the gallows 11 people and gave life imprisonment to 20 others for the February 2002 burning of a train coach in Gujarat's Godhra town that killed 59 people and triggered a communal frenzy, which claimed an estimated 1,000 lives in the state.

The sentence was pronounced by special judge P.R. Patel in the court within the high-security Sabarmati prison here.

The 31 people were convicted Feb 22 and held guilty of conspiring and setting on fire S-6 coach of the Sabarmati Express near the Godhra railway station Feb 27, 2002. The train, carrying many radical Hindu activists, was on its way back from Uttar Pradesh's temple town Ayodhya.

The court had acquitted 63 others, including alleged mastermind Maulvi Saeed Umarji.

While the prosecution sought death for the 31 convicted, arguing that it was the "rarest of rare case", the defence appealed that the convicts be spared the noose and sentenced to life in prison

Lawyer I.M. Munshi told reporters that the defence has asked for leniency, saying the incident was a reaction to the "misbehaviour" of 'kar sevaks' (Hindu volunteers) in the train and could not be termed a "rarest of rare" case.

The lawyers also argued the convicts should not be sent to the gallows considering their past, their family circumstances and the fact that they had spent nine years in jail during the trial.

The 31 men were held guilty of murder, attempt to murder, dacoity, robbery and arson.

    Please don't start the violence. The law will punish you and the society as well.

    Bear the consequences. Don't blame the after effects. Think before committing any crime.

    Racist Verdict!Dara Singh gets 'Life Sentence' for burning Australian Missionary Graham Staines and his two innocent children contrary to these 11 who get 'Death Sentence' for the same act. Religion of the accused and the victim matters in court, not justice.

    ATROCIOUS JUDGMENT.
    I am ashamed of our judicial system.
    Can someone from the legal fraternity explain the difference between these two judgments?
    Mr. ABC burns one adult and 2 children sleeping inside a vehicle – Verdict – Life imprisonment citing it is not rarest of the rare.
    Mr. XYZ along with 10 other people burns 59 people inside a train – Verdict – Death Sentence.
    Do our judges have a different law book for minorities?
    Is India fast becoming a BANANA REPUBLIC?

    Look @the dichotomy of the vedict by same SC!here burning to death of bajarangies who were notorious for their goonda behaviour becomes rarest of rare case i agree 100% with the SIT.but burning of 2 kids n their father graham by same BJP/RSS frontman dara sing is NOT "rarest of rare"!!!!..what the hell is going on..since when we r having 2 justice system?, 1for majority,here killing of bajarangi becomes rarest but if bajarangi does the same thing to  any minority..well u c.err..umm..its pretty "COMMON"!!!..no death4 hindu terrorists..somashekar adopted same double std..whats bothering me is "HAS OUR JUDICIAL SYSTEM DISTINCLTY MOVED FAR RIGHT N SAFFRONISED"..?..seeing recent development its difficult2 believe otherwise..without doubt this is dangerous4 indias unity n integrity..

    We need to advocate non-violence even for noble cause. Religious freedom and tolerance is the need of the hour. If religions don't advocate amicable coexistence we will see more and more communal strife. Meanwhile, it is worth remembering that quite recently the Supreme Court said that dead penalty is awarded only in rarest of rare cases. The case involved burning alive a missionary with his family. If burning them was not a crime grave enough to award death penalty, will this case merit it? Just abolish death penalty altogether so that the Supreme Court need not worry about which are the "rarest of rare" cases.

    Good Judgement, all the criminals must be hanged. What about the souls of poor, innocent and helpless girls who were dragged out of their homes and gangraped by thugs calling themselves saviours of some religion?

    The final verdict will be from SC only it seems after seeing HC verdict.If those people were condemnd to death really did crimes, they must deserve the punishment. For all ifs and nots SC will deliver it's final verdict.Having Said that post Godhra cases are as serious as Godhra incident but yet I did not hear any capital or life punishment so far !! Why?
