Bangalore: High Court Stops Lokayukta Probe into BSY, Family

Bangalore, Mar 29 (PTI): In a relief to Chief Minister B S Yeddyurappa who has been facing allegations of corruption, Karnataka High Court today stayed the order of a lower court which had taken cognisance of the offences against Yeddyurappa and his family members in one of the five complaints filed against them under Prevention of Corruption Act. 

With Justice K N Keshavanarayana granting interim stay on a criminal petition filed by Yeddyurappa's son-in-law, Sohan Kumar challenging the lower court order, further proceedings on the first complaint, including the Lokyukta probe ordered by it, comes to a halt.

The court also ordered issue of notice to the respondent, Sirajin Basha, an advocate, who is the main complainant.

Arguing on behalf of Sohan Kumar, senior Counsel B V Acharya said "on the face of it, in law, taking cognisance of the complaint itself is blatantly illegal and will have serious repercussions on all the accused".

He submitted that the Trial Judge (C B Hipparagi) had "erred in taking cognisance of the offences for which no sanction was accorded by the Governor".

Acharya said while the Governor had accorded sanction to prosecute for offences committed under IPC section 405 (criminal breach of trust) and under provisions of  Prevention of Corruption Act,the Special Judge "without referring to the sanction order, proceeded to pass orders taking cognisance of all offences mentioned in the private complaint".

"The learned judge has passed a common order....the proposed complaint presented to the Governor is only one while complaints presented to the (Sessions) court are five", he submitted.

Speaking to reporters outside the court, senior Counsel Ravi B Naik, who also represented Sohan Kumar, said "the Governor accorded sanction without any investigation....the allegation of misappropriation that was there in the complaint before the lower court, was not there in the complaint filed before the Governor".

On March 24, the 23rd Additional Civil and Sessions Judge C B Hipparagi postponed prosecution in the complaint and ordered Lokayukta police to probe the matter and submit the final report of the inquiry by May 4.

The complaints against Yeddyurappa and others relate to alleged irregularities in denotification of land.

    CRORES OF RUPEES WENT TO THE JUDGE AND THE VERDICT CHANGED. EVEN THE COURTS ARE PURCHASED BY YEDDY AND THE JUDGES. SO WHAT PUBLIC CAN SAY ? YEDDY WILL DO ANYTHING TO SAVE HIMSELF AND HIS CHAIR. IF YEDDY DIES HE SHOULD BE BURIED WITH HIS CHAIR. SO THAT TIME ONLY HIS SOUL WILL REST IN PEACE.

Till BJP vanished by his tainted image and till Advani and Gadgari gets their part of Royalty from sinfull collection from this state, yeddy will continue and indulge in more scams directly and indirectly with this family. What prevents BJP to Mr. Suresh Kumar who is Mr. Clean in the place of yeedy ? May be worried about the Royalty share at to Advani and Gang..

    I think the need of the hour is immediate treatment to Mr. Nagesh Nayak's eyes. The scams of Mr. Yeddy are not a secret anymore . They are revealed like day light but this Nayak still praising him blindly as if he is blind or un intended to believe them. I strongly suspect he ever visited Bangalore or even stepped out of his residence. If he had ever visited Bangalore he would not have commented on the development Over crowded garbage bins, filthy streets, damaged and congested roads, broken street lamps are some of the witness to the development done by BJP. His comments are like some one telling stories behind his bed and he is repeating it to us. He is in a fools paradise that he can convince us by singing the same song of Development from Eddy.

    But in contrary the word “Development “ is widely misused in the 3 years ears BJP rule. They used this word mainly for Land scam, rape, murder, bribing the MLAs , attacks on holy places etc. these issues are developed rapidly during their rule. At the present situation neither Congress nor BJP can give us a good governance. Because the leaders in the top of these two parties are not “Sathya Harischandras” and engaged in looting the national wealth for their own gain. Since we have no any third option to vote, we are forced to vote either of them. That means it is not an open support for their mismanagement. So Mr. Nayak, please step out of your residence and comment.

    One thing we all must remember that what ever court says it based on the lawyers and proof of evidence. Now it is Mr. CM knows exactly what he did. His opponent knows why they are back of CM. One question we must ask our self, Do they both really LOVE our Karnataka State and the Citizen? May be BJP followers tell yes for Mr. Yeddi and Other group may say NO to CM. The people who are fighting for them are fools because our Political Leaders are shameless creatures. They change their Political Faith and Their Promises like “Back Door Stupid’s”.

    There is no use of any Lokayukta if the Courts give such an order. Nowadays you cannot trust any Courts. Money makes the difference. You show money to the chief Justice or Judges, verdict changes immediately. We cannot understand why the Additional Civil and Sessions Judge C B Hipparagi postponed procecution of Yeddy and ordered the Lokaukta Police to probe the matter and give final report of the inquiry by May 4th. Why so much of time is given. What is the Secret behind this ?

    It is a techinical question raised by the counsel of Yeddy/Sohan and judge agreed up on the issue and gave temporary stay(intrim stay).However the 'DAAG'would not be erased from voters point of view against Yeddy and BJP alike.

    GOD KNOWS HOW MUCH MONEY WAS GIVEN TO JUSTICE KESHAVANARAYANA WITHIN A NIGHT TO GIVE SUCH A VERDICT. TO SAVE HIS CHAIR YEDDY WILL DO ANYTHING. EVEN THE COURTS ARE PURCHASED BY YEDDY AND THEY ALSO HAVE NO GUTTS TO TAKE ACTION ON YEDDY. LAND ALSO MIGHT HAVE ALSO GIVEN TO THE JUSTICE KESHAVAN. MAY BE YEDDY THREATENED THE HIGH COURT JUTICE FOR DIRE CONSEQUENCES IF HE TAKES ACTION ON HIM. MONEY CAN DO ANYTHING RIGHT WRONG AND WRONG RIGHT. EVERYTIME YEDDY GETS SAVED BUT THE DAY WILL COME FOR YEDDY WHERE NO ONE WILL SAVE HIS CHAIR. THIS IS ALL TEMPERORY RELIEF FOR YEDDY.

    Court has taken right dicision. God knows how many crores changed hands? Now justice is under "Operation kamala" jai ho Yeddy. This enquirys are all bogus, Justice hegde will put all his efforts and present the case to the court, but Judge will dismiss the case as no proof despite all the evidence. Let the public decide Yeddy is right or wrong. Once again Henda & Hanna will rule the election. No use in blaming politician better blame our self.
