Bangalore, April 15 (IANS) The Lokpal (ombudsman) Bill would help fight corruption only at the centre and not in states where the magnitude of graft is alarming, cautions former Supreme Court judge Justice N. Santosh Hegde amid the escalating hype over the proposed legislation.

Hegde, also the ombudsman for Karnataka, is part of the 10-member committee set up by the government to draft the new bill following the hunger strike by reformer Anna Hazare that had triggered a nationwide movement against corruption.

"The lokpal will deal with acts of omissions and commissions at the centre such as alleged corruption by union ministers, including the prime minister and central government employees. But there is much more corruption at the local level in states, which has to be tackled by the lokayukta (state-level ombudsman)," Hegde told IANS in an interview.

Hegde, who played a key role in drafting the various clauses of the Jan Lokpal bill, the stronger alternative drafted by civil society members, hoped the fight against corruption and maladministration would not only be strengthened at the centre but also in states.

"The institution of the lokpal at the centre has been overdue. Unlike in Karnataka and a few states where the lokayukta has been constituted and functioning, there is no such legal entity at the central level for people to fight against corruption. There is an urgent need because corruption is also prevalent at the centre, as evident from the various scams that surfaced recently," Hegde asserted.

Though the lokpal may not deal directly with corruption cases and other grievances at the state level, Hegde said the members representing the civil society on the joint panel would strive to ensure that the act would be uniform and its powers applicable in all states through their respective lokayuktas.

"One of the suggestions I made is that the Lokpal Act should be uniform and its powers applicable in all states so that the lokayuktas are equally empowered to tackle the menace, as about 90 percent of the graft incidents occur at the ground level, be it in the local body, district offices and state capitals," Hegde noted.

Though it would be in the interest of speedy justice, he said, to accept the lokpal judgment as final, the accused or a convicted person cannot be legally stopped from approaching the Supreme Court as he or she would be entitled to under the laws of the land, especially where fundamental rights were involved.

"We cannot stop the affected person from taking to legal course against the lokpal ruling even if he or she is held guilty of the offence though it would be ideal. But we are governed by the constitution, which empowers every citizen to defend from being framed, accused or convicted," Hegde pointed out.

"As a central act, the lokpal will facilitate creation of a lokayukta in every state with a common law on the lines of the Karnataka Lokayukta Act, which is one of the best in the country. But having been an ombudsman over the last four years, I have not been able to check corruption and maladministration in the absence of adequate powers envisaged in the Jan Lokpal bill," Hegde told IANS.

Lauding the role of social crusader Anna Hazare in making the government form the joint panel after protracted delays, Hegde said he was optimistic that the draft bill would be finalised by June and passed in parliament in its monsoon session so that the momentum gained by the recent unprecedented turn of events was not lost.

"There are two draft bills - one from the government and other from our side (civil society). With the cooperation of all the members, we hope to finalise the draft bill by June. There could be 10-12 meetings to review the bills clause by clause and build a consensus to protect the legitimate rights of citizens, bring in transparency in governance and ensure accountability on the part of the executive, legislature and even judiciary," Hegde emphasised.

The drafting committee of the Lokpal bill would comprise five ministers and five nominees of Hazare, including himself. While the ministers are Pranab Mukherjee, P. Chidambaram, M. Veerappa Moily, Kapil Sibal and Salman Khursheed, the civil society members are Hazare, Hegde, advocates Shanti and Prashant Bhushan and activist Arvind Kejriwal.

    I have elaborated the case of corruption in the root level which cannot be contained only at the top unless bottom remains corrupt/un-checked/stopped.

WHY BJP CANNOT SOW GOOD SEEDS RATHER THAN DIVIDING COMMUNITIES, INDULGED IN LURING VOTERS, WITH KAMALA OPERATIONS, CORRUPTING THE MLA'S, LAND SCAMS & CLAIMING DEVELOPMENT WORKS ACCOMPLISHED BY THE CONGRESS IN 60 YEARS.

    The Lokpal Bill be formuulated on the patten of consumer forum,But administration of district forum,state forum and national lvel be vested with independant body controlled by supreme court or national forum. No political ministers should interfere in the administation including appointment of memebrs to the furum

    Congress generated corruption in the country during A.R. Anthulay time way back in 1980, after Italian lady become president she put break to all type of corruption, now BJP has crossed all the limits and has attained post graduation, now they are masters in corruption BJP has even bribed judges & MLA’S. Shame on Congress they could not beat BJP in corruption. Even JDS is doing well in the field of corruption. Mr. Santhosh Hegde wants to pin only Yeddy and that’s not correct, he should treat all the parties and govt’s in central n state alike. Justice has to be just n impartial, once grudge & revenge should not be party in the field of justice, rich & poor ha to be treated alike. No to be like Baba Ramdev.

    Justice Santosh Hegde has created lot of awareness to the people of Karnantaka after taking the office of Lokayukta. But he still facing lot of problems from the Govt. and executives to carry out his job.

    As u said Congress is corrupted party,but I say it has few best leaders were u cannot make any calculation. Our honourable Prime Minister , Our Defence ministers were among them.and what is Modi? and what he did ? whole world know about it.
    I really support Anna Hazare and wish this bill would be applicale to all states

    One of the Most Beautiful part of Jan lokpal bill as envisaged by Anna Hazare is DELAY IN EXXECUTING A gOVT JOB ITSELF is an Offence In this 21st century Govt officials dont ask for Bribe openley they just say NO or they will say it will take 15 days or they will say you have to get NOC from Bangalore if you are born in Karnataka and wants your some job done in Mumbai But if you grease the Palms you will get the Job uted within an hour Corruption is very much matured in India .Please note IAS officers .Govt Officers are the one who train and teach the Politicians

    A comprehensive,effective,truthful prosecuting authoriy against corruptions.....need to be drafted for Centre and state.Janlokpal Bill should be applied from HALLI to DELLI on the issue of corruptions especialy and this effect drafting members need to looked in to.I hope we are blessed with person like Mr S.Hegde who would emphsize and forward his great exprience in this regard to close all loopholes under prevailing laws.We are proud of Mr Hegde for being a member of JANLOKPAL drafting body.

    WITHOUT CORRECTING THE BASE NOBODY WILL ACHIEVE CORRUPTIONS IN THE STATE HEADQUARTERS OR IN THE CENTRAL.
    First check in our own district Corporation, Revenue department, R.T.O., Forest Department, Block Development Offices, Police departments, every Taluk Offices, even Taluk Treasury, Town Municipalities & Village Panchayat's without corrupting files will never move.
    How the flats are becoming costly? Without bribing Electricity Department, Corporation & Registration Office can anybody get license?

    The real estates are fat with short cut money spreading intensity hype of panicking & misguiding public in the name of SEZ's.

    Can anybody get a house plan passed from Corporation without bribing?
    Can anybody open business house without bribing Corporation?
    Without lies traders can have business? Bundle lie's bundles of business.
    Even some news papers, TV channels are blackmailing people for money.
    Engineering colleges are asking exorbitant money from where the parents bring this much money?
    The medical colleges are far from the reach of ordinary people.
    The KSRTC bus conductor is working for himself.
    The KSRTC stores department is hungry for selling spare parts to the public in half rate.
    Social evils such as dowry are taking heavy toll, crazy for corruption.
    The lawyers are deceiving clients for money.
    The judges are corruptive.
    The Public Prosecutors & Lawyers have understanding in the goose
    ELECTORAL REFORMS ARE NEEDED. LURING VOTERS SHOULD BE STOPPED

    Lokayukta must address the burning issues such as what is stopping him against acting against the corrupt. To date we have come across hundreds of raids and crores of property assessed as illegal. BUT, we havn't heard one case where the guilty is punished with jail term or confiscation of property. What is the purpose of having lokayukta if his job is only to address media and publish crimes committed by corrupt. Corrupt will be only happy to get media attention. WE WANT CORRUPT TO BE PUNISHED.
