They are married. The families of both sides seem to be having consent on the marriage as there is no mention of any opposition from the families. Moreover she is pregnant. What is the logic in separating them by putting him in jail? What about the child in her womb if they are separated?

It is technically a rape because of the age; even though it is consensual relationship.

In 2013, a city court of Delhi in a similar case had acquitted the accused citing consensual relationship. The judge had suggested that obstacles should not be put in their married life. Here in this case, the girl is even bearing their child. Anything that dissolves their marriage is bound to make the problem worse instead of solving it.
