Udupi, Nov 13: In various courts of Karkala, Kundapur and Udupi, 34,320 cases were resolved in just one day through mutual compromise under the guidance of state legal services authority and an amount of Rs 12,34,77,966 was pronounced as compensation.

The resolved cases included 29 criminal cases that could be decided through mutual compromise, 268 cheque bounce cases, 21 cases of bank/recover of money, 86 cases of MVC, one labour loss case, 15 MMRD act cases, one marital discord, 174 civil, 2538 other criminal cases and 31,187 cases of pre litigation.

 

In a declaration and declaration partition cases that were in the court of fourth additional senior civil and JMFC court, Teena Pinto presented herself physically with her mother, brother and sister and resolved the matter. Their sister in Dubai appeared on virtual mode and agreed to compromise. So two cases of one family were resolved amicably.

In the Rashtriya Lok Adalat that was held in various courts of Dakshina Kannada, 22,262 cases were resolved and Rs 17,39,46,414 was announced as compensation.

The family court of Udupi brought together a couple who had been separated for 13 years. The couple married in Mangaluru and lived in Brahmavar. Husband was employed overseas and used to come to native place once every two years. The couple has an 18-year-old daughter, who studies in college at present. Wife accused husband that he does not look after her and daughter properly and went to Udupi and has been living separately for the past 13 years.

Recently, the husband arrived from abroad and applied for alimony for him and his daughter in the family court of Udupi. The lawyer for the husband referred the matter to the compromise center. Lawyer Ronald Praveen Kumar was made as the compromiser for both parties. He called the elders of families of both husband and wife. Later the pep talk given by the judge, middle men and lawyer made the couple understand the situation and they agreed to lead life together with their daughter.

    People are fed up of "No Judges" or "Judges on Training" in most of the courts. Add to this Tareek pe Tareek either by mooted by heavy workload of existing judges or tactics of many advocated to fleece as much as possible from their gullible clients for each passing dates or many complainants just file cases to harass opponents & never turn up to courts or accused avoiding courts. Heard that case number & info display digital boards fixed at inside & outside most courts are not functioning at all despite tax payer money spent on it. Imagine due to absence of judges, other countless court staff are paid salaries from tax payer money for their idle capacity which is a waste. Hope new CJI makes a fact finding mission regarding functioning of each court in the country & works for better justice delivery system. Further online case status website developed by NIC should display "serial numbers" of each dates so that anyone can easily make out how much Tareek Pe Tarrek productive dates have been lost. Hope India gets time bound justice at least hereafter. Only factors like these & frustration leads people to go for Lok Adalat half heartedly or with no option as they may not have enough money to fight long legal battles which is not a good sign. Justice delivery system should be time bound & meet its purpose.

    I am surprised, 31,187 pre-litigation cases in Udupi resolved. If this is the situation then huge job loss for some people.
