SC agrees to examine plea against ban on BBC documentary on Gujarat riots


New Delhi, Jan 30 (IANS): The Supreme Court on Monday agreed to examine on February 6, a plea challenging the Centre's ban on the BBC documentary in connection with the 2002 Gujarat Riots.

Advocate M.L. Sharma mentioned the plea for urgent listing before a bench headed by Chief Justice of India D.Y. Chandrachud. The top court agreed to hear on February 6.

The top court will also hear next Monday, a separate petition filed by journalist N. Ram and advocate Prashant Bhushan on taking down their tweets with links of the documentary.

The plea filed by Sharma contended that the BBC Documentary on Gujarat riots recorded and was released for public view, however due to fear of truth the documentary has been banned from viewership in India by any means under rule 16 of IT Act 2021.

Sharma's plea sought a direction for quashing of the January 21 order under the IT Act being illegal, malafide and arbitrary, unconstitutional and void ab-initio and ultra vires to the Constitution of India.

The documentary titled 'India: The Modi Question' has been banned on social media and online channels, but some students have screened it on campuses of various universities across the country.

Sharma's plea contended that the BBC documentary has reflected true facts with original recording of the victims of riot 2002 as well as other concerned persons involved in the scenario of riot, and it can be used for judicial justice.

    In my view this is a BJP ploy, you never know. I saw the documentary and there is nothing new. It will just fan communal passions. It wont affect BJP vote bank, as they will vote for their party anyway. The neutral ones and the voters from other parties may be lured to think twice. The opposition party leaders should sit tight and not make any statements. It will be just playing into the hands of Modi/BJP.

    People never learn. Regardless of the truth, UPA government with all its might could not fix Modi on Gujrat riots for 10 years when they were in power at the center. In fact, Modi won Gujrat elections with even more votes each time after the riots. He used the same to play victim and trounce UPA in 2014. If justice was not served even by SC, by playing with emotions of people again after 20 years, it is only going to harm the opposition further in the court of public opinion. Modi is going to use this again as a proof of international conspiracy to derail him and India and, in India people will buy it. The opposition needs better strategy to counter him rather than wake up old ghosts. Divisive strategy is always advantageous to Modi.

    Any critical documentary about mahaan abhineta is to derail India... Any research report about misdoings of adani group is also to defame India... So the question is whether India is so weak to be derailed for just another politician or a businessman???... If modi is proved guilty he has to go and if the case is inappropriately closed it has to be opened again... Nation does not seize to exist with the exit of any politician or a businessman... Face the public and stand tall if you are pure and honest.... Talking to tutored children is a child's play....
