Bengaluru, May 24: Karnataka High court has upheld on Monday the validity of handing over the ownership to tenants land under Moolageni and Ola Moolgeni rights Act 2011.

The single member bench in the leadership of justice Krishna S Dikshit pronounced the verdict reserved after hearing the petitions submitted by Udupi Adamar math, Ganesh Pai and others. The detailed orders are likely to be announced later.

Advocates Udaya Holla and Ravindranath Kamath who represented the petitioners had argued that payment of minimum price instead of appropriate price for the land is against the constitution and will be unjust to the land owners.

Senior advocate B V Acharya and A G Holla who represented the tenants on Moolageni and Ola Mulageni said that the tenants have been ploughing the land for generations and giving them the right of land is just. The legal Act that is announced by the government is valid, they argued.

The tenants on Moolageni and Ola Moolageni rent could not develop the land even though it was in their possession. They could not obtain a bank loan on the land. The tenants could not sell the land. After several campaigns, the state government passed the legal Act to provide full rights to the tenants and just compensation. The court has dismissed the petitions questioning it.
