Jan Lokpal Impractical, Undemocratic: Aruna Roy


New Delhi, Aug 21 (IANS): Terming Anna Hazare's Jan Lokpal Bill "impractical and complicated", noted social activist and National Advisory Council (NAC) member Aruna Roy said that giving widespread powers to an unelected body is a "threat to democracy".

"Jan Lokpal is a bill impossible to implement. Also, it derails the checks and balances between the judiciary, executive and other organs of the democratic structure," Roy, 65, who pioneered the right to information (RTI) movement in the country, told IANS in an interview here.

"Not that we agree with the government Lokpal Bill. The Lokpal legislation should be thoroughly deliberated again by activists, lawmakers and all other stakeholders.

"We of course support the democratic right of Hazare to hold demonstrations and fast against the government. That is why we condemned the arrest of Hazare," she said.

"But we have no meeting point with them, though we keep meeting each other at functions and meetings of common interest," she added.

Asked about the huge public support Hazare has drawn, Roy said: "There have been huge gatherings in support of NGO-sponsored agitations, like the Narmada Bachao movement. It might not have got similar publicity, as live TV was not there then."

Roy and her fellow activists in the National Campaign for People's Right to Information (NCPRI) have prepared an alternate version of the Lokpal bill, which will be presented to parliament's standing committee.

Roy, a Magsaysay award winner, said the Jan Lokpal bill is a "giant, complicated exercise" as it tried to extend from the prime minister to a peon.

"It wants to bring the higher judiciary into its ambit, which otherwise should have been under the Judicial Standards and Accountability Bill, 2010," she said.

She felt that the suggestion of dual duties -- curbing corruption and redressing grievances -- under the Jan Lokpal was not feasible.

"The Jan Lokpal is a threat to democracy as a powerful, non-elected agency can lead to abuse of power and abuse of authority. Power corrupts and absolutely power corrupts absolutely," she quipped.

"Grievance redressal should not be the role of the Lokpal; it should be the work of the executive.

"See, wages of lakhs of workers in the NREGA (Mahatma Gandhi National Rural Employment Guarantee Act) in Rajasthan have not been paid. But that is because the shortage of bank staff and other bureaucratic delays," she said.

The massive organisational setup suggested in the Jan Lokpal will lead to corruption and inefficiency, she cautioned.

"You may be able to find 11 Lokpal members of integrity, but it is difficult to create a clean set-up of thousands of staffers and hold them accountable," Roy said.

The government-drafted Lokpal is also deficient on several fronts, she added. Since it excludes cases under the state governments, there can be no probe against cases like the Adarsh housing society scandal, the Commonwealth Games scam and illegal mining in Karnataka.

She said excluding the prime minister and the higher judiciary was wrong. "This is a wrong practice. Nobody should be above the law," she said, adding that there should be certain safeguards. "Like both the Lokpal and the Supreme Court should agree on a probe against the prime minister."

Roy also suggested that the Judicial Standards and Accountability Bill should be revised to facilitate effective action against the higher judiciary while the Central Vigilance Commission (CVC) should be strengthened to probe junior officials.

The whistleblowers' protection bill too should be revised to deal with the increasing attacks and threats against RTI activists, she suggested.

"The Lokpal bill should not become an issue of adamant stances, political rivalries and personality-driven agitations. What we need is a sincere, detailed debate for legislation of immense social significance and public concern," she said.

Roy, an Indian Administrative Service (IAS) officer from 1968 to 1974, resigned from the government as the clouds of Emergency were gathering. She took to social work in the Social Work Research Centre in Tilonia in Rajasthan, founded by her husband Sanjit 'Bunker' Roy, another Magsaysay award winner.

However, she professionally disassociated from her husband in 1983, reportedly for ideological reasons, and founded the Mazdoor Kisan Shakti Sangathana (Workers and Peasants Strength Union) in 1990 in Devdoongri in Rajsamand district of Rajasthan.

Roy's campaign for right to information led to the enactment of the RTI Act - in Rajasthan in 2000 and five years later at the national level.

    I see the comments from the readers ridiculous.If a gov gets corrupt, we can change it through election(that gov came through popular vote). But who are these Jan Lokpal committee whom no one has elected and have a veto on the vote of entire country supreme than the parliament. Who will be these citizen committee-completely resistant to corruption. Don't call me some gov paid agent.

    Its a high chance that the committee will not represent the entire India. It will be a club of Brahman folk. Even if it is to include someone from Dalit and Muslim section,surely it will not have anyone from south particularly Tamil people.

    Aruna Roy says that giving widespread powers to an unelected body is a "threat to democracy".But these circumstances have arrived only because of giving power to an elected body. The elected body has showed that how much it can misuse the power and how much it could be corrupt. What is there to see more? No one is bothered about democracy or countries development. Everyone is behind power and money.

    Majority of the so called intellectuals who hold a prominent post in journalism and NGO's and media are funded/bribed or assured of post retirement benefits and incentives by the vested interest groups such as political parties and corporate houses.

    Please monitor the participants of the talk shows of news channels and you will will see how people are changing sides using 'great' arguements!

    Aruna Roy is no exception.

    As regards Jan Lokpal Bill, why Govt is so scared and worried about? Why it is so thick skinned? Why they cannot call team Anna to negotiating table? Let the Bill be discussed in the Parliament. The fact of the matter is all politicians are scared that they will be exposed!!

    What Roy doubted is perfectly possible.Therefore I would say the process of JANLOKPAL BILL should not undermine parliamentary democracy of India which is acknowledged by the world.In between Anna team and Govt rep need to explore cautious steps in formulating effective, unique strong JANLOKAPAL BILL.

    Madam Aruna Roy,

    Your outburst against Anna`s stand is undersandable coming from a loyal congrssman/person. You may have done monnumental work with your team members that may have rightly added laurels within your circle but surely not beyond it. I had not heard your name in any context of nation at work before it appeared as leading National campaign for People`s Right to Information.

    But again your campaign is unrecognised and unknown to general public. You speak of democratic institutoin being higher to people`s voice. What a lusty approach to smother the hopes and dream of "havenots"/general, semi-literate, unhealthy people who have no links to the "haves"/distinguished politicians, bureaucrates, local influential goons, leaders and loyalists.
    Institution dies when it has served its purpose or fails to serve any purpose. So please let the leaf fall and fly, in thin air so that a new may sprout. When there is a storm, weak trees fall and sometimes appaerntly strong too. let your arrogance not be the sign of your enlightened frustration.

    Though the Lokpal bill seeks to root out corruption, it could eventually end up as another corrupt organization for the following:

    1.Who will police the police, and how to deal with corrupt officers appointed by Lokpal legislation? Who will appoint those “honest” people to enforce checks and balances against the Government and the Judiciary? As per the bill we need police, to police the police of a corrupt system.

    2.So why is the system corrupt? Because those working for the Government are under-employed and to make ends meet they resort to taking bribes. Hence, government employees should be paid well.

    3.But then the government will be broke? For that we need wealthy Indians, especially businessmen to pay their fare share of taxes?

    4.So why aren’t the businessmen not paying taxes? Because they feel if they honestly pay taxes, then there will be nothing left for them and a return for their time and money’s that they have invested to earn a decent profit.

    Hence, the Lokpal legislation bill should include the following:

    a.A taxation system that works, and every Indian must pay their fare share of taxes, duties and levies.
    b.Applicants for public service should be cleared by District, Provincial Level as well as Lokpal legislation.
    c.Citizens and the Press should pay a greater role in highlighting unscrupulous, criminal and illiterate candidates.
    d.The members of the Rajya Sabha should have a good number of appointees cleared by the Lokpal bill. Jai Hind

    This lady is the product of UPA govt to counter the influence of Anna. Mrs Roy just tell us how much crores you have taken to give this statement. Most of the elected represetntatives and bureaucrats our country are corrupt. From peon to PM are corrupt. We need a legislation that mandatorily awards capital punishment to corrupt officials and life sentence to those who indulge in small level of corruption . Anna we are with you..     Why every body is talking that this govt lokpal bill that is ana lokpal bill and so on.what is bad if standing committe or parliament debates on all bills and recomend what ever is the best for decreasing corruption in society. More over seminars should be held by prominent honest citizen live on channels to discuss good and bad side of each bill item by item.More people willlearn about this and public opinion may obtained through sms and shown on next discussion.

    Kudos Aruna Roy for saying it is undemocratic to give powers to somebody other than elected representatives to draft the bills. But what exactly you are doing? What is this National Advisory commission? Is it democratic? who elects them? what is their powers?

    A beginning is made and we found a selfless LEADER in Anna. If our government is for the people, by the people and of the people then there is no threat to democracy. Our successive governments have failed to stop corruption and today it is alarming and disgusting. It has lead to an unbalanced economy, pushing more and more people below poverty line. If it is not checked now, then when? If not Anna Hazare then who?

    We have to think beyond us, what future our future generations will have if corruption is left unchecked. Our government will not stop corruption in their own and vested interests. We all know how credible most of our politicians, MPs, MLAs, ministers, bureaucrats and other government officials are. Unfortunately we do not have a single LEADER in our country. Now we found a leader in ANNA HAZARE, he is our only HOPE. Long live India, Long live Anna Hazare. Jai Hind.

    Why don't we get a similar explanation from UPA veterans? All we hear is arrogant rebuttals and personal attack on Team Anna. If UPA explains why it is opposed to Jan Lokpal bill they could have averted this whole drama.

    Having said that, Ms Roy must appreciate that one efficient and honest Lokayukta like Santosh Hegde could force a CM out. One TN Sheshan could set the elction process right. One Manmohan Singh could bring back the economy back on track. No one heard about these gentlemen before they assumed the office. So we need not be so pessimistic about Jan Lokpal Bill.

    i can see that there are only some differences between this bill and jan lokpal bill.  but i think that aruna roy should have been in the anna's team and try to resolve the issues.i think government is talking with her only to destabilize anna's movement.

    unless we fight as one, we cannot make this change happen. we can see even with somuch support government is playing around, does aruna roy really exepts government to listen to her for the people of this country

    Definition of corruption has wide meaning.Money in lieu of work is the last step of corruption.Also I suppose that taking money is as equally punishable as offering.Therefore,both side should have the punishment.There should be check for those who offers bribe,otherwise innocent gov.employees may be a victim of lokpal or jan lokpal bill.I suppose there should be check for NGOs and private business corporate,because sound comes only when both hands meets.
