Bangalore: Lawyer Behind Yeddyurappa Arrest Faces Contempt Case


Bangalore, Oct 15 (IANS): Bangalore advocate Sirajin Basha, whose complaint against B.S. Yeddyurappa resulted in the former Karnataka chief minister being jailed Saturday, now faces a case of contempt of court.

Justice B.S. Patil of the Karnataka High Court Saturday directed the court registrar to initiate contempt proceedings against Basha, who along another advocate, N.K. Balaraj, has filed five cases of corruption and illegal land denotification against Yeddyurappa.

Basha is facing contempt case as he objected to Justice Patil continuing to hear a petition by Yeddyurappa seeking quashing of cases filed by the two advocates and summons issued by the Lokayukta special court.

On Sep 30, Justice Patil had stayed the proceedings against Yeddyurappa in the Lokayukta special court. Patil had criticised Basha's conduct, seeking more time to argue his case.

However, on an appeal by Basha, a two-judge bench of Justice N. Kumar and Justice Arvind Kumar lifted the stay on Oct 4.

On Friday, Basha filed another petition in Justice Patil's court, requesting Patil to stop hearing Yeddyurappa's petition and transfer it to another judge.

Justice Patil Saturday said Yeddyurappa's petition will now be heard by another judge to be decided by the chief justice and also ordered contempt proceedings against Basha.

    At First you make Basha to run from pillar to pillar and now you have found loop holes in the judicial system to punish Basha because he created a situation where you have to reject bail eddy’s on saturday.I think people will loose trust on the judicial system if Basha is booked under contempt of court.
    I think the people , other judges and lawyers watching seriously what is happening in these days at the court of Justice Patil. At one point Basha and team is filing five cases against Eddy after a long process including approval from the Governor and on the other hand Basha is objecting justice Patil on hearing cases filed by Eddy advocates on Eddy seeking quashing of cases filed by Lokayukta special court which were based on justice hedge’s report.
    The Basha and team have been working since months together to file cases on Eddy on public interest and at the same time Eddy has the privilege to seek quashing of Lokayukta cases which were the main reasons for his resignation as CM. When both happens on the same day and same times and at the same judge then Basha after all a human being will surely raise a obligation on the judge to give more importance to his case rather than hearing and arguing on quashing cases on the same accused.

    Patil proved why Basha wanted the petition to be heard by a different bench, by his last action.
    When a prejudiced judgement might derail the very act of natural justice, & the accuser is reprimanded & the accused getting favours(unjustly)- He did the right thing by asking the petition to be heard by a different bench.
    Here the Justice is important than who hears it. Nobody should be in favour of tainted.
    Contempt is wrongly used to thwart justice seekers as we know those who sit in judgement of others themselves are not above LAW.
    In some cases Judges got almost impeached or resigned at the last moment-Why? Everybody knows the answers.
    Contempt of People is far GREATER than contempt of Court who are there to serve the people-& not the other way round.

    We too have blue-collar high-esteemed citizens like Justice B.S. Patil of the Karnataka High Court who wanted to punish those two lawyers from Shimoga and near Chikmangalur who were asking for just and quick justice in the interest of the general public. I wonder where the common people should go for justice. Justice is delayed, justice is denied.

    The common man is too innocent to understand the complexity of Indian Politics...the fact is that there is a puppet controlled by Kumar anna in the courtroom...the proceedings and logical conclusion of the case is not what is wanted but a negotiating tool in an hour of need or a convenient time.

    Where is the contempt here? Basha has every right to ask for a transfer of the case.It is now proved Basha had a good reason.

    BEFORE TRANSFERRING THE CASE JUSTICE PATIL PLAYED HIS LAST POWER, NOW A DAYS CORRUPTION HAS EVEN HIT THE COURT PREMISES, I HOPE ANNA WILL SUCCEED IN HIS STRIKE FOR JAN LOK PAL....
