New Delhi, Dec 17 (Agencies): Janata Party chief Subramanium Swamy will appear as a witness before a special CBI court in New Delhi on Saturday in support of his private complaint seeking home minister P Chidambaram’s prosecution in the 2G scam.
The court on Thursday had granted Swamy permission to become a witness against Chidambaran after he claimed, he would provide prima facie evidence on Chidambaram’s alleged role in the scam.
The court partially allowed the application of Swamy, who has not only sought to record his statement but also wants to examine some government officials, to press his case that Chidambaram, who was finance minister during the 2G spectrum allocation, was as culpable as former telecom minister A Raja in deciding the spectrum prices and entry fee.
In his three-page order, special judge OP Saini said the two witnesses mentioned in Swamy’s application “shall be allowed to be summoned only after the relevance of their testimony is explained (to the court) by the complainant (Swamy).”
The opposition has been demanding Chidambaram's resignation and a probe into the allegations against him.
UPA backs Chidambaram
Rejecting the Opposition’s demand as "extremely unfair", law minister Salman Khurshid said: "It is like saying the moment you move an application, everybody mentioned in it should be hauled up. It can’t be done. That is not the law of this land."
Telecom minister Kapil Sibal thrashed Swamy for his allegations, while backing Chidambaram.
"The CBI has submitted in the Supreme Court that it had looked into the matter thoroughly, recorded the statement of the then finance secretary, and come to the conclusion that no official of the finance ministry, including the then finance minister, had committed any irregularity or misconduct," Sibal said.
On acceptance of Swamy's petition by a special CBI court in connection with the 2G case, he said the magistrate was only following the law.
