Aarushi, Hemraj were found in objectionable position: CBI


Ghaziabad, Apr 23 (PTI): The Central Bureau of Investigation (CBI) on Tuesday said that dentist Rajesh Talwar had found his daughter and domestic servant in "objectionable position" and killed them using his golf stick and a sharp-edged weapon.

Deposing during cross examination in a special court in Ghaziabad, CBI Additional SP AGL Kaul, who led the second probe team, went into the motive behind the sensational double murder of 14-year-old Aarushi and domestic servant Hemraj at the Noida residence of dentist couple Rajesh and Nupur Talwar on the intervening night of May 15-16, 2008.

Kaul said according to his investigation Rajesh Talwar was awake in his room at 12 midnight whereas the time of murders, according to postmortem report, is between 12 midnight to 1:00 am. The officer claimed that according to his probe Hemraj was attacked in Aarushi's room on her bed, taken to the roof and dragged to a corner where his throat was slit.

Explaining the sequence of events which took place on the fateful night, Kaul said Rajesh heard some noise and went to Hemraj's room but did not find him there. "There were two golf sticks lying in Hemraj's room one of which Rajesh Talwar picked up. He heard a noise from the room of Aarushi. The room door was not locked and was just shut. He opened the door and found Aarushi and Hemraj were in objectionable position on the bed of Aarushi," Kaul said in his testimony.

Kaul said finding them in such a position, Rajesh Talwar hit on Hemraj's head with golf stick. By the time he gave a second blow the servant's head moved from the position and the stick hit Aarushi on her forehead. He said when golf sticks were seized the stick heads were not sealed separately. "The V or U shaped injury on Aarushi's forehead could have been caused by the use of golf stick head," he said.

The officer said the noise generated in the process awoke Nupur Talwar who rushed to Aarushi's room. "By the time the injured Hemraj had fallen from the bed. Both checked the pulse of Aarushi and found her near-dead which scared them and planned that the servant should be executed so that no one comes to know about the incident," Kaul said before the court.

He said both decided to hide the body of Hemraj and dispose it of on getting suitable opportunity. The duo wrapped Hemraj's body in a bed-sheet and dragged him to terrace where they slit his throat, covering the body with a cooler panel, Kaul said.

He said after coming to the room, they dressed up the crime scene by arranging the bedsheet and toys. They slit Aarushi's throat, to ensure that wounds on Hemraj and their daughter look similar, and Nupur cleaned her private parts, he said.

Giving details of his findings, the officer said the dentist couple cleaned blood stains, disturbed the router, collected all the clothes which were used to clean blood and also the small sharp edged weapon used in the killing with an intention to dispose them off. "They cleaned the golf stick which was used in the murder and hid it in the loft of Aarushi's bedroom. They locked the door of Aarushi's room from outside. They locked the outermost door from inside and wooden door from outside and entered the flat through Hemraj's room, the door of which opened between these two entry door. Both waited for their maid Bharti to come while Rajesh kept drinking liquor all this time," he said.

    Sensible observation. an outsider would flee the scene pronto. is not going to hang around cleaning up the crime or even to drag Hemraj's body up the stairs to hide it up the terrace. just murder and run as fast as he could taking the bottle of whisky to drink elsewhere, certainly won't be drinking it at the scene of crime. it is for sure an honor killing. the Talawars are trying to ride on the questions raised by the movie to their advantage. the police botched up big time in collecting evidence. and why did they allow the crime scene to be cleaned up so quickly.

    you too have fallen for police & CBI version of stories.
    The router was on all night which never says whether it was in use or idle.
    Why they never divulge the number of mbps sent or received before or after the crime? An evidence created by investigators to implicate Talwars of switching off @ 3.25 am.
    Why CBI never thought it was necessary to check the call records or Arushi?
    Simple they have done it & if they divulge & produce as evidence then their story of allegations falls through.
    The Police initially have sent Talwars to Jail for killing their daughter(if they had bought the police, they would have implicated Hemraj's friends like some have commented) who had objected to their illicit relationship. There is no mention of consensual sex between her & Hemaraj or any conclusive proof that she wasn't a virgin.
    They then planted a story of cleaned private part, for not finding any DNA of Hemraj inside her.
    Now the case is in Argument stage-
    The Prosecution will put forward their version of evidence & Defense will counter & Prove these WRONG later.
    Court will then give Judgment- Guilty or Not Guilty depending on Evidence.
    Talwars need not prove innocent, but prosecution has to prove them guility.

    For an argument sake let us believe that Talwars were fast asleep that night and didn’t not hear any noice. Though there are no solid evidences to prove the Talwar’s guilty, some of the circumstantial evidences good enough to nail them as only culprits. If you go by these evidences Talwar’s can never prove their innocence.
    First of all the post mortem report clearly tells that murders have committed between 12-1 AM. Who switched of the router in Aarushi’s room at 3:25 AM?. If its not Talwars who else did?. How come they didn’t get any clue that their daughter was murdered when they entered the room?.
    If the murderer was outsider what he has got to do with the router? Was is freely roaming in Talwars house from 12 Midnight to 3:25 AM when he knew that Talwars were resting in the next room.
    Secondly who does have the audacity to spend nearly 3.5 hours in a small flat after the murder to dress-up the crime scene. The murderer did all the cover-up works with ease as if it is his own house. He dragged the body of Hemraj to terrace, dressed up the Arushi’s bedroom, replaced the bloodstained cloths, cleaned up the private parts of deceased and more over had drinks sitting in the living room. If it was outsider the first thing he would have done is leaving the crime scene immediately after murder.

    Now Talwars have to prove their innocence in above circumstances.

    This is a pure case of HONOUR KILLING!This is alarm to all parents.Dont keep male servants when you have daughters and viceversa.Teenage is such an age were all involuntary muscles are active.They need all time parents and teachers as well wishers to guide.I remember when i was a teenager.I was so inspired by AXN fear factor that i wanted to walk on jute rope from our godown to our house.It was my uncle who saw me and stopped.Now i get goosebumps,thanks to him for saving my precious life.

    Whatever the comments from the readers here implicating the parents for murder MUST NOTE that the Indian Court cannot convict anybody based on the so called circumstantial evidence. The crime has to be proved beyond reasonable doubt. The burden of proof lies with CBI. They have to prove convincingly without any shred of doubt. CBI has proved time and again that they are incapable. They are only fit for political revenge cases.

    The last line of your comment that the CBI are only fit for political revenge cases.
    In the present scenario that seems like alluding to the Congress Party using the CBI against political opponents like the BJP ?
    Whether this is right or wrong is not the point. The point is that, that particular last line was diverting this 'Aarushi case' discussion towards politics.

    OK, I take your point Declan, your interpretation of my last line is very valid. But, it was not intended to mean that way. When I commented, Congress 'manipulating' CBI was not in my mind(you gave me that idea). I feel no matter who is in power, CBI will remain a puppet (remember Gadkari statement)and valuable resources of CBI are likely to be wasted behind silly cases (politically motivated). I still feel that CBI is incapable to crack any case under the present circumstances (to be under the ruling govt) unless it is given the autonomy. Thanks for your comments.

I agree with your comments that the CBI is becoming increasingly a tool of whichever Government that is in power for use against political opponents.     I have read somewhere that the Talwars are a issuless couple and Aarushi was not their biological daughter.

    Anyway, it looks like that Arushi's death was an accidental action occurred while punishing the servant Hemaraj.The second strike of the golf stick on Hemaraj accidently hit the forehead of Arushi which resulted in her death.

    Out of fit of anger, Rajesh killed the servant. There is a proverb - Don't take decisions when you are angry and don't make promises when you are happy. They may sometime work contrary to your interest.

    Imagine the scenario if Hemraj alone was dead by the blow and Arushi was not.

    Just imagine the events thereafter. Could her parents tell the world why, by who and where he was killed ? We are so cruel, our honor is priority to us, not the child whether or not she is biological.

    Its good that she is dead than dying each and every day struggling to find answers to our questions.

    If finally, the investigators and the judiciary are not able to conclusively establish anyone's guilt then it is better that the case be left as 'Unsolved' or 'Inconclusive' rather than run even the slightest risk of convicting an innocent person(s) just to satisfy the media's/public's pressure and impatience.
    I am not saying that the case should be 'closed' but Im saying that it should be left as an 'Unsolved' case which can be re-opened anytime in the future should there be any new substantial evidence found.

    Till then we can only hope for the Almighty's Divine justice to punish the guilty and solve this crime. Believe me the Almighty's justice never fails !!!

    Any Nepali Gorkha can slit the throat more precisely than doctors surgical knife!
    DNA on her bed- even a hair & blood contain DNA.
    Vaginal swabs were created much later.
    Funeral Hasty- a lie, as without police releasing the body after postmortem, they could not have carried last rites.
    To Guard their family honor, they might have initially tried to cover the clues. After consulting their family friends they came to their senses.
    All the evidence was concocted later by Police & 2 CBI teams were contradictory because of their initial bungling in collecting forensic evidence.
    My Daiji mates have fallen for their false allegations, which Arushi's parents have refuted in TV live interview point by point which changed my point of view, victims made Scapegoats is my point of view.

    Dev, it appears as though you are presenting your arguments here as though you have already established the innocence of the Parents.
    Everyone knows that there is enough circumstantial evidence to indicate the guilt of the Parents but at the same time there is sufficient doubt in favour of their innocence.
    Therefore, I think none of us should be too eager to decide 'guilty' or 'innocent' just yet. There are experts to do that. If they cannot, then let it remain 'Unsolved' until new evidence comes up. God bless them to make the correct decision.

    Circumstancial evidence created first by Police & later by these angered CBI for challenging their closure report are only theories.
    Until proven guilty, give benefit of the doubt to the victims. We including all that condemn them guilty, weren't present when the crime took place.
    Those who know our police know how they create evidence rather than finding the evidence which they consider is difficult & tedious.
    Nobody will believe their theories & cover-ups if you have inner knowledge of how they work.

    Dev, please understand that in law if there is circumstantial evidence but not enough conclusive evidence to prove a person guilty then even though the person is acquitted by the Court the person is not d 'Innocent' by the Court. The person is acquitted for lack of sufficient evidence and it is common sense that lack of conclusive evidence does not necessarily mean 'Innocence'.

    What seems to have been the initial bungling up of the forensic evidence by the Police could have been actually done at the behest of the wealthy and influential Doctor couple. You see the inefficient/corrupt Police theory works both ways. Thats why I am saying keep an open mind.

    I remember, it was said during the incident the Doctor couple was at some club. What is this new theory?
    Looks like Government officials have no responsibility.

    They had failed to prove that, 12 year old minor had sexual relationship with Hemraj in the initial investigation.
    Now CBI is floating a story to incriminate the parents.
    What Hemraj's 2 friends role in all these? Expose their hand & the real murderers will emerge.
    Another angle- Hemraj inivited his friends to have a drink after his masters retired to bed.
    After a few drinks they might have tried to take advantage of Arushi, which Hemraj objected & was silenced, Arushi got hit & was killed by them to cover their earlier murder.
    They vacated the house after covering their crime is a possibility.
    Now fiction has taken the prime stage as forensic evidence was bungled along with Police floating a theory of Arushi objecting her parents illicit relationship for which she was silenced!

    Let us agree about outsiders' advantage and Hemraj's defending. Could those outsiders, who are low-scale workers, manage a very professional, hairline slit from one year to the other below her chin ? Moreover, DNA traces of Hemraj were found on the bed sheet. Why weren't of the visitors ? Secondly, there wasn't a pool of blood in the room - the blook was clotted, signalling the slitting of throad (of both) took place much after they were hit on the head.

    Now, why the vaginal swab had to be swapped with someone else's ? Why a brother of Rajesh Talwar called investigating police officer to remove 'rape' word from the report ? Why the Golf Sticks that were not present during first time investigation in the lot were found during later-on investigation ? Why the two sticks were distinguishing because they appeared to have thoroughly cleaned ?

    Many questions remain unanswered. Yet, sympathetic that they lost their daughter. However, why hide the truth ? Why still maintain to uphold the honor when the daughter is not living anymore ?

    Note that Hemraj's friends were Nepali and it is well known that certain Nepali communities are very skilful at using the 'Kukri' which could possibly be the reason for the precision throat slitting. However, Im no expert to distinguish between a Kukri slit and a surgically made slit. This is just an alternative observation which even the CBI had made earlier in their investigation which is why the 'surgical slit' theory is also hanging in doubt.

    Circumstantial evidence is loaded against the parents. All involved have been examined/questioned over and over again including Hemraj's known friends/associates.
    It seems to me that even if the parents did not actually kill Aarushi they must be knowing who has and why. In addition to other circumstantial evidences the hasty manner in which the parents proceeded with her last rites also gives reason to point the needle of suspicion towards the parents. Now only the Almighty can provide help to the investigators to conclusively solve this crime. I am not alluding to the parents or anyone in particular but I only pray that no innocent is convicted.

    Please check the case file or history of this crime. 1. Arushi had a relation with Hemraj 2. Parents found there relation in appropriate circumstances Above has happened because the parents were not able to give proper care to the kid. If you Consider the above two points, it is quite judgemental to understand who murdered whom and why?

    Honour killing. A good Father should have persuaded her daughter to marry servant Hemraj after seeing her in intimate position , rather than ending both of their lives brutally. Two young s lives lost. A mystery file closes here.

    Accomplice brother was present before and after killing.why were other servants not questioned.If Hemraj and Arushi wanted to have intercourse,they could have when her parents were at work.why was the victim tested for rape.
