SC gives a month to overstaying MPs, judges to vacate premises


New Delhi, Jul 5 (PTI): The Supreme Court today set a one- month deadline for ministers, MPs, judges and bureaucrats to vacate their official accommodation after retiring or demitting government office.

A bench of justices P Sathasivam and Ranjan Gogoi expressed concern over MPs, ministers and bureaucrats illegally overstaying in their official accommodation and said that they must vacate the premises within a month after demitting office.

It said the time can be extended by another month under special circumstances.
The bench framed a slew of guidelines for government authorities to take action against the illegal occupants.

"It is unfortunate that MPs and ministers continue to remain in official accommodation beyond their entitlement," the bench said.

It said that in case of MPs, Speaker of Lok Sabha and Chairman of Rajya Sabha should initiate proceedings against them for breach of privilege.

The bench said that three months notice should be given to the officials before they are supposed to vacate the premises and reasonable force can be applied against them if they refuse to leave the accommodation.

The bench said overstaying in government accommodation encroaches upon the rights of other person to whom it is to be alloted.

    Double Rent should recovered from all these people for the overstaying period, and if they do not pay the same, their valuables may be confiscated while vacating forcibly.

    Right decision. If they overstay charges as per 5 star hotels heavy penalty to be imposed on defaulters.

    Law makers are Law breakers. SC is the only authority to straighten these law makers when they become law breakers. No common man will have the guts to touch these shameless servants of the people of India. Good judgement by SC.

    The problem is that these jokers who misuse facilities will get their "chamchas" to stop eviction.
    How I wish the SC would have added that retirement benefits should not be released to judges & babus till they return ALL repeat all Govt property, be it car, mobile, house, furniture & fixtures, etc etc to the department and get a clearance certificate for release of benefits ( am sure none will starve if they delay in this).Add to it, the penalty must be very high- commercial rent for the second month and double commercial rent for the third month (with no excuses whatsoever)- as for the politicians if they do not leave their official premises within 30 days of losing the elections, they must lose the water, electricity and other facilities which the Estate Manager must switch off on the 31st day. The SC should penalise the Estate Masnager if he/she does not follow this rule.
    (maybe even for babus this will be a good deterrent for wanting to live in posh comfort).
    I would like to add that ALL STAFF must be withdrawn at the end of the 30th day.

    They should be informed only once to vacate, then an eviction notice issued. Finally they should be thrown out on the road along with their belongings as is done with the common man.
