Cabinet unanimously withdraws ordinance, bill


New Delhi, Oct 2 (IANS): Forced into a corner after a public censure by Congress leader Rahul Gandhi, the cabinet, presided over by Prime Minister Manmohan Singh, Wednesday evening withdrew the controversial ordinance and the bill that sought to save convicted lawmakers from disqualification.

A day after the prime minister indicated that the ordinance could be taken back, the cabinet met for just 20 minutes at his official residence to take the decision, brushing aside the disapproval of some Congress allies.

A visibly hassled Information and Broadcasting Minister Manish Tewari, who was among the ministers who had earlier stoutly defended the ordinance, told the media: "The decision of the cabinet to withdraw the ordinance and the bill was unanimous."

He insisted that the cabinet U-turn did not mean that Manmohan Singh's authority had been undermined by Rahul Gandhi, the Congress vice president who chose to publicly denounce the ordinance, that too when the prime minister was abroad.

BJP's prime ministerial candidate Narendra Modi was quick to condemn the Congress-led UPA government.

"The government does not know the pulse of the nation or they would not have brought an ordinance to shield convicted politicians," he said at an event here.

The writing on the wall was clear since Gandhi's Sep 27 dramatic outburst that the ordinance was "complete nonsense" and should be "torn up and thrown away".

The ordinance, now with President Pranab Mukherjee, sought to overrule a Supreme Court ruling that favoured the disqualification of convicted MPs and state legislators.

"Democracy is not a monolithic authoritarian system of government," Tewari said. "We respect the diversity of views, and there was a view which was articulated by Rahul Gandhi."

He said Gandhi's criticism was possibly based on a "wider feedback".

"Under those circumstances, the (earlier) cabinet decision was reconsidered and it was decided that we would withdraw both the bill and the ordinance.

"It demonstrates that you have a government which is not authoritarian in nature." The bill would be taken back by parliament "at an appropriate time".

Nationalist Congress Party chief Sharad Pawar did not look too happy after the cabinet meeting.

"We (NCP) have communicated our views. What I said was said in complete secrecy. I made my views clear," the agriculture minister told reporters.

National Conference leader Farooq Abdullah too was blunt: "It was a cabinet decision then, it is a cabinet decision now... I am not upset, but I am not happy."

According to informed sources, the allies were unhappy that the government wanted to axe the bill also.

They said Pawar and Abdullah expressed reservations over the manner Rahul Gandhi trashed the ordinance and the way the cabinet surrendered.

The road to the ordinance's burial began early in the morning when Gandhi called on the prime minister to explain his criticism of the ordinance.

Hours later, the Congress core group, including party president Sonia Gandhi, Manmohan Singh and other senior leaders, who had last week cleared the ordinance, discussed its likely withdrawal.

Shortly thereafter, the prime minister met President Mukherjee, before the latter began a week-long trip to Turkey and Belgium.

The president, who has not yet given assent to the ordinance passed by the cabinet Sep 24, had sought clarification from two ministers.

Rahul Gandhi's criticism triggered a political storm, with the Bharatiya Janata Party (BJP) saying the prime minister must resign as his authority had come under question. Manmohan Singh has ruled out stepping down.

BJP president Rajnath Singh said the ordinance withdrawal was "better late than never" for the country. The BJP claimed it was its pressure that forced the change of mind.

On July 10, the Supreme Court held as unconstitutional Sector 8(4) of the Representative of People Act and said an MP or state legislator must be immediately disqualified if convicted by a court in a criminal offence with a jail sentence of two years or more.

The UPA government's desperation to pass the ordinance was widely seen as an attempt to save Congress MP Rasheed Masood, who was Tuesday jailed for four years, and ally and RJD leader Lalu Prasad, who has been convicted in the fodder scam. His jail term will be announced Thursday.

Masood, a Rajya Sabha member, became the first politician to lose his seat in line with the Supreme Court ruling.

    First these congis are made Pranab Mukherjee as President as they donot want him in cabinet as he was only one straight and non corrupt. Also he was PM material. Hence to make the way easy for Amul Baby they made Pranab da as president.
    Now they realized pranab da is not going to sign the ordinance hence Amul Baby took the opportunity to become the hero and came front of the media. Poor makad (maken) left speechless when Amul baby giving his version of two line to Media which he said first time without anybody writing speech for him.

    Amul baby tried to become hero but became big zero.

    Yesterday Feku exposed himself by passing his version of the Lok Ayukta bill in Gujarat. This is the very same man who goes around day in and day out talking about corruption and transparency, but now wants a rubber stamp as Lok Ayukta in his own state. His impotent bill gives the CM the final say in the appointment of the Lok Aykuta and also states that the investigations and findings of the Lok Ayutka are not binding on the government. If such a person becomes the PM of the country he will surely rape the laws of the lands. Don't be surprised if he tomorrow appoints Amit Shah as the Lok Ayukta of Gujarat.

    I think this Aam Aadmi Party is like the BJP 'B' team and may one day merge with the BJP if they fail to take off the ground. The AAP which was born out of the Anna Hazare movement has not really been able to hit any headlines as they do not have Anna Hazare with them.
    In fact I heard that in a survey conducted of the AAP supporters in Delhi most of them indicated their preference for Modi as PM instead of any AAP leader. Wierd !

    KRPRABHU, you are right. In the bottom of heart all Political parties were happy with ordinance, because all political parties are formed by criminals, rapists and looters. Now, when they realized that the ordinance will be withdrawn, every one says they were against ordinance. And, unfortunately, it is evident from the comments, many people still likes to be ruled by criminal politicians who are busy giving trophy to Aam Admi Party, BJP etc. for withdrawal of ordinance instead of enjoying the withdrawal & cleansing the Parliament from criminals.     Amul baby is any day better than tuss pataki feku. We need leaders like Shrimaan Rahul Gandhi and not comedians like Feku. In case a necessity arises to elect a comedian, we prefer Johnny Lever as his acts and jokes are more entertaining and funny than Feku's.     When the Ordinence was drafted what Rahul Gandhi was doing? Is he sleeping. Then after become PM what he will do? Proposse any bill and later he will say " oh this is nonsence" Then his chelaas will say " Gandhi's criticism was possibly based on a "wider feedback". No budy have the guts to talk against the truth in Congress. So, many senior leadrs in Congress in Congress say Rahul is great. He is the best canditate to the PM. Is he is the best then what experience you got from so many years as an MP and MLP.
    Are you good in Politics. Did you do anything to the public. Rahul doesn't know what to talk and when to talk. I am not against rahul but as an PM or as an MP MLA he is not fit.

    Funny drama by Rahul Gandhi... With this acting skills he can get into 'comedy circus' or movies like 'phata poster nikla ZERO'.

    The way he emerged into the press meet and disappeared immediately.. just by uttering one sentence regarding ordinance showed his stupidity & cowardness. Thank god, as elections nearing he atleast managed to get some publicity for his fekugiri of introducing and withdrawing d bill...

    Declan let me clear your misconception... an Indian doesn't need a US Visa to become a PM... Modi is alone able to save India and doesn't go crying to US to help save India :p He's not one of those Aurath types like the present PM or the Cong PM candidate. So he doesn't need a Visa to US.. It's waste of time going to US when you have your responsibilities as a PM in India. Another thing to know is the present government is a... licking the US.. and there is no way they will let Visa to be issued their opponent. Just wait and watch after the 2014 elections when Obama will fly to India to seek Modi's help.. Visa is not a concern.. It's not a nationality ID proof anyway.

    Could you please let us know in which cave Rahul Gandhi was hiding when this bill was drafted and passed in the parliament? Remember dude, this bill was not passed overnight, it took more than 1 month.

    Now the question here is:

    Why did Rahul Gandhi not raise his voice against the bill during its formation if he was really concerned about it?

    My Answer: Rahul Gandhi was under understanding this bill and what the other people were discussing in the parliament. A week back someone had prepared a SPEECH SCRIPT for him. He just read out that last week in a function. Let us salute that script writer.

    Shame on your party man. What candidate are your projecting as PM candidate? Don't you have any other good person in congress party?

    No use of BJP opposing for any bill. Since you brought judiciary system under your control, everything is possible for you.

    It is Govt's duty to take everyone into confidence before passing any bill. Your Govt could not take your MP Rahul into confidence while passing this bill, how do you expect your Govt to take other parties into confidence?

    When the Secret Survey Agency disclosed that UPA would lose atleast 35 to 40 seats in next LS election only because of this Ordinance, the Cong Strategists came up with the novel plan to withdraw the Ordinance and also to give the credit to Rahul Gandhi to save embarrassing situation. So in the last moment Rahul was advised to Rush to Press Conference of Ajay Makhan and shoot those by-hearted words and rush back within few minutes without giving chance to the journalists to ask any question such as - why he did not oppose the same even though he knew about ordinance many days ahead. This Congress strategy seems to have given some shine to Rahul.
    But now every one is asking one main question - why same Rahul did not oppose when same govt passed the bill of exempting Political Parties from the ambit of RTI Act ? In fact RTI act was more important than this Ordinance.

    Forcing the Union cabinet that includes opposition parties too who are parties in passing the ordinance that sought to protect convicted MP's & MLA's to withdraw the ordinance.

    Rahul Gandhi is not in the unit where an ordinance is discussed and passed but leaders of opposition are. The drama anticipated was that the opposition wanted to make it a an election slogan - thanks to Rahul Gandhi - they lost that too !

    He did not have say because he is a mere MP - not a minister. He exercised his right, right in front of the media so that the entire nation hears it.

    MMS told yesterday during press conference that the ordinance was brought discussion not once but TWICE. Let the opposition now answer, why did they not oppose it inside the house ?
