Reject Rajiv killers' mercy plea: Centre to SC


New Delhi, Feb 4 (IANS): The government Tuesday urged the Supreme Court to reject the plea by three Rajiv Gandhi assassins seeking commutation of their death sentence to life, saying that they suffered no agony or dehumanisation during 11 years when their mercy petition was pending with the president.

Attorney General G.E. Vahanvati told an apex court bench of Chief Justice P. Sathasivam, Justice Ranjan Gogoi and Justice Shiva Kirti Singh that the petition by the Rajiv Gandhi assassins was not covered by Jan 21 verdict of the apex court, which said that inordinate, unexplained, unreasonable delay was a ground for commuting death sentence into life imprisonment.

Vahanvati told the court that all through these 11 years, these three assassins were living a full life by holding music shows, art exhibitions and other recreational activities in the jail.

He also said that in the mercy petition to the president filed April 26, 2000, there was not even an iota of remorse for their action of killing former prime minister and they even justified it.

He said that this absence of remorse assumes serious connotation because their mercy petition to the president was made after their similar plea was rejected by the Tamil Nadu governor.

Rajiv Gandhi was killed in 1991.

    They were holding music shows, art exhibitions and other recreational activities inside the jail. Was this done officially or unofficially? If done officially what was the fault of the prisoners? If done unofficially why did the prison authorities allow it? Whatever be the case, the government cannot keep the mercy petition indefinitely. They should either accept it or reject it a the earliest. Who knows how many prisoners must have died and their mercy petitions are still with the government pending?

    Honorable Supreme Court of India has well reputed, expert judges. Hence the dongi people do not stand to advice SC.

    I feel after 1984 and 1991, innocent people of India are safe. Hence the assailants mercy plea should be considered.

    Killing the killer is no solution does not solve the issue. Tit for tat is barbaric. Put them in jail for all their life and make them feel sorry for their deeds.

    What you say is reasonable and logical, but practically it may not work always as we have seen in the case of the Kandahar hijacking of the Indian Airlines aircraft where the inefficient NDA led govt. (who were caught off-guard) were forced into releasing dangerous convicts when the hijackers threatened to kill the passengers.

    Similar situation can happen in the future and prisoners on death row/life sentence can go free.

    A serious deterrent is needed. It will not stop crime, but it will certainly bring down the rate of crime.
