UP govt was negligent in preventing Muzaffarnagar riots: SC


New Delhi, Mar 26 (PTI): The Supreme Court today held the UP government led by Akhilesh Yadav prima facie responsible for negligence in preventing communal violence in Muzaffarnagar and adjoining areas but refused to direct a CBI or SIT probe into the cases.

A bench headed by Chief Justice P Sathasivam passed a slew of directions for proper investigation in the cases and for rehabilitation of victims of the communal clashes.

"We prima facie hold the state government responsible for negligence in preventing such incidents," it said.

The court said that the state government was taking proper action and had constituted a special investigation cell for conducting probe into various cases and there was no need for a direction for a CBI or SIT probe at this juncture.

It directed the state authorities to bring to book all accused persons irrespective of their political affiliations.

It also directed that the victims and their family members be given protection by the state government till the completion of trial.

The bench passed the order on a batch of petitions filed by various people including riot victims seeking its direction to the state government for proper probe into the cases and for a CBI investigation.

The petitions had sought the court's direction to the Centre and Uttar Pradesh government to find out the reason behind the communal clashes in the state.

The PILs had also sought that the affected persons should be properly rehabilitated and the culprits behind the violence must be brought to book.

The communal violence, which had broken out on September 7, last year in Muzaffarnagar and adjoining towns, had claimed over 40 lives. It left 85 others injured and rendered 51,000 people, mostly Muslims, homeless.

The PIL was filed by Mohammed Haroon and others in the apex court.

The counsel for the petitioners had earlier submitted that the situation in Western districts was grim as mobs had set ablaze many religious places, shops and houses.

    Now our Apex court also has double standards. They are saying that the UP and the Central govt should take the responsibility and should have prevented the riots then why the Godhra riots is not the responsibility of the state govt at that time and why a clean chit to Narendra Modi. Is it not double standards by our Supreme Court.

    If daijiworld is to publish one of their previous news report where it mentioned Amit Shah was appointed as UP state incharge. I mentioned in a comment riots are now inevitable. It is not a prediction, it is simply a pattern. It is not UP Govt alone, every other non-BJP govts are negligent. There is a heavy undercurrent is flowing to push religiously biased anger. Riots simply are the next stage of ution, where the blame never falls on those, who ignite the anger.

    Yes, indeed UP govt was negligent in containing riots and Supreme Court realized this very late but appreciable. But our bogus secularists are more interested in one and only 2002 riots than this.

    If UP Govt can be considered as negligent. Agreed. What can be called of Modi, who the same supreme court, called as Nero. Those who haven't heard of Nero, Nero a roman king, was playing music when the entire city was burning and rioting. Only Modi is the leader to date, who has been named that way by SC. That speaks volume. Everything in courts depends on evidence. When there is no evidence nothing happens, just look at Church attacks in Mangalore. Nothing ever happens to the instigators.

    Now that SC has upheld the corrupt & communal SP Govt at UP solely responsible for the Muzaffarnagar riots, it is time that the Akhilesh Govt is kicked out immediately by the Governor & by the Central Govt so as to allow free & fair elections to the LS & subsequently to the assembly too. How the SP tried very hard to camouflage the situation by trying to blame the BJP is very clear....
