Amway India CEO arrested for 'unethical circulation of money'


Hyderabad, May 27 (IANS): Andhra Pradesh Police have arrested William S. Pinckney, managing director and CEO of Amway India, evoking strong condemnation from the direct-selling firm and the industry body FICCI.

A team of police officials from Kurnool district arrested him late Monday from the company headquarters in Gurgaon following a consumer complaint against the firm.

According to police, a case was booked against Pinckney in Kurnool for unethical circulation of money.

Police said several criminal cases were booked against Amway in Guntur, Vijayawada, Prakasam, Medak, Hyderabad and Cyberabad and investigations were on against the company.

The Crime Investigation Department (CID) had booked a criminal case against Amway in 2006. The CID had filed a charge sheet against the company and the same was taken cognizance by the chief metropolitan magistrate's court at Nampally here.

According to a statement released by police, the Andhra Pradesh High Court in 2007 had declared the Amway scheme as illegal under the Prize Chits and Money Circulation Schemes (Banning) Act, 1978. The Supreme Court had upheld the same.

The home department in 2008 had restrained Amway from issuing advertisements and directed police to confiscate the material.

A police official pointed out that Enforcement Directorate also registered a case against Amway under the Foreign Exchange Management Act, 1999 and the matter is under investigation.

Last year, Kerala Police had arrested the Amway CEO and a court had sent him to judicial custody.

Meanwhile, Amway has expressed shock over the "unwarranted detention" of its official. "The case against which the action has been taken was filed in December 2013. The company had no prior information on the same. The allegations mentioned in the FIR are frivolous and gives a misleading impression about our business," a company statement said.

Amway said that as a law abiding corporate, it always cooperated in investigations, and has been responsive to queries and documentation.

"Due to the lack of a legal framework for the direct selling industry, any case filed is being misinterpreted and booked under the Prize Chits and Money Circulation Schemes (Banning) Act 1978 (PCMCS), which is otherwise intended to regulate financial schemes," it said.

"The direct selling industry has been repeatedly seeking an amendment to the PCMCS Act and has been working along with various industry bodies and government for the same. We urge the authorities to take note of the challenges faced by this industry and give us clarity to facilitate its smooth functioning," the company statement added.

Amway claimed that it is a legitimate direct selling FMCG organization operating in the country since 1998, selling more than 140 high quality products. It has made an investment of more than $100 million in a manufacturing facility in the country.

Amway, a 50-year-old manufacturer and direct seller, is operating in over 108 countries.

Meanwhile, FICCI condemned the Amway CEO's arrest. "This move has been initiated by a consumer complaint and could have been easily addressed as a consumer redressal since there was no criminality involved," the industry body said in a statement.

FICCI called for a clear and independent regulatory framework for the direct selling industry in India, urging the authorities to take note of the challenges faced by this sector and give clarity to facilitate a clear distinction between fly by night operators and legitimate businesses.

"This uncalled for action might also have an adverse impact on India-US business relationships," said its secretary-general A. Didar Singh.

    Amway products are too expensive based on the quality they offer. It is a pyramid scheme and the vast majority of the people are brainwashed to believe in a fairly impossible dream pattern but the nice talk will fool the gullible people. I know about Amway since 1971. Amway has a different title in the U.S. now because of the negative publicity of the company. The topnotch people are too sweet talking people promising paradise on earth. The politicians need to join Amway to add more color to the political lectures.

    Please read the Article, there itself it proves- there is no unethical business practice by this company, sour grapes in throat has brought these comments, without any knowledge about the company or their products.
    Its not a money chain which distributes the money of those who join to his uplines without selling or providing any service like ponzy schemes.
    The joinee will only get any commission if he sells the products. He pays nothing to join as such no way anybody can be put to loss or taken for a ride.

    The company has paid to Indian govt. 200 crores in taxes, has its own manufacturing facilities in India.
    Their products which are backed by 1000 patents which are Green & ecofriendly, the quality of which no other FMCG has ever succeeded to deliver at their cost.
    The cost of use per unit is cheaper as they come in concentrated form without water & packings which saves lot of money through whole sale packings.
    Their Nutrilite Dietary supplements which are grown from seeds to final product are organic & provide results which no synthetic available over the counter have been able (failed) to provide.
    In 1996 itself they have asked the govt. to frame rules & regulations, but successive govts. failed,as in many countries as soon as they entered, many ponzy schemes arrived to cheat people by claiming just like Amway.
    They had asked Manmohan Singh to frame again the rules but being snail paced he failed as well.
    Modi being proactive will frame them along with his team of Ministers as early as possible.
    The Diamond gets more shine & beauty enhancing its value as it gets cut & ground repeatedly. Amway will come out with flying colors too.

    Complete explanation. i agree with you. Its nature process that true valued activities will have struggle in the beginning face.BUT AMWAY WILL ROOT IN INDIA STRONGLY WITH ETHICAL VALUES. THESE ANTI AMWAY ACTIVITIES DONE BY JEALOUSY PEOPLE WHO ARE LAZY WHO ARE NOT FOCUSSED IN THEIR LIFE.

    I fully endorse the comment of Eric Coelho, Mangalore.As he rightly said India has become a heaven for unethical business by international companies.Anybody can come and do the business without any control or problems at the cost of Indians,who are in fact fools in one way.According to them Amway products are directly coming from the nature without the involvement of any mediator or any kind of advertisements but the fact is the products are pretty expensive not reachable to common/poor people.Even I attended their workshops to join them but after attending their workshops/meetings I thought that it is not worth joining them when i can't deliver the goods.However many people minted the money and amassed the wealth and reached their respective star status.Country should have its own norms and laws governing the business and punish guilty,which we lack in India.
    Everybody is enjoying to their maximum at the cost of the poor/middle class.

    Being part of this Company i know its tactics and techniques. No doubt the products are good but in order to avoid negativism from the Market they started Advertisements and captured the costumer network by Direct selling. Products are Expensive and Distributors run Carrot - Donkey Race.

    What surprises of this International companies - They cannot do unethical business in their country, so they come to India to do their unethical activities. India has introduced economic reforms but it has became a place for Unethical activities, dumping ground and what not. They say "You Name it and you will Have it".
