MUMBAI, Nov 21: A Session court here on Tuesday adjourned to November 23 the bail plea of 21-year-old Alistair Anthony Pereira, who mowed down seven pavement dwellers sleeping at Carter Road in Bandra on November 12.

The plea of Pereira, son of a city businessman, came up before Sessions Judge A T Amlekar. In his bail application, he contended that he had been in police custody since November 12 and police had sufficient time to investigate the matter.

He had neither the knowledge nor the intention of committing the crime, hence section 304 was not applicable and instead section 304(a) pertaining to rash and negligent driving would apply in the case.

Being young, his entire career will be jeopardized if he continued to be in custody.

In the wee hours of November 12, Alistair's Toyato Corola ran over 15 construction workers sleeping in front of a temporary shed on Carter road in which seven persons died and eight were seriously injured.

Last Saturday, Bandra Metropolitan Magistrate court had granted Judicial Custody to Alistair. He has been charged under IPC 279, 336, 337, 338, 304, 427 and 185 of the motor vehicle act.
