Salman Khan car crash: Man died due to car falling, says defence

Mumbai, April 17 (IANS): Giving a sensational twist to the ongoing re-trial of Bollywood actor Salman Khan in the accident case, his lawyer Shrikant Shivade on Friday argued that one of the victims could have died because of the impact of the car falling off while being lifted by a crane.

Salman's vehicle had rammed into the American Express Bakery in Bandra West early morning of September 28, 2002. One pavement dweller, Nurulah Mahboob Sharif, died in the accident while Munna Malai Khan, Kalim M. Pathan, Abdullah Rauf Sheikh and Muslim Shaikh sustained injuries.

"There are incriminating circumstances to suggest that the car dropped on the persons who were under it when it was being lifted with the help of a crane brought in by police after the accident," Shivade said in his ongoing final arguments in the case before Additional Sessions Judge D.W. Deshpande.

He further pointed out that the injury certificates of the four people suggested that the injuries were because of "friction" and "dragging", the autopsy of the deceased victim Sharif showed that he was "crushed".

"He (Sharif) was crushed as some heavy object fell on him," Shivade told Judge Deshpande, adding that the car weighed around 3,000 kg.

Shivade pointed to the autopsy report which suggested that the head, chest, lungs, thorax, larynx, trachea and bronchia were crushed completely.

"Can a person in such a condition cry for help," he said, suggesting that Sharif could have died because of the impact of the car falling off while being lifted by the crane.

He also termed as "misleading" the statement of one of the injured witnesses, who said Sharif was below the car and screamed and shouted till the crane lifted the vehicle.

Perhaps paul dsouza does not know what is the difference between road and foot path. Because most roads in Mangalore/udupi does not have the foot path. Otherwise, he would not have commented in such way....

Also, it took more than 12 years to solve this issue... what a pathetic condition of our legal system. Murderer is free outside.

Though Paul's comment is true but bit rude, but Tridev you should blame the owner of bakery for not giving the employees accommodation thats why they slept on foot path or its people who slept on foot path to be blamed. Drinking and driving is wrong, but sleeping on the footpath is equally wrong. Here if people not sleeping on foot path it would be a drunk and driven accident case. When celebrities involved the case goes complicated. However justice prevails.

You might have not seen the life of Mumbai.. Some of rickshaw drivers are sleeping in their vehicles and go to public toilets. They can’t afford accommodation in Mumbai. A survey, BaTh (Bathing Trend, Belief and Behaviour Survey) conducted by National Integrated Medical Association (NIMA), revealed that of the 600 respondents in Mumbai, 32 per cent don't bathe daily. Of the 600 people surveyed, 300 were middle-aged men and women and the remaining were children in the 8-14 age group. They can’t take bath daily because of water, time etc. Most of the low salaried people sleep on footpath or Railway or bus stops.

Collective conscience of the society should explore the options of boycotting films starred by criminals. These people are testing the efficacy of Indian criminal justice delivery system with their money and muscle power. Whatever they have eaten has gone to build-up muscles to leave nutrient- starved gorilla brains. The inevitable can be delayed, but cannot be denied.

everyone should not have thier own perception here rather hope that truth prevails.

in western countries we see numerous cars crashing into the pavements but nothing will happen neither top the occupants of the car nor t o anyone in pavements as no one will be sleeping there .

pavements are not for sleeping purpose.in night, if the vehicle lost control due to high speed it will be very difficult to stop and also if another vehicle comes in front during night in high speed ,to avoid that, driver may have turned the car to pavement to avoid accident.lets hope the truth prevails.

for some people, salman khan was hero a year before and suddenly he has become a villain now.lolz

We are talking about Indian accident. The Government must catch the people who are using footpath other than walking.... In western countries you can marry and have more than 1 wife and have as much as you can but you must have separate room for each family member otherwise he will be penalized but in India one room house man will marry 4 times and have children more than 10. Is there any punishment for this????

Irony of law...Why in India it is taking time....at last these criminals will evade law and court will proclaim there is no prosecutable evidence and these criminals are good at hiring some of the best lawyers .....Law is always in favour of rich and those who have political backing....We cant prosecute salman...sanjay dutt stays out in parole more than staying inside jail...In hashimpur riot case there is no prosecution of those personnel who have done cold blood murder.....
I just wonder what would poor and marginalised section of society has to do to get justice if we are moving in this direction...
Salman should be ashamed for "not being human"...now he has started blaming on innocent car driver....latest twist now he started blaming on victim itself...Meanwhile people should also pity on that black buck on that killing case he will now blame blackbuck tried to attack him and he killed it...
