Delhi court calls Jitender Singh Tomar’s arrest a 'farce'


New Delhi, Jun 10 (I Exress) : A Delhi court on Tuesday sent former Law Minister Jitender Singh Tomar to four days in police custody. It, however, observed that the arrest notice issued to Tomar by Delhi Police was a “farce”.

Metropolitan Magistrate Navneet Budhiraja observed that the notice served under section 160 CrPC “appears to be a farce exercise”, after Tomar’s counsel argued that the police arrested him under “political pressure” and the notice for arrest was served upon only after the arrest.

“This has happened for the first time in history that a person is arrested first and served a notice under section 160 CrPC hours later. This shows there is political pressure. The complaint was given by the Bar Council on May 10, but police comes to my office almost a month later, and I am taken to the police station. Only after this was I served the notice (under 160 CrPC) at 12:30 pm. This can happen only in police raj,” senor advocate H S Phoolka said.

After this the court asked the police, “Was there compliance with the Supreme Court guidelines on arrests? Have you served the notice to him?” The investigating office replied: “Tomar is an influential person. Almost every educational certificate was fabricated and he can also tamper with evidence.”

The court rebutted this argument and said, “What was the hurry to arrest him. You have served the notice only today. The notice issued appears to be a farce.” The court has directed the police that a lawyer will accompany him wherever he is taken.

    Mr. Sachidanand Shetty, Tomorrow if wife complains that husband is harassing her for dowry, then court and police first will arrest the husband!. Whether he is innocent or not will take time to prove in court and initially he will get aeroplane treatment first!.

    But for everything there is a procedure laid down by SC and that has to be followed!which was not followed in Tomar's case is what is being pointed out!. Recently 3 people who were convicted and jailed for life 13 years back for a murder were released by the SC because the man whom they had murdered surfaced!. So for 13 years didn't they, their families suffer the stigma of murder!? think about it.

    In Maggi episode Modi governments face is being blackened!. They have made themselves a laughing stock by relying just on a single UP lab report!. All other labs in India have given a favourable report including Singapore about Indian noodles imported there!. Now the only way left to them is to quietly let things cool down and pretend as if nothing has happened!. Similar is the case with Tomar!. Here also Modi government is interfering too much with a elected government and want to portray AAP as good for nothing and corrupt. Surely this will backfire on the NDA government.

    You are right. What is happening against Maggi i.e. Nestle seems more like some deep rooted conspiracy to displace Nestle from the market most probably for the benefit of some 'favoured Corporates'.
    Maggi noodles have been around so long so why suddenly now this witch hunt against Nestle.
    I say witch-hunt because the problem even if there has been any with Maggi samples is being blown out of proportion. It seems like like the focus here is more on damaging NESTLE'S reputation rather than protecting the health of the consuming public.

This circular was issued inspite of other states and nestle itself saying there is no problem with maggi. The lab in UP is not a state government run.     the allegations against the smriti irani cannot be compared to the Tomar case because Irani was facing the charge of providing wrong information (Irani had made contradictory declarations about her educational qualifications in her election affidavit), while the allegations against Tomar was about printing of fake degree certificate, submitting it before the Election Commission, and then becoming nothing less than the law minister in India's capital city on the basis of his fake degree.

    Absolutely true. Falsification of an official government document is a crime punishable by Indian law, be it a degree certificate or the Election commission's nomination form and sworn affidavits.
