Bengaluru, Dec 16: Former union law minister, M Veerappa Moily, got big relief in a case registered against him in connection with violation of model code of conduct during the campaigning for Lok Sabha election when fighting from Chikkaballapur constituency. On Tuesday December 15, the court dismissed the charge sheet filed against Moily in the said case.

The single judge bench of the high court presided over by Justice Rathnakala upheld the petition filed by Moily seeking dismissal of the charge sheet filed against him in the court of junior magistrate first class.

A person named S S Abid had filed complaint under Indian Penal Code section 188, alleging that Moily had organized procession of school children during the Lok Sabha election in 2014 when he was fielded by Congress, without obtaining prior permission from electoral officer. The bench, which went into the merits, observed that the complainants do not have the right to register police complaint in such cases and the police do not have the provision to file a case. It observed that the complainant should have approached the magistrate's court with private complaint. "As this complaint was directly filed in police station, the investigation conducted by the police and the charge sheet filed in the lower court are not admissible," it said in its verdict.
