Bengaluru: CJ recuses himself from hearing appeal filed by Justice Adi

Bengaluru, Mar 23: State high court chief justice (CJ), justice S K Mukherjee, has recused himself from hearing an appeal filed by state Upa Lokayukta, justice Subhash B Adi, questioning speaker, Kagodu Thimmappa's action in adopting a motion to remove him from the post. Congress legislators had brought in this resolution, claiming that Justice Adi had violated certain norms when discharging duties as Upa Lokayukta of the state.

When the appeal came before the division bench of which he was a member, the CJ said that the assembly speaker had written to him, asking him to investigate about allegations against the appellant. Therefore, he felt that it would not be in the interests of justice to hear this appeal. Justice Mukherjee said that the case would be shifted to another bench.

He also orally asked the advocates for Justice Adi whether the appellant would not face embarrassment to appear before another judge for the hearing, taking into consideration the fact that Justice Adi had earlier worked as high court judge.
