Udupi: Bhaskar case - Mother approaches court to nullify Rajeshwari's GPA

Udupi, Dec 1: Slain Bhaskar Shetty's mother, Gulabi Shetty, approached the court of the chief judicial magistrate here on Wednesday November 30 through an independent lawyer, seeking to annul the general power of attorney (GPA) issued by main accused in the murder case, Rajeshwari Shetty, who is in judicial custody, in favour of her mother, Sumathi Shetty.

Gulabi has argued that a person who is in some sort of custody cannot conduct any business or other dealings without the approval of the court. She has wondered as to how could Rajeshwari hand over the GPA to her mother in spite of being inside jail. This is the bone of contention on which this petition is based, family members of Gulabi have explained.

Main accused in the case, Rajeshwari Shetty, Navneet Shetty, and Niranjan Bhat, as well as persons accused of destroying of evidence, Srinivas Bhat and Raghavendra, were produced in the court of the additional senior civil judge and chief judicial magistrate here on Wednesday. As Srinivas Bhat and Raghavaendra had failed to attend the court proceedings in spite of serving summons during the last hearing, the court had issued arrest warrants against them. They provided clarification for their absence, which was taken on record by the court. Judge of the court, K Rajesh Karnam, ordered extension of the judicial custody of the three main accused named above till December 14.

The bail application moved on behalf of Rajeshwari Shetty in the district and sessions court here stands adjourned again, to December 6. As the newly posted judge is yet to report for duty here, the matter was taken up by the court of the additional district and sessions court at Kundapur.

    People of her locality must unite and reactivate this case and try to get portion of property to this poor mother. Instead of approaching those sold lawyers better to approach any welfare organization to yield any justification for her cry.

    It appears her lawyers are fooling her. As a long as the person is alive, not d mentally incapable, the person can issue a GPA to any other competent person. It does not matter if the person is in jail or otherwise. Her situation is sad, but it looks even worse when people try to misuse the situation for their own benefit.
