HC quashes Centre's notification to ban FDC drugs


New Delhi, Dec 1 (IANS): The Delhi High Court on Thursday quashed the Centre's notification to ban 344 fixed dose combination (FDC) medicines.

The brands included D'Cold Total, Corex cough syrup, and Vicks Action 500, among others.

Justice R.S. Endlaw, allowing the 454 pleas filed by the pharma companies, quashed the Centre's notification issued on March 10.

Companies like Pfizer, Glenmark, Procter and Gamble, Reckitt Benckiser, Cipla and others had moved the court against the government decision. The court had granted stay on the notification.

The government had told the court that FDC medicines sold by pharma majors "endanger patient safety".

It had banned the drugs on the ground that they involve risk to humans and hence needed to be withdrawn immediately and contended that safer alternatives were available.

The pharma companies had argued that the ban order was passed without considering clinical data and had termed the government's claim as absurd.

    The parent companies of most of these Indian subsidiaries are more than 200 years old with solid clinical research behind them and they will not take the things lying down. I know a British co. now merged with Glaxo, who fought with govt, when govt told their drug was substandard. They took the case to final and showed the govt. that govt's analytical lab was not fully equipped to check their sophisticated drug, since they were the pioneers in the world of that drug.

    Drugs should not contain poisonous substance.
    It is not good to allow everything.
    There should be court committee to learn clinical data and allow them. Also document court finding

    When these reputed pharma companies told court that govt ban order was passed without considering clinical data, court would not quash the order without checking the clinical data from these companies.
