Supreme Court rejects plea for playing anthem in courts


New Delhi, Dec 3 (DHNS): The Supreme Court on Friday declined to entertain a plea by an advocate to play the national anthem not only in cinema halls but also in courts across the country before the start of the proceedings.

A bench of Justices Dipak Misra and Amitava Roy told advocate Ashwini Kumar Upadhyay not to “overstretch” the order passed on Wednesday. “Whether right or wrong, we have already passed our order...it cannot be overstretched now. We are not inclined,” the bench said.

When Upadhyay said the court order was “great” and “historic” and it should be emulated in the courts also, the bench said, “You don’t have to put adjectives. We have already passed our order and it was in connection with a specific petition.”

Attorney General Mukul Rohatgi, who was called as Upadhyay mentioned his plea, supported the court’s view.

He also said the application filed by the lawyer was not in appropriate format. The bench said the bar should show some restraint and try not to stretch it too far. Upadhyay submitted that he would file a separate petition with this plea but the court said it would not want to comment on it.

The apex court had on Wednesday directed all the cinema halls of the country to play the national anthem with national flag on screen in order to instil “committed patriotism and nationalism”.

The court also ordered those present in theatres to stand up to show respect when the national anthem is played.

    This order to sing national anthem each time a movie is shown is going too far. Granted the anthem should be played at national sports events and other public functions \. However the court must also lead the way. It should show that what is sauce for the goose is also sauce for the gander. The anthem is played on Remembrance Day and Dominion Day in churches in Canada which should be done even in Indian churches on Independence Day and Republic Day. Is it asking too much? Can the same logic used by the Court not to play at the opening session of the yearm be applie to churches, tha it is interfering with the internal affairs.

    Real nationalism lies in abiding the constitution of the country, helping your fellow citizens, fighting for the country. But movies don't deserve the grace of the national anthem. The anthem should be played only on appropriate moments

    I will Say NATIONAL ANTHEM should be played in Every Parliment Sessions on After Every Break and Even in All Police Stations...

    Why??? for instant if you go to watch movie daily are you going to sing once in a week or daily? guys they are public servants, government employees not a outdoor staff/officer or a labourer/helper, so they should be the first.

    No need to play anthem in courts as already many pending cases lying from last 20 to 40 years..waiting for judgement.
    Better introduce same in all jails so that they understand how to love nation and not against it.

    If people who wish not to stand in theatres...can toil outside for ten minutes and have 'paan parag'...only option left.
