Gujarat Bano gangrape : Bombay HC denies death penalty for convicts, upholds life imprisonment


NEW DELHI, May 4 (Agencies) : The Bombay High Court on Thursday dismissed CBI's plea seeking death penalty for three out of 11 people in the 2002 Bilkis Bano gangrape case and upheld the trial court's verdict of life imprisonment.

The court also set aside the acquittal of five policemen in the same case and directed the Central Bureau of Investigation agency to probe them.

The court rejected appeals filed by the convicts against life sentence awarded to them by the trial court.

Eleven convicts, who were sentenced to life imprisonment by a trial court in 2008 for raping Bilkis and killing her family members in the aftermath of the Godhra riots, had filed appeals in the high court challenging their conviction.

The CBI had also moved the high court, seeking death penalty for three of them.

In January 2008, a Mumbai court had held the 11 convicts-Jaswant Nai, Govind Nai, Shailesh Bhatt, Radhyesham Shah, Bipin Chandra Joshi, Kesarbhai Vohania, Pradeep Mordhiya, Bakabhai Vohania, Rajubhai Soni, Mitesh Bhatt and Ramesh Chandana-guilty of murder and gangrape among other charges.

All of them were awarded life imprisonment. It was the case of the prosecution that in March 2002, Bilkis’ family was attacked by a mob at Randhikpur village, 250 km from Ahmedabad in Gujarat.

Bilkis, who was 19 years old at the time and five months pregnant, was gangraped by the convicts. Fourteen members of her family were killed. The Supreme Court had ordered a re-trial of the case in Mumbai.

    Bilqis Yakoob Rasool alias Bilkis Banu is a living tragedy.When fellow villagers raped her during the post-Godhra riots she was five months pregnant.
    In the accompanying violence, she lost 14 relatives, including her three-year-old child, mother and two sisters.

    Since independence 'communal violence' killed more than total terrorist attack in the country. All the past and present government are not reluctant to solve the problem once for all rather exploiting the religious sentiments to insight each other for political gains.

    If anyone understand the chronology of communal violences across India BJP is the only beneficiary. In most of the cases communal tension begins prior to election season and escalate before it concludes. If opposition party counter the BJP then they will tag them as minority appeasement. No party knows how to counter BJP communal agenda.In comparison communal violence and terrorist attack lives the same death and destruction.

    One of the deteriorating condition of law and order is lack of accountability and absence of stringent penalty. Bombay HC court is know added to the vows of victim who suffered the most. Balkis bano who has lost her 14 members of her family has suffered more than 'Nirbhaya' rape case living dead life. Impartial judgement by judges are only encouraging the accused who will soon bail out threaten the victim.

    Baliks bano hails from Gujarat when BJP is ruling under Modi. Why all those tears dried out by BJPians who are sobbing day in and out from Muslim women for 'Triple talaq'? Why this widow's cry can't be heard by the PM Modi and his party comrades? Why there are no 'Mahapanchayat' to save someone's daughter to get justice? Why can't PM take selfie with victim ask the nation to respect the 'beti' of others?
