Maharashtra at SC against decriminalising of beef possession


Mumbai, Aug 11 (IANS): The Maharashtra government has approached the Supreme Court against a Bombay High Court order which had decriminalised possession of beef where animals are slaughtered outside the state.

On May 6 last year, the Bombay High Court struck down as "unconstitutional" provisions which held mere possession of beef as crime, saying only "conscious possession" of the meat of animals slaughtered in the state would be held as an offence.

The high court had struck down sections 5(d) and 9(b) of the Maharashtra Animals Preservation (Amendment) Act, which criminalised and imposed punishment on persons found in possession of beef of animals, slaughtered in the state or outside, saying it infringed upon a person's right to privacy.

Challenging the high court order, the Maharashtra government said restriction imposed by the Act on possession of flesh of cow, bull or bullock could not be interpreted and concluded to be an infringement of right to privacy.

Under the Act of 1976, there was ban on cow slaughter and possession and consumption of their meat, but in 2015, the ban on slaughter of bulls and bullocks was also included in the Act by an amendment.

The high court in its judgement had upheld the ban on slaughter of bulls and bullocks imposed by the Maharashtra government, but had decriminalised possession of beef in case the animals were slaughtered outside the state.

    Cows will become extinct in India,not by slaughtering but people will not keep the anymore because it is too complicated ....and because humans have actually given it a mother's place....just because they drank it's milk. The same people forgot that there are many who also drank goat and camel milk..

    Why beef/mutton only ? Ban chicken/egg/fish. Ban plucking anything from a plant/tree because it hurts it. People can eat only what if fallen from trees.

    Make this a Supreme Court Order !

    Possession of beef in Maharashtra slaughtered outside is not okay.
    But beef slaughtered in Maharashtra, possessed outside India is okay.

    POSSESSING, CARRYING AND CONSUMING ANIMALS FLESH FOR HUMANS CONSUMPTION AS FOOD SHOULD NOT BE DISCRIMINATED OR PROHIBITED.

    KINDLY DON'T DICTATE US WHAT I SHOULD I EAT AND WHAT I SHOULD NOT EAT. WHAT SHOULD BE IN MY PLATE AND WHAT SHOULD NOT BE IN MY PLATE.

    PROHIBITION ANIMALS FLESH FOR HUMANS CONSUMPTION AS FOOD IS NONE OF ANYBODY'S BUSINESS.

    Bovine population shall go in line of MALE infanticide. A male calf shall be put to death at birth and only female calves shall be raised. Reason ? Female calves grow up as cows and give milk. What would the bulls do ? For irrigation, now we have machinery. With scarcity of fodder and non-requirement of them during off-agriculture season, farmers are unable to sell them under present law. Why suffocate a farmer ? Issue tilling machinery to farmers and do ways with bulls. No killing of non-milking animals, no beef in circulation.

    How will a cow get to calf bearing state ? Well, ask that to RSS dictators !
