SC verdict on triple talaq progressive: Pinky Anand


New Delhi, Aug 22 (IANS): Additional Solicitor General Pinky Anand on Tuesday hailed the Supreme Court verdict on triple talaq as "progressive" and said the community already found the practice "derogatory".

"It is a very progressive judgement. Triple Talaq is something which is being looked down upon as derogatory within the entire community," Anand told NDTV.

Asked if the triple talaq should now be considered unconstitutional, Anand said: "Yes, by the 3:2 majority of the judgement, it is."

She added that Chief Justice J.S. Khehar has, for the time being aside from his view on the subject, "injuncted" the practice for six months and directed that the government look into it by means of appropriate legislation.

She also said that Justice Kurian Joseph has relied heavily on Shamim Ara's judgement which has also deprecated these practices.

The Supreme Court on Tuesday held triple talaq being practised by the Muslim community as "unconstitutional", "arbitrary" and "not part of Islam".

A five-judge constitutional bench by a 3:2 majority judgement said there is no constitutional protection for triple talaq.
