SC judgement a setback for NDA government: Congress


New Delhi, Aug 24 (IANS): The Congress on Thursday described the Supreme Court judgement on right to privacy as a landmark verdict and said it was an obvious setback for the government which had argued that there was no fundamental right to privacy.

Reacting to the apex court judgement, Congress leader P. Chidambaram told the media: "Today we can again celebrate our freedom. Tomorrow, there will be other challenges, other questions and other attempts to invade the right to privacy. We should overcome those challenges too."

Welcoming the unanimous ruling, Chidambaram, himself a leading lawyer, said: "We salute the Supreme Court and many counsel -- senior and junior -- who worked tirelessly, did extensive and splendid research and presented persuasive arguments before the court.

"The judgement delivered is a landmark verdict and will rank among the most important judgements delivered by the Supreme Court since the advent of the Constitution of India."

He said the freedom won in 1947 was enlarged and enriched from time to time by the wisdom of Parliament and the sagacity of the Supreme Court.

The former union minister said the most important fundamental right of a citizen was embodied in Article 21 of the Constitution.

"It is the right to life and liberty. Civilized societies will breathe meaning into that precious right and guard against any erosion of that right."

He said privacy was at the core of personal liberty. In fact, privacy was an inalienable part of life itself. By virtue of Thursday's judgement, Article 21 had acquired a new magnificence.

Replying to questions, Chidambaram said the judgement was obviously a setback because the highest officers of the government argued that there was no fundamental right to privacy. The unanimous nine-judge bench ruling said it was a fundamental right.

Answering queries about Aadhaar in the backdrop of the controversies surrounding it, Chidambaram said the Aadhaar that the UPA government conceived was perfectly compatible with right to privacy.

"Aadhaar was conceived as an administrative tool in order to ensure that the benefits reach the targeted people. It is not Aadhaar that is inconsistent with right to privacy. It is the interpretation of this government over Article 21 which is invasion of right to privacy.

"It is the current government which argued that there is no fundamental right to privacy," he said.

Chidambaram said one had to go through the original papers on which the Aadhaar decision was made. It was mainly intended to see that the benefits of the government schemes reach only the right people and that there was no duplication or falsification.

Maintaining that Aadhaar cannot be the "be all and end all" of all administrative issues, Chidambaram said the NDA government's approach to Aadhaar was totally inconsistent with the UPA government's. That is why, he said, all these disputes and challenges had arisen.

    The BJP's true face is exposed that there is no Right to Privacy. Similarly the Supreme Court has permitted total freedom of Speech on the Social Media or else intimidation would have been galore with arrests. Hope our High Courts will also protect our rights as gauranteed by the Constitution.

    This aadhar card has given me innumerable problems.

    1. I had to stand 4 hours in hot sun while submitting application.

    2. Now it is mandatory to link to income tax. My Aadhar was not accepted by Pan Card linkage due to one extra alphabet in the name. I could do the change since while applying for card, mobile no was not asked. Now without mobile no in the card, you can not do anything online since there is OTP. Mobile inclusion can be done only in aadhar office. I went there and done. Anyway, income tax now accepted.

    3. I am frequently getting message from airtel that the mobile number has to be linked with Aadhar. Mumbai no, I got linked. For Mangalore sim card, they told me to go to Mangalore.

    4. I have ration card in DK and my relative told me Sept 02 is the last day for linking ration card to Aadhar. I have to go to my panchayat office with documents, otherwise ration card will be cancelled.

    5. I think a day is not far off when I will have to link my Aadhar card with my wife's card.

    Congress ruled this country for sixty years and brought this vibrant nation to this shape with sheer corruption, nepotism and appeasement. Chidambaram is one of the most corrupt politician India has ever seen and he is not as simple as he is visible outside. There hides a cunning politicians in his white wrinkle free khadi attire. He did all improprieties through his son Karthik who is facing the music now. He is a master in double talk. UDAI and Aadhar is brainchild of UPA and they spent 85000 Crores to implement this Unique Identification Scheme without proper homework. They brought one of the best technocrat modern India has ever seen to head the scheme and left him in the lurch when their scheme kicked up controversy due to internal politics. Chidambaram is a frequent traveler to international cities and can you show me his single photo in western attire appearing in Indian media. Does it mean he is travelling to all international destinations in true Indian khadi attire......? A good PR team works behind to make him more presentable and acceptable to the public...!

    Supreme Court decision making privacy a fundamental right of citizens is a supreme slap for this BJP government who want to intrude into the private information of all citizens thereby assuming all citizens are criminals.

    Congress government did not make compulsory aadhaar linking to PAN, Bank account and mobile number for those not taking government subsidy. However, that is what the BJP government are doing to intrude privacy of citizens by making compulsory linking. Congress party brought in aadhaar only to ensure that government schemes and benefits like LPG gas cylinder as well as other benefits like MNREGA meant for the disadvantaged people of society receive government benefits directly so that they will not be taken away by middle men, agents or government officials responsible for distribution of those benefits.

    Sandesh,
    One more thing is that during the Congress government they did not even make having an aadhaar card compulsory. However, certain government offices like RTO (for Driving licence) in some states arbitrarily made it compulsory although as per law they did not have the right or authority to demand aadhaar. If at that time they were challenged in court by citizens they would lose.

    i don't think its a set back............surely it is set back for security of this nation.....every person should have an I.D ......there should not have any excuse with it .......terrorist and terrorism will not see privacy .....
