Panaji, Jun 4: Although the medical report confirmed that there were no sperms in vagina or mouth of British teenager Scarlett ruling out rape on her, the Goa police on Wednesday said that the rape charges are being established on circumstantial evidence.
"We have an eye witnesses account and circumstantial evidence to establish rape and our charges are based on them," Superintendent of Police (north) Bosco George said.
The medical report has not confirmed presence of sperms in vagina or mouth of scarlett, which virtually ruled out any sexual intercourse or oral sex prior to her death.
The police, however, dished out their own theory based on medical findings too.
"The post mortem report indicates that there were tears on vagina which are clear indications of sexual intercourse," George said.
British teenager Scarlett Eden Keeling's bruised semi nude corpse was found on Anjuna shore on february 18.
The police have already chargesheeted two locals -- Samson D'souza and Placido Carvalho -- for drugging, raping and leaving scarlett to die on shore.
George said that the police have british eye witness Micheal Mannion's testimony which reveals that he had seen accused Samson D'souza lying half naked on Scarlett, hours before her body was found. Goa police, who is waiting for the Central Bureau of Investigation (CBI) to take over the case, have stood to their contention that the teenager was raped and murdered. Interestingly, the state police was accused of goofing up the case initially, when they ruled out the possibility of rape and murder and instead termed the death as accidental drowning. After facing the accusation of wrong investigation, the police had dismissed police sub inspector Nerlon Albuquerque for "messing up" the case. The case was being handled by senior police officer Braz Menezes, who has filed a chargesheet against both the accused in the Goa children's court this week. Goa police officials confirmed that the CBI is in the final stages of taking over the case. "Since the case is booked under section 8 of Goa Children's Act, the CBI will have to notify the section," George stated.
