Judiciary, govt need to be on same page: Modi


New Delhi, Nov 27 (DHNS): Prime Minister Narendra Modi on Sunday underlined the need for the government and judiciary to be on the same page for realising the dream of 'New India', but wondered whether they are working in unison.

Addressing the valedictory session of the Constitution Day celebrations, Modi said the occasion raises an important question on the relationship between the three arms of the government - legislature, executive and judiciary.

"The Constitution has ensured that we move forward through the path of democracy and it prevented us from wavering from the path. The government, judiciary and bureaucracy are party of this family. This occasion raises an important question. As members of this family, are we adhering to the norms, which the Constitution wants us to follow?" Modi said.

On whether these branches of the government are strengthening and cooperating with each other, the prime minister said this question is not linked just to those working in the government and judiciary as it is "linked to all institutions of the country on whom crores of people have placed their faith".

"The question is whether these institutions are working towards development, whether they are understanding the needs of the country, whether they are understanding the challenges this country faces and whether they are understanding the needs of the people. The question is whether they are cooperating each other. Are they supporting each other, strengthening each other?" he said.

He said the Constitution envisions separation of powers, which could not be violated. "The legislature should be free to frame laws, the executive should be free to take any action and the judiciary should be free to interpret the laws enacted by the legislature," he added.

Modi's comments came as senior Union ministers Arun Jaitley and Ravishankar Prasad locked horns with Chief Justice Dipak Misra on the question of judicial activism.

    In recent days Indian Judiciary became mockery of democracy. More and more criminal politicians to terror suspect are getting 'clean chit'. Here are the few example;
    The death of Brijgopal Harkishan Loya, the judge who was hearing the matter of the allegedly staged encounter killing of Sohrabuddin Sheikh. On November 30, 2014, Loya was in Nagpur attending a wedding. At 11 pm, he phoned his wife on his mobile phone and spoke to her for around 40 minutes. On the morning of December 1, 2014, an RSS worker named Ishwar Baheti informed his family about his death. To this day, the family does not know how Baheti came to know about the judge's death and why he was involved in moving the body to the judge's native village of Gategaon.
    It was Baheti, not the police, who returned Loya's mobile phone to his family, three to four days after his death.The judge's sister, Biyani, told the then chief justice of the Bombay High Court, offering him a bribe of ₹100 crore in return for a favourable judgment.
    In cash-for-bail scam involving mining baron and former Karnataka minister Gali Janardhan Reddy as a lower court judge, arrested in the case, disclosed to the ACB that Gali's men were ready to offer as much as a staggering Rs 100 crore to secure bail for him. T Lakshminarasimha Rao, the arrested judge, disclosed that Dasaradha Rami Reddy, a relative of Gali, had made the Rs 100 crore offer, according to the confessional statement recorded by the ACB.
    In both the cases Judges are found murder and the accused are free on bail.
    In recent case of Prashant Bhushan appeal rejected by Chief Justice Misra to investigate Odisha judges is another setback. In another case Supreme Court annulling Hadiya legal marriage a consent adult and referring the love marriage to NIA investigation is nothing but mockery of system.

    How can they be on the same page . Judiciary is the watch dog ....let say dharmedra pradhan in investmenst of 60000 crores in refinery when refineries are clsoing down and we are moving to other forms of energy ..?? you want judicary to say yes its a great idea

    As it is taught in Civics, as it is known in any democracy; the Executive branch, Legislative branch and Judicial branch of democracy are independent of each other. In democracy these three branches of constitution have differences of opinion now and then. It is Judicial system which has final say in any constitutional interpretations, a guiding force to the elected government.

    Indira Gandy ( a. k. a. Indira Gandhi) did not respect the verdict of Allahabad Court when her election from Rai Bareli was nullified by the court. She became autocratic and within few months suspended Indian Constitution and imposed emergency. During emergency she elevated junior judge Justice Chandrachood as the Chief of Indian Apex Court. In protest few judges resigned, including our district intellect Justice K. S. Hegde. All over the world there are numerous examples, where interfering government in Judicial system has been voted out or overthrown...

    All over the world democracy is an efficient government if Executive, Legislative and Judicial branches of Government are independent of each other.

    This joker and dictator already hijacked Election commission, ED, IT Dept, CBI etc. Now he want to bring judiciary under the saffron fold. Hope his dream will remain dream only and Modi cannot hijack our country's judiciary system. As per the constitution, govt & judiciary are the different bodies and govt cannot influence on the judiciary. Dear Modiji, just keep quite, you have another 1.5 years to rule this country and you already damaged the country enough.

    Judiciary is the power which protects citizens rights as per the constitution and the judiciary should not be in par with the Government.

    Especially the RSS chaaiwaala Prime Minister of India who has only one sided agenda. Government should not pull the Judiciary and the Judiciary should be independent.

    The BJP government is partisan and accomplishes parties developments rather than the development of India. See the Bullet Train. He started the fast train to Gujarat. Why he didn't start from commercial city of Bombay to Delhi???!!!

    The congress with relentless, sleepless with determination was built in more or less in 65 years. We were the III largest economic power in the world.

    NOW WITH THE MINDLESS DEMONETISATION AND HASTILY IMPLEMENTED G.S.T., THE ECONOMY OF INDIA FELL LIKE A PACK OF CARDS.

    Hitherto the judiciary is known & functioning independently under the parameters set by the Constitution of Hindustan..., there was no scope govt., interaction & interference in judiciary..., if judiciary is expected to function in line with govt's wishes .., then it will be the end of diverse country like Hindustan...,

    Time for all right thinking Hindus to come in unity to fight against such degeneration of Secular Credentials of Hindustan...,
