Office of profit crisis: Prez okays disqualification of 20 AAP MLAs


New Delhi, Jan 21 (PTI): President Ram Nath Kovind on Sunday accepted the Election Commission's recommendation to disqualify 20 MLAs of Delhi's ruling Aam Aadmi Party for holding offices of profit.

A notification issued by the law ministry quoted the president as saying that in the light of the opinion expressed by the Election Commission (EC), the 20 members of the Delhi legislative Assembly have been disqualified.

The AAP MLAs were appointed parliamentary secretaries and their appointment was described as them holding offices of profit by a petitioner.

In a blow to the AAP, the EC had on Friday asked the President to disqualify its 20 MLAs.

"...Having considered the matter in the light of the opinion expressed by the Election Commission, I, Ram Nath Kovind, president of India, in exercise of the powers...do here hold that the aforesaid 20 members of the Delhi legislative assembly stand disqualified from being members of the said assembly," the notification said.

All the 20 AAP MLAs had moved the Delhi High Court challenging the poll panel recommendation but Justice Rekha Palli had refused to pass any interim order.

    The election commissioners must explain to the Indian people why elected officials in BJP ruled states have not been disqualified for holding offices of profit. The EC decision to target selectively AAP in Delhi has damaged seriously its claim to be an autonomous constitutional authority.

    I am glad that you guys are very concerned about Democracy is in danger!!
    I feel democracies more endangered when emergencies imposed, the country is sold to the highest bidder, when there are scams. All over the country, when one religion is pitted against the other religion, when the borders are not safe and secure and families Run political parties and run it like a business and people belong to these parties promote their own children. Look at our own Mangalore and see all the political leaders who have amassed huge amounts of wealth and we call them leaders and some of you people call them heroes
    Thank God you still have a voice and the justice system that you can count on a few things. if Injustice was done or rules were broken One could go ahead and go to court and fight.
    The system was broken and it is going to take a long time to fix. And just because it doesn't happen the way you want it or your party wants it- IT DOES NOT MEAN THAT DEMOCRACY IS IN DANGER. It only means things that have been done wrong, have to be done right and the time has come. As I always say there are many parts of the world where people do not have these opportunities and please go to these countries. If you think they're better suited for your ideologies and needs.

    Office-of-profit case MLAs’ disqualification by Chief Election Commissioner Achal Kumar Joti is gift to the PM. Did Joti decide to carry out a ‘favour’ for someone just before his retirement? Joti sahib is considered to be quite close to the ‘Big Boss’. He was Modi’s Chief Secretary during his tenure as CM of Gujarat . He was later made the chairman of the Kandla Port Trust. His appointment as CEC after the Modi government coming to power cannot be a mere accident.
    It is common knowledge that the BJP was in bad shape in Gujarat due to demonetisation and GST. The business community was especially upset over the implementation of the GST. The Commission, while announcing a date for elections in Himachal Pradesh, evaded Gujarat.
    This, despite the fact that both elections were supposed to be conducted together, results were to be declared together, and new governments were to be formed at the same time.Till this day, there has been no concrete answer to why this was done.
    The disqualification of MLAs further strengthens this suspicion. This is perhaps the first time in the country that the accused have been sentenced without giving them a chance to present their side of the story.
    It appears that this decision was taken to hurt the AAP government. The BJP has been looking for an opportunity to do this for a while. MLAs being thrown into jail under ‘false cases’, income tax notices being sent to AAP on ‘fake charges’, among others all these seem to be attempts in this direction.
    AAP MLAs’ Disqualification Proves EC & PMO’s ‘Collusion’.
    Any attempt to create an Arunachal Pradesh or Uttarakhand-type situation, and then form a government through the back door, is bound to boomerang and will only make AAP stronger. Such attempts are likely to damage the BJP’s prospects in the Lok Sabha where it swept all seven seats in 2014.
    Ugly ongoing interactions between the LG and AAP have been the order of the day. Now with President nod another elected democracy is finished.

    This is a huge victory for AAP. Delhites did not vote AAP to power twice just by faking and vendetta politics, Kejriwal's has proved something beneficial to Delhites. Now people will come out in huge number to give AAP sympathy vote which AAP can do even without it. BJP has gone further down with this cheap politics and it has made itself impossible to win Delhi elections.

    President has been nominated by their respective majority Government to their party politician or supporter. Unfortunately in India some of them favours on party lines which is unfortunate and spoil the reputation of the post.     EC advocate lied in HC. Didnt know if order sent to Prez on Friday.
    AAP wanted to meet Prez but Prez denied....

    Dear EC, please act on some other Political Parties elected representative also, there are many such who are in business of "office of profit", giving statement against Constitution of India, calling public as "DOGS", MLA/MP with charges of Murder, Looting public etc....
