Bengaluru, Feb 28: The court, which took up bail applications moved by Mohammed Nalapad and his associates, accused of assaulting Vidwath in Farzi Cafe in the city, adjourned hearing into the bail petition to March 2, after hearing arguments and counter arguments placed before it by advocates from the two sides on Tuesday February 27. The court said that verdict in the case would be delivered on Friday.

Advocate, Balan, arguing on behalf of the accused, advised the special public prosecutor to place truth and documentary evidence before the court rather than relying on principles, imaginations and exaggerations. He noted that the objection moved by the special public prosecutor is not backed by documents. He noted that the objection filed contains imaginary things and exaggerations and that the hearing in courts cannot rely on media trial.

He said that there are doubts in several issues in the entire case. "Complaint in the case was filed at 11.30 pm on Februrary 17. It is alleged that the accused also came to hospital to assault Vidwath. Hospital records say Vidwath had been admitted at 12.19 am," Placing documentary evidence before the court, he wondered whether the accused barged into hospital an hour before the victim was admitted there. He also wanted to know why the hospital staff did not register complaint if the people concerned had actually entered the hospital without authorization. He also wanted to know from the special public prosecutor the basis on which he has been saying that Vidwath would have to remain in hospital for eight more months. "Hospital doctors have said he has shown 90 percent improvement. Does it take eight months to heal balance ten percent? The special public prosecuctor says that Vidwath had not consumed alcohol. Had he gone there to consume milk?" he enquired.

Another advocate, Tommy Sebastian, also provided hospital documents to prove that there are lot of changes between what the special public prosecuctor is claiming and what records say.

Special public prosecutor, Shyam Sundar, said that second complaint was filed after first information report was registered on the basis of first one. He said that the second complaint was filed by the accused because of guilt and precaution that he will face problems if the victim of the attack succumbs to his injuries. He also questioned why the accused was not arrested when he came to deliver the second complaint. He argued that the accused should not be granted bail.
