In a curious incident which happened in Ira village in the taluk on Saturday April 14, officials raided a house in the village when an engagement ceremony connected with marriage was in progress, and arrested the owner of the house. The officials, who were strictly enforcing election code of conduct, ensured that the arrested man was put behind the bars.

Steven D'Silva from Ira village was remanded to judicial custody and lodged in the district prison at Mangaluru on Saturday night relating to this incident.

The engagement ceremony of Steven's brother's daughter had been arranged to be held at Steven's home where both families live together, on Saturday afternoon. All arrangements were in place, and guests had begun to arrive since morning. Even as the family geared up for the ceremony, excise department officials raided the spot at about 9.30 am on Saturday and found during the search operations that liquor was stored in the house in excess of quantity permissible as per code of conduct rules. They registered case against Steven and arrested him. When he was produced in the court, his bail plea was rejected and as such, he was sent to jail.

Excise officials have said that even in case of private functions where purchase bills and receipts are maintained, no one can store liquor in excess of two litres. They stated that they found 16 litres of liquor including beer during the raid on Steven's house. Although Steven, and his elder brother who came from abroad for the function, explained to the officials that about 600 people had been invited for the function, and requested them not to create obstacles for the auspicious function, the officials did not pay heed, it is said. The officials, who were reportedly from Kolar, did not relent even after the local traditions and customs were explained to them, it is gathered.

Locals have expressed their resentment about such actions, pointing out that higher officials have been repeatedly saying that no permission is necessary for holding private functions. At the same time, restrictions of the above kind are being enforced, putting people into unwarranted hardships. They feel that if the people were properly educated about such rules, incidents of this kind would have been avoided.

Deputy commissioner of Dakshina Kannada district, Sasikanth Senthil, said that he cannot pass any comment about the incident as he was not aware of the details of the case as yet.

President of the taluk panchayat here, Chandrahas Karkera, felt that such incidents are happening as people in general do not have sufficient knowledge about the election code of conduct, and also as officials have failed to spread awareness about the rules properly. The police department also was not having information about this case as it was handled by excise department officials.

The incident has driven home the need for the people to acquaint themselves properly with the election code of conduct rules and abide by the rules in all seriousness.

    One of the clauses in election code, as I understand, is not to induce any voters by giving them food,liquor, sarees or any other gifts. Engagement party is not a gathering to induce any voters. Here the Excise Department should have used their common sense, if at all they have it. This case needs to be investigated and stern action should he taken against the officials included in sending the accused to custody. Even the judge should have used his judgement in deciding whether or not it was a gathering related to the election. The dignity of innocent man has been tarnished by sending him to custody. The Excise department was utterly failed in using their good judgement whether these invitees of engagement party are the class of people who can change their voting preference just for couple of drinks? Or is it a simple case of "Hair of the Dog" that bit these people to seize the alcohol.

    I totally agree with what u have said, if government has such law why don't they put it at the sellers end.its a pity these exisise people had to come all the way from Kolar spending tax payers money, just to cease 16 Ltd of liquor, what a catch , when crores of rupees worth illegal liquor is changing hands.looks like foul play in the name of code of conduct1407

    What are the excise department from Kolar doing in Bantwal?
    Two litres of spirit is allowed to be brought in when coming from abroad. If one makes two trips and request acquaintances to get two bottles each there is enough liquor for the function. when one gets liquor from abroad it isn't usually consumed in a jiffy and kept behind for family functions.
    the excise people raided the place even before the function started!
    Definitely something fishy.

    There are two operative sentences in the report with the following quoted elements:
    “ ...where both families live together ..” and “..16 litres of liquor including beer...”
    While I am doubtful about the limit of liquor mentioned in the report, the lumping of liquor and beer is wrong and mischievous, if not motivated – may be for collateral purposes. The alcohol content of liquor ( say whiskey) and beer have a large difference and lumping them together is wrong
    Two families living under one roof can have common storage ( including for liquor) or bathroom and toilet. Then why concentrate on one person who is fronting the celebrations?
    With 600 guests are expected, it was a tempting opportunity to blackmail for the family’s enemies and/or for the raiding party itself. The election code of conduct can have absurd outcomes and this a classical case of mindless intrusion of normal celebrations.

    These excise dept people have no thinking capacity. Somehow they want to catch few poor people who genuinely want to celebrate functions without any disturbance to election process. Yes, the rules are made for smooth progress of elections and not for stopping family functions. Are these Excise people not capable of reasoning which one is actually affecting elections? If they are really duty conscious, why are they not stopping sale of liquor without permits, keeping improper account of liquor sale, etc. Everyone knows that political parties will still hoard liquor and use it for campaigning. Can these excise people spend their intelligence in nabbing such people? No. That is because they dont benefit by doing such sensible acts. Instead if they catch some poor family people, they know very well that they will get lot more than what they will get by catching political parties.
    People will not keep quiet if such things continue. Soon everyone will fight back and nab the wrong doing officials.

    Congress is used to these types of things. During Emergency time of late Mrs. Gandhi, Tums-up was recommended instead of wine for "raising the toast" during functions. I practice non-alcoholism; still If 600 are invited, 16 liters are well within limits of election rule, simple arithmetic show that EC rule is not violated.

    I'm surprised about this crazy law. In the UK /USA / Japan / Australia , bars and wine shops are wide open during the election and on the counting day. Blame our uneducated law makers ( we vote for them ) fir this mad law.

    The wine shops should be held responsible if they open one bill of 16 liters without asking the buyer to obtain a party licence. It is the duty of seller to explain and restrict himself from selling such quantity during election code of conduct is on.

    Lacer, providing liquor in the program is hosts choice! Only people interested consume and enjoy it! No one is forced. You can refrain from serving alcohol when you are the host. Do not extend the advise to whole community in a sarcastic manner. Many hosts do not drink, yet they serve it guests! Remember age old saying....Athithi Devebhava!

    But how come Wine shops, Bars are allowed to store more than this quantity that to in public places?
    It's private function. That to in a remote location.
    Anyway they spoiled the Engagement party. Wht to do? This is how common man are treated in country and the great great great laws, justice system of this nation.
    Privately not allowed but in Public Wine stores, Bars can sell large quantities of Liquor. What type of law?

    Always innocents have to follow rules but the powerful don't have to follow any rules, this is the status of this country.
    Why Wine stores, Bars are open in first place? Close all Wine shops, Bars during your election.
    I feel people should completely get rid of this liquor, liquor is not good. Avoid liquor in the functions, parties especially Christians. Please get rid of this liquor culture.
    We in our family functions, we clearly mention in the invitation card itself that "Liquor will not be served", so that those who want they can make their own arrangements.

    Funniest part is Salman Khan will get a bail and this poor man's bail plea is rejected.

    I have asked this question a couple of days back should liquor to be served in our own RESIDENCE for marriage or roce or engagement during this period.The Election officer has given clean chit that no permission is needed for private functions such as marriage and so on.This is absolutely rude when the owner is arrested when the function is going on.Tomorrow just imagine when there is a mourning supper in the house where people gather for condolence will they arrest the owner of the house during sadness.This is mystery.
