UP woman given triple talaq, forced to leave husband’s house over burnt chapati


Banda, Jul 9 (PTI): A woman has complained to the police that she was given triple talaq and forced to leave her husband's house because the chapati she had prepared got burnt.

The incident took place in Pahretha village of Mahoba district in Uttar Pradesh and it came to light after the 24-year-old woman registered a complaint with the police on Sunday, senior police officer Banshraj Yadav said.

On the basis of her complaint, a case of domestic violence will be registered against the husband, he said.

The woman, who got married in 2017, also alleged that her husband had inflicted burn injuries on her with cigarettes three days before 'divorcing' her by way of triple talaq, the police said.

The Supreme Court had on August 22, 2017 struck down triple talaq, calling the practice unconstitutional and in violation of Article 14 of the Constitution, which provides for equality before the law.

The "triple talaq" bill has not been cleared by the Rajya Sabha yet.

The top court's verdict vindicates the stand of the government, which had said "triple talaq" violates fundamental rights of women. Several Muslim women who have been divorced because of it, including on Skype and on WhatsApp, had appealed to the top court to end the practice.

Three of the five judges hearing the case said it is unconstitutional; the other two wanted it banned for six months till the government introduces new legislation. The majority opinion held that "triple talaq" "is not integral to religious practice and violates constitutional morality".

    Will our mainstream media will come out of the 'choola' and 'Chapati' and focus more on women in employment, equality,gender discrimination, sexual abuse, education, hygiene, health and so on?

    Triple talaq is the deliberate political motive of BJP for electoral gains. This is nothing to do with minority women empowerment.

    If media give coverage to emotive issues, main issues will not be highlighted. This is exactly the political party of India wanted to deprive the right of the citizens.

    Every now and then when reports like these come up, many in that community are so embarrassed that they distance themselves from their fellow religionist, and so go as far as saying that those people who are doing so are not from their religion.

    There are two problems:

    1. Marriage is a contract, very similar to a buy sell agreement. Such agreements with an exit clause designed for a man to get out of that agreement with ease is a cause of all the problem. This one sided agreement leaves the woman and children exposed to all sorts of exploitation.

    2. We are living in the 21st century, but following outdated and baseless laws of the 7the century, will not work and if there are no changes to reflect the modern day. All this coupled with the above and a largely illiterate and conservative people is a dynamite to disaster.

    This 7th century religious law has given all the rights to women what the modern day laws have given her recently. In fact, more than that. As what you are expecting now, this 7th century laws have even given woman the right to give divorce to her husband. Woman can even put forward special demands if any with the husband at the time of marriage contract. The husband is also obliged to give his wife a mandatory Mehr amount as per wife's demand before marriage contract.

    Similarly this 7th century law has given even the husband the right to give divorce to his wife. But the great thing is that neither the divorce is made very difficult nor very easy in the 7th century law so that it remains impartial towards both husband and wife.

    I'll try replying your mail in bracket., but your claims are baseless and unfounded a lot of it is not based on the Sunnah, Hadiths & Qur'an that have not been abrogated.

    As what you are expecting now, this 7th century laws have even given woman the right to give divorce to her husband.
    (Woman have to go a Kazi and explain the matter to them and only if they fell the matter is 100% genuine, he will order an investigation. Then if he agrees with the finding he can assist her getting a separation, it is very long and tedious process. Whereas a man can say thrice Talaq, and then he will get another woman and he could go up 4. His ex wife and children would land on the street and their only hope is government assisted programme and help form individual or public organizations. The matter is so much out of hand now that the government has decided to intervene because no solution is coming from your sides)

    Woman can even put forward special demands if any with the husband at the time of marriage contract.
    (Poor Muslim girls are thankful that someone has married them, in most cases there is no demands from her side or she remain a spinster all her life)

    (The mandatory Mehr is called Haq Mehr, and in Indian rupees it works out to today to less than one hundred rupees, wow that's a lot of money)

    Do you know that in some parts of Uttarakhand, a girl is forced to marry all the brothers of a family at once. Why you and your bosses are not interested to ban these? Who rules in Uttarakhand? Khangress or your favorite party? Hum kare tho Balathkar, Thum kare tho chamatkar.
    Don't relate Shias with other Muslims. They are also bhakths of their desires.

    Opting to stay with a husband who can go to this extent just for being served burnt chapathi or stay away from him?
    Giving a triple talaq is absolutely ridiculous; but the wife opting to stay with that husband with the pretext that he has done wrong will be a foolish act from wife.

    Instant triple talaaq is not practice of Islam as most people thinks . If he given instant triple talaaq then he should be jailed for this. There is much more flexibility in triple talaaq if you understand it.

    Don't look at people and make fun of the religion.

    People tend to make mistakes and misunderstand the teachings unless they learn them and practice them as it is.

    You want to get knowledge go through the authentic books (In Islam its Quran and Hadees).

    One who doesn't follow the sacred books properly and performs against its interests are not the true followers (any religion it may be).

    There is no instant triple talaaq in Islam (there is procedures and conditions for it).

    No Muslims support instant triple talaaq.
