Mangaluru: Boy’s death inside lift, case filed against society management

Mangaluru, Aug 25: A case has been registered against society maintaining an apartment where a 7-year-old boy confined inside the lift lost life on August 24.
Kadri police have registered a case under IPC section 304a for negligence against the society.

The officials from the PWD department and MESCOM are collecting details regarding the apartment lift. The police will further investigate the case after receiving the report from the officials.

The last rite of the boy was performed on Friday night at Addur mosque.

Victim's father who is aboard is yet to arrive to meet his family.

It may be recalled that Muhammed Sinan (7), son of a couple from Addur, Bantwal was stuck in a lift of an apartment complex at Vas Lane in the city and lost his life.

    If the lift was old, it clearly shows that the lift has been used since long time and from then until now there was no such Incidents shown . Now when the 7 year old child got stuck in the lift u started blaming the lift for service or maintenance and not the negligence of the parents for leaving the kid alone to enter the lift .As a kid was 7 year old, it clearly indicates kid was too small to operate the lift was being stuck . So instead commenting on something take a deep breathe , we need to think a bit on it. don't simply blame the society or the management. it happens to be more responsibility to be taken from the parents by not allowing the kids to go alone on the lifts

    I do agree with you, the negligence on the part of the parent too. Some single parents where the bread winner are not with them, cannot handle children and some are too, too young to take the parent responsibility. Might be they have been forcibly married.

    Now being this is a case of death due to lift failure and case is filed against society management by the Mescon and PWD department.

    What about so many death due to the utter negligence of MESCON and PWD department. Why no case is filed against MESCON and PWD. Is it because it is government body and here it is private.

    We do share the grief on the death of this young boy of 7 years, due to lift failure. May his soul rest in peace.

    RIP, Parents should be educated . Parents should not leave their children alone to use the lifts.Many old buildings lift sensors do not work. Some people try to stop the closing lift doors and get injured. All the lift doors should have a danger sign and warning sticker mentioning Not to allow children alone to use lifts. Society should change old lifts with the new lifts.

    Its a machine and no one can guarantee its functionality. It may malfuction at any moment. Its parents duty to educate thier childern how to behave in apartments. More over parents firstly learn how to live in multistorey apaprtments. I have seen if lift is closed residents shout at assotiation and if any thing mishap occures then also association is responsible. How can any one do both things???

    In every place where lift is installed, the owner or the association must appoint a liftman in the lift to handle it.

    Young children of the apartments should be given orientation of do's and don'ts of using lifts.
    guidelines should be sticked in native language near the control panel of the lift.
    Machines are like wild pets, when they don't operate as per your instructions, they turn monstrous..

    The latest trend in big societies is that if it is a high rise building, most people especially staying on the ground floor need exemption f lift maintenance from their Society Bill since they claim they are never in need of a lift facility. Calculate that to number of flats on the Ground Floor itself and multiply it with the number of buildings within the precinct of a colony or a cooperative society, depending upon the case.

    In the past I had put forth a comment here in this very Daijiworld forum that UNLESS the lift is of a repute brand (the likes of OTIS, OLYMPUS, MITSUBISHI, SCHNEIDER, THYSSENKRUPP or international brand) there is every chance of the funds allocated for this being usurped.

    This could be one of those cases.

    The deceased victim's shall initiate criminal proceeding as well as file suit for appropiate compensation in civil court or consumer court, against building management for poor quality elevator & poor maintenance service thereto ,act of negligence which caused death of the child.

    It is easy to say to take action on
    Builder, society etc. Residents of same society donot obey basic rules. Where a lift can carry six persons it will be filled with 10. If reminded or objected by watchman same people are ready for a fight. Corporation is supposed to monitor periodically. Tell me how many times these people check personally when they came

    Lift maintenance, especially old lifts is a costly affair. Most residents in these old apartments do not cooperate with each other, hence maintenance takes a back seat.
    In a way, everyone is responsible.

    It's easy to point fingers at building association secretary and chairman. How many owners attend the association meeting? Many people from gulf give the apartment for rent and never bother to inspect their flats or about the tenants. The association office bearers spend lot of their time for implementing new ideas but there won't be sufficient support from the flat owners.
